ORDER
AND NOW, this ~ day of _~, 1998, upon receipt of the
Conciliator's Report, it appearing that the parties have agreed to the terms and provisions of this
Order which was dictated in their presence and approved by them and their counsel, it is hereby
ordered and directed as follows:
1. The parties shall share legal custody of their minor child, Trevor P.
Kirby, d.o.b. January 25, 1994.
2. Mother shall have custody of the minor child in accordance with the
following schedule:
A. On alternating wcekends from Friday at which time she will
pick the child up after work at the day care provider, until Sunday at 7:30
p.m. This alternating weekend schedule shall commence on Friday,
September 11, 1998.
B. On Tuesdays and Thursdays at which time Mother shall pick
the child up aftcr work at the day care provider and shall rcturn the child
the following morning to the appropriate day care provider.
3. Father shall have custody ol'the minor child at all other times.
4, The parties agree thatthcy shall evenly share the holidays. those
holidays bcing dclined as Labor Day, Thanksgiving. Eastcr. Mcmorial Day, and
Fourth 01' July, attimcs to be agrced upon,
5. Thc Christmas holiday shall be broken into two segments, Segmcnt A
shall be from 12:00 noon on December 24th until 12:00 noon on Christmas Day;
Segment B shall be from \2:00 noon on Christmas Day until 12:00 noon on
December 26th. Father shall have Segment A in 1998 and all even years
thereafter and Segment B in \999 and all odd years thereafter. Mother shall have
Segment A in 1999 and all odd years thereafter and Segment B in 1998 and all
even years thereafter.
6. Father shall have the child on Father's Day and Mother shall have the
child on Mother's Day, These periods of partial custody and visitation shall be
I'rom 9:30 a.m. until 7:30 p,m,
7. Each party will be entitled to two uninterrupted non-consecutive weeks
01' vacation with the child. The parties shall provide each othcr with thirty (30)
days advance notice as to when they intend to exercise these periods of
uninterrupted vacation.
8. In the event that either party needs to obtain the use of a babysitter for
an extended time 1'01' thc child, the parties shall make each other their lirst option
before employing that babysitter.
H. Need lor independent psychological evaluation or counscling: None rcqucsted and the
Conciliator docs not believe any is necessary.
