COMES NOW, the Petitioner, DIANE M, PETTYJOHN, through her
attorneys, Kayer & Brown, and who does hereby aver as follows:
1. The Petitioner, DIANE M. PETTYJOHN is an adult individual
residing at 629 North Hanover Street, Apt, 4, Carlisle, Cumberland
County, Pennsylvania, 17013,
2, The Respondent in this action, JAMES E. PETTYJOHN, is an adult
individual residing at 629 North Hanover Street, Apt. 4, Carlisle,
Carlisle, Cumberland County, Pennsylvania, 17013.
3. The Petitioner in this action has concurrently filed with this
Petition, a Complaint for Custody of one child, Veronica Marie
Pettyjohn, date of birth March 13, 1996. The Petitioner is the mother
of the child and has lived with her her entire life,
4. The Respondent is the father of the subject child.
5. There is no prior Court Order or agreement pertaining to the
custody of the child.
6. Petitioner and Respondent reside together at the same address
at 629 North Hanover Street, Apt, 4, CarliSle, Pennsylvania, to date.
7, Respondent has planned a trip to Texas to occur on June 25,
199B.
8. The Respondent has seized the parties' child and advised her by
telephone to her place of employment that he shall not allow her to have
further access to the child.
9. Petitioner believes and therefore avers that Respondent shall
take the child with him to Texas, thereby removing the child from the
jurisdiction of this Court.
10. Respondent took these actions as retaliation to a divorce
commenced by Petitioner and served upon him on June 20, 1998.
11. Petitioner has been the primary caretaker of the minor child
since her birth.
12. It is Petitioner's intention for the child to remain in the
same home to promote her stability.
13. The best interest and welfare of the child will be served by
granting the relief requested because the Respondent has threatened to
deprive the mother access to the child and represents a flight risk,
Irreparable harm could result if Respondent removes the child from the
Commonwealth of pennsylvania, and from the mother.
WHEREFORE, the Petitioner requests this Honorable Court to grant an
Order preventing Respondent from removing the child from the
Commonwealth of pennsylvania and requiring him to turn the child over to
petitioner pending further hearing of this Court.

proceedings who has physical custody of the child or claims to have
custody or visitation rights with respect to the child.
9. The best interests and permanent welfare of the child will be
served by granting temporary primary physical custody of the child to
the plaintiff as the Defendant is a flight risk. Defendant has warned
plaintiff on several occasions that should she undertake any action to
pursue her custody rights, that he would take the child from Plaintiff,
and he plans on leaving for Texas on June 25, 1998. Granting Plaintiff

5. On or about July 13,2000, Respondent vacated the marital apartment and Respondent
also removed the minor child I'\\)\ll the marital apartment without the Petitioner's consent and relocatcd
to Lackawanna County.
6. Respondent has takcn these actions as retaliation to the pending divorce and Respondent
has taken action which indicates shc will continue to impede any regular contact betwcen thc child und
the father, the Petitioner herein.
7. Petitioner has becn the primary caretaker of the minor child since ber hirth.
8. It is the petitioncr's intention for the child to return to Cumberland County and to re\llllin
in the same home that she has heretofore resided in order to promote stability and contact with her fllther,
the child's primary caretaker.
9. The relocation 01' the child without court approval or consent of the Petitioner and is
against the best interest and wcll[\I'c of the child.
10. The best intcrcst and welfare of the child would be served by granting the relief
requested because the Respondcnt has. in her unilateral actions deprived the minor child from Petitioner,
the child's primary caretakcr and such action will cause irreparable harm to the close bond that Petitioner
has with his daughter.
11. Unlike Respondent, Petitioner will encourage close contact between the minor ehild and
the Respondent, non-eustodial parcnt, and will provide reasonable alterna.tive periods of partiul cllstody
whereby Petitioner will mect Respondent halfway between Carlisle, Pennsylvalliu IInd LuekuWllnll1l
County on alternating weekends and thereby share in the tmvel involved in the cllstody exchun[!e.
