COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW COMES the Plaintiff, PNC Bank, National Association, by and through its
counsel, Tucker Arensberg, P.C., and files the within Complaint in Mortgage Foreclosure, in support of
which it avers the following:
Plaintiff, PNC Bank, National Association ('Bank"), is a national banking association
organized under the laws of the United States of America with a principal place of business at One PNC
Plaza, 249 Fifth Avenue, Pittsburgh, Pennsylvania 15222-2707.
2. Defendant, Patricia R. Shelley, is an adult individual with a last known address of 35
Highland Drive, Camp Hill, Pennsylvania 17011-7514.
3. Terre Tenants, Lee Saurman and Patrice Saurman are adult individuals with a last known
address of 35 Camp Hill Drive, Camp Hill, Pennsylvania 17011-7514.
4. On or about December 11, 2000, Patricia R. Shelley ('Borrower") executed a Home
Equity Line of Credit ("Note"), whereby Borrower promised to pay Bank the principal amount of
$45,000.00 plus interest and other amounts as more particularly set forth in the Note, is attached hereto
and incorporated as Exhibit "A".

5. The obligations evidenced by the Note are secured by a Mortgage dated December 11,
2000 ("Mortgage") given by Patricia R. Shelley ("Mortgagor") to Bank, granting the Bank a lien on
certain real property located in the Township of Lower Allen, County of Cumberland, Pennsylvania, as
more particularly described therein ("Premises"). The Mortgage was recorded in the Office of the
Cumberland County Recorder of Deeds on January 2, 2001 in Mortgage Book Volume 1661, Page 229.
A true and correct copy of the Mortgage is attached hereto and incorporated herein as Exhibit "B".
6. The Borrower is in default of the provisions of the Note and Mortgage for failure to
make payment when due. The Note is due for October 10, 2006, and was past due in the amount of
$1,602.04.
7. The Terre Tenants are the record and real owners of the Premises.
8. There has been no assignment, release or transfer of the Note or Mortgage.
9. On or about October 23, 2006 and February 2, 2007, Notices were sent to the Defendant
and Terre Tenants in accordance with 35 P. S. §1680.403C (Homeowner's Emergency Mortgage
Assistance act of 1983-Act 91 of 1983) and 41 P.S. §403 (Act 6 of 1974 with Act 91, the "Acts") that an
action on said Mortgage may be commenced after 30 days from the date of Notices. Said Notices further
advised Defendant and Terre Tenants of Defendant's and Terre Tenants' rights and obligations in
accordance with the Acts. Copies of the Notices sent to the Defendant and Terre Tenants are attached
here to and incorporated herein as Exhibit "C".
10. The amount due to Bank under the Note and Mortgage as of January 26, 2007 is as
follows:
Principal $41,331.28
Interest through 1/26/07 (continuing thereafter at 473.19
7.6321 per diem)
Late Charge 115.32
Costs To Be Added
Attorneys' Fees 1,015.00
TOTAL $42,934.79

11. The total amount due to Bank under the Note and Mortgage as of January 26, 2007 was
Forty-Two Thousand Nine Hundred Thirty-Four and 79/100 Dollars ($42,934.79) plus interest accruing
from August 25, 2006, costs and reasonable attorneys' fees.
WHEREFORE, Plaintiff demands an in rem judgment in mortgage foreclosure for the amount
due of Forty-Two Thousand Nine Hundred Thirty-Four and 79/100 Dollars ($42,934.79), plus continuing
interest at the contract rate, late charges, reasonable attorneys' fees as authorized by the Note and costs of
foreclosure and sale of the Premises.
