7. Thl: suspension is based on an alleged violation of Section 1543(a) of Ihe Vehicle
Code.
8, Thl: I'laintilT did nol violate said Section, in lhal the I(lllowing were improper:
a. I'laintilTwas never provided an opportunity to be heard onlhl: hearing;
b, I'lainti fI's due process rights were not provided:
e, I'laintilTnever pleaded guilty to lhe violation:
d. I'lainlilThas been wrongfully convicted oflhe Section without the proper due
process hearing.
c. There is no evidence that the PlaintifThad notice of the suspension of driving
privileges.
f. The suspension is based on two (2) failure to appear which are erroneous,
incorrect and should not appear on the Plaintiffs driving record.
g. The two (2) failure to appears were resolved months prior to the alleged
violation and are incorrectly noted, with one case having been dismissed on
October 23, 1997 and the other resolved on July 10, 1997.
h. The Magisterial Districts provided DOT with lhe appropriate notice which
DOT failed to correctly note on the Plaintiffs record.
1. The imposition of this matter effectuates an injustice, and is a violation of the
Plaintiffs rights.
9, The citations which are the basis of this matter have been improperly entered against
the Plaintiff and based on such it would be against the interests of justice to suspend the Plaintiffs
operating privileges.
