specifically, they had no water, and the water that came in
with the property was brown and muddy and the water was not
potable for drinking.
7. Although the Defendants signed a Seller Disclosure
form as an addendum to the real estate agreement of sale for
the purchase and sale of the above-named property, disclosing
that there were no plumbing problems, the plaintiffs found out
from speaking with neighbors and a prior well driller that
there had been numerous problems before. The Seller Disclosure
form is attached hereto as Exhibit "B".
8. Despite repeated demands to have the Defendants come
out to remedy the problem, the Defendants refused to do so.
9. Because of the problems with the well and the water,
the Plaintiffs were without drinking water for eleven (11) days
had to purchase drinking water, had to get water from a
neighbor to bath, and had to take all of their clothes to a
laundromat.
10. The Defendants did have the problem remedy by
contacting Negley's, who came in and completed the work at a
cost of $3,137.79; a copy of said repair order is attached
hereto and made a part hereof marked as Exhibit "CU.
11. In addition, the plaintiffs suffered a loss of $25.00
for purchasing bottled water, $30.00 in going to the
laundromat, and lost wages in the amount of $217.60.
12. Because the Defendants individually and acting under
the authority of Nye Construction company, Inc. fraudulently
misrepresented the fact that there were no prior problems with

Specifically, they had no water, and the water that came in
with the property was brown and muddy and the water was not
potable for drinking.
7. Although the Defendants signed a Seller Disclosure
form as an addendum to the real estate agreement of sale for
the purchase and sale of the above-named property, disclosing
that there were no plumbing problems, the Plaintiffs found out

from speaking with neighbors and a prior well driller that
there had been numerous problems before. The Seller Disclosure
form is attached hereto as Exhibit "B".
8. Despite repeated demands to have the Defendants come
out to remedy the problem, the Defendants refused to do so,
9. Because of the problems with the well and the water,
the Plaintiffs were without drinking water for eleven (11) days
had to purchase drinking water, had to get water from a
neighbor to bath, and had to take all of their clothes to a
laundromat,
10. The Defendants did have the problem remedy by
contacting Negley's, who came in and completed the work at a
cost of $3,137.79; a copy of said repair order is attached
hereto and made a part hereof marked as Exhibit "CU.
11, In addition, the Plaintiffs suffered a loss of $25.00
for purchasing bottled water, $30.00 in going to the
laundromat, and lost wages in the amount of $217.60.

6. On or about February 10, 1998, the Plaintiffs began
experiencing problems with the well on their property.

7. Although the Defendants signed a Seller Disclosure
form as an addendum to the real estate agreement of sale for
the purchase and sale of the above-named property, disclosing
that there were no plumbing problems, the Plaintiffs found out
from speaking with neighbors and a prior well driller that
there had been numerous problems before. The Seller Disclosure
form is attached hereto as Exhibit "B".
8. Despite repeated demands to have the Defendants come
out to remedy the problem, the Defe~dants refused to do so.

cost of $3,137.79; a copy of said repair order is attached
hereto and made a part hereof marked as Exhibit "C".
11. In addition, the Plaintiffs suffered a loss of $25.00
for purchasing bottled water, $30.00 in going to the
laundromat, and lost wages in the amount of $217,60.
12. Because the Defendants individually and acting under
the authority of Nye Construction Company, Inc. fraudulently
misrepresented the fact that there were no prior problems with

with the property was brown and muddy and the water was not
potable for drinking.
7. Although the Defendants signed a Seller Disclosure
form as an addendum to the real estate agreement of sale for

the purchase and sale of the above-named property, disclosing
that there were no plumbing problems, the Plaintiffs found out
from speaking with neighbors and a prior well driller that
there had been numerous problems before. The Seller Disclosure
form is attached hereto as Exhibit "3".
8. Despite repeated demands to have the Defendants come
out to remedy the problem, the Defendants refused to do so.
9. Because of the problems with the well and the water,
the Plaintiffs were without drinking water for eleven (11) days
had to purchase drinking water, had to get water from a
neighbor to bath, and had to take all of their clothes to a
laundromat.
10, The Defendants did have the problem remedy by
contacting Negley's, who came in and completed the work at a
cost of $3,137.79; a copy of said repair order is attached
hereto and made a part hereof marked as Exhibit "Cu.
11. In addition, the Plaintiffs suffered a loss of $25.00
for purchasing bottled water, $30.00 in going to the
laundromat, and lost wages in the amount of $217.60.
12, Because the Defendants individually and acting under
the authority of Nye Construction Company, Inc, fraudulently
misrepresented the fact that there were no prior problems with

AND NOW, come Defendants, by and through their attorneys, O'BRIEN, BARIC AND
SCHERER, and file this Answer and New Matter and in support thereof set forth the following:

Company, Inc, is a Pennsylvania corporation. It is denied that Nye Construction Company, Inc. is
doing business at 49 West Orange Street, Shippensburg, Pennsylvania.

purchased a property known as 9 Roger Avenue, Shippensburg, Pennsylvania as referenced in the
deed appended as Exhibit "A" from Nye Construction Company, Inc. as set forth in the deed. It
is denied that Ujjal Maker or Benjamin Musser, as individuals, conveyed any property to the
Plaintiffs,
6. After reasonable investigation, Defendants are without knowledge or information
sufficient to form a belief as (0 the truth of these averments and they are, therefore, denied.
7. Admitted in part and denied in part. It is admitted that the "Seller", Nye
Construction Company, Inc., provided a Real Estate Disclosure to the Plaintiffs. That document
is a writing which speaks for itself. It is denied that the Real Estate Disclosure was inaccurate or
that the Defendants had any knowledge of any prior "problems" with the well at the property,
8. Admitted that the Defendants have not remedied any "problem", if one existed,
with the well or water system at the property, By way of further answer, Defendants have no
obligation to do so,
9, After reasonable investigation, Defendants are without knowledge or information
sufficient to form a belief as to the truth of these allegations and they are, therefore, denied,

Jones by and through their attorneys, Saidis, Shuff & Masland,
respectfully avers as follows:
1. On or about July 16, 1998, Plaintiffs in the above
captioned matter filed a Complaint in the Court of Common
Pleas, CUmberland County, Pennsylvania alleging in earlier that
Defendants had fraUdulently misrepreSented the fact there were
no prior water problems with a well on property purchased by
Plaintiff's from Defendants.
2. Paragraph 10 of that Complaint is a mistake in
inaccurate representation and should read as follows; "The

Plaintiff's did have the problem remedied by contacting Funk's

$3,137.79." A copy of said repair order is attached hereto and
make part hereof marked as Ex"e".
3. The amendment to correct Plaintiff's Complaint in
paragraph 10 is not prejudicial to Defendant's in any way and
therefo~e shOuld be changed to represent the actual facts and
circumstances.
WHEREFORE, Defendant respectfully requests this Court to
issue an order amending Plaintiff's original complaint,
paragraph 10 to read specifically as stated in paragraph 2
above.
