PLAINTIFF'S PETITION FOR SPECIAL RELIEF
PURSUANT TO Pa.R.C.P. 1915.13
AND NOW comes Plaintiff Duane J. Bowers, by and through his counsel, Howctt,
Kissinger & Miles, P.c., and files this Plaintiffs Petition for Special Relief Pursuant to
Pa.R.C.P. 1915.13, and in support thereof states as follows:
I. Plaintiff is Duane J. Bowers (hereinafter referred to as "Fathcr"), an adult
individual who currently resides at 922 Thomton Drive, Mechanicsburg, Cumberland County,
Pennsylvania, 17055.
2. Defendant is Tina M. Bowers (hereinafter referred to as "Mother"), an
adult individual who currently resides at 922 Thornton Drive, Mechanicsburg, Cumberland
County, Pennsylvania, 17055.
3. The parties were married on June 25,1988 and are the parents of four
children namely:

4. Mother has announced hcr intent to tem1inate the marriagc, although the
parties continue to reside in the same residcnce,
5. Simultaneously with the filing of this Petition for Spccial RelicfPursuant
to Pa.R.C.P. 1915.13, Father has also filed a Complaint for Custody.
6. For approximately four months, Father has been the primary caretaker of
the parties' four children as Mother is often absent from the marital residence while spending
time with her paramour.
7. Mother has kept one or more of the children away from the marital
residence on weeknights until well after midnight, retuming the children to their home in the
middle of the night and disrupting their sleep pattems, During such times, Mother refuses to tell
Father the whereabouts of the children.
8, Mother has on several occasions indicated to Father her surreptitiously
intent to vacate the marital residence and to take the parties' four children with her over Father's
objection.
9. Father believes it is in the children's best interests that they continue to
reside at the marital residence until the court has an opportunity to address Father's Complaint
for Custody.
