On or about Junc 22, 1996, Plaintiff was a customer at the said Giant rood Store, whcn she was caused to slip and filiI on water that was on a aisle !loor. Thc said store was at alltimcs owncd, posscsscd and controlled by Defendants, individually, jointly and/or severally, 5. As a rcsult of thc accidcnt, Plaintiff sustaincd sevcrc and disabling injurics, which arc continuing. 6. As a rcsult of her accident, Plaintiff incurred mcdical bills and cxpcnses for medical carc and treatment, and suffered pain and suffering, mental and emotional distrcss, which may be continuing. 7. As a result of her injuries, Plaintiff suffered loss of life's pleasures and diminution of daily activities, which is continuing. COUNT! PLAINTIFF v. GIANT FOOD STORES. INC. 8. Plaintiff incorporates herein by reference the allegations of paragraphs 1 through 7, as if fully set forth at length. 9. At all times material hereto, Defendant acted through its agents, servants and/or employees within the course and scope of their agency or employment. 10. Plaintiff's injuries and damages are due to the negligence of Defendant, including: A. Allowing a dangerous condition to exist on the !loor of its store, without due regard to the rights of persons such as Plaintiff; B. Failing to propcrly and adcquatc rcmovc forcign substances from the aislc floor, whcrc Dcfendant knew or should havc known customers would bc walking; C. Failurc to correct a dangerous condition; D. Failing to warn of a dangerous condition; E. Failing to keep the property frec and clcar of dangcrous substances; F. Failing to arrange for competent or qualified pcrsons to inspect and remove foreign substances from the aisle floor; G. Failing to have in place a proper and adequate policy for the detection and removal of foreign substances on the aisle floor. WHEREFORE, Plaintiff demands judgment against Defendant, individually, jointly and/or severally, in an amount not in excess of $25,000.00, exclusive of interest, costs and delay damages. COUNT II PLAINTIFF v. DEFENDANT GIANT FOOD STORE 11. Plaintiff incorporates herein by reference the allegations of paragraphs 1 through 7, as if fully set forth at length. 12. At all times material hereto, Defendant acted through its agents, servants and/or employees within the course and scope of their agency or employment. 13. Allowing a dangcrous condition to cxist on thc floor of its storc. without duc regard to the rights of pcrsons such as Plaintiff; B. railing (0 properly and adcquatc rcmovc foreign substances from thc aislc floor, whcre Defcndant kncw or should havc known customers would be walking; C. Failure to correct a dangerous condition; D. Failing to warn of a dangerous condition; E. Failing to keep the property free and clear of dangerous substances; F. Failing to arrange for competent or qualified persons to inspect and remove foreign substances from the aisle floor; G. Fail ing to have in place a proper and adequate pol icy for the detection and removal of foreign substances on the aisle floor. WHEREFORE, Plaintiff demands judgment against Defendant, individually, jointly and/or severally, in an amount not in excess of $25,000.00, exclusive of interest, costs and delay damages.
