12. Plaintiff incorporates by rcference Paragraphs 1 - 11 as though fully set forth.
13. On or about March 2S, 1997 Defendant executed a Promissory Note and
Disclosure Statement as "borrower" in favor of the Plaintiff in the amount of Three Thousand
Three Hundred and 00/100 Dollars ($3,300.00) at 12.15% interest. A true and correct copy of
the foregoing document is attached hereto as Exhibit "B".
14. Defendant has failed to make timely payments under the Promissory Note.
15 Defendant's monthly payment under the Promissory Note was$SI.60.
16. As of June 5,1998 the principal balance remaining unpaid was $2,S64.20.
17. As of June 5, 1995 the past due interest was $64.53 accruing at $0.95 per day.
IS. Under the terms of the Promissory Note Defendants must repay the Plaintiff its
reasonable attorneys fees and all costs of collection.
19. Defendant has failed to curc the default despite repeated requests by Plaintiff.
WHEREFORE, Plaintiffrcspcctfully rcqucsts this court to cntcr judgmcnt in its favor

Count III: Brcach of Contract on VISA Account
20. Plaintiff incorporates Paragraphs J through 19 as though fully set forth.
21. Defendant applied for a VISA card from the Plaintiff on January I, 1997.
22. Defendant was granted a VISA card with a credit limit of$400.00 on January S,
1997.
23. Defendant requested a credit line increase to $1,000.00 for the VISA card which
was granted on February 28, 1997.
24. As of June 2, 1998 the present outstanding balance owed the Plaintiff is Nine
Hundred Thirty Six and 66/100 Dollars ($936.66).
25. Defcndant has failed to make any payments on his VISA account since March 30,
1995 despite repeated requests by Plaintiff.
WHEREFORE, Plaintiffrespcctfully requests this court to enter judgment in its favor
and against Defendant Arquelio Martinez in the amount $936.66 plus all costs of collection,
court costs, and reasonable attorneys' fees.
