WAIVER OF LIENS

WHEREAS, George B. Thomas, Jr. and Lynn L. Thomas, husband and wife, of
cunwerland County, Pennsylvania, (hereinafter referred to as Owner) entered into
a contract with Home Designe, of Pennsylvania, (hereinafter referred to as
Contractor), to provide materials and perform labor necessary for completion of a
reeidential dwelling situate upon lot of ground located:
Lot 43, Carlisle, PA 17013, South Middleton Township, cumberland County,
Pennsylvania, as more particularly set forth in Exhibit "A" attached hereto.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said
parties, as part of the said contract and for the consideration therein set
forth, that neither the undersigned contractor, any sub-contractor or material
man, nor any other person furnishing labor or materials to the said contractor
under this contract shall file a lien, commonly called a mechanic's lien, for
work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the county prothonotary
within ten (10) days after date, in accordance with the requirements of the Act
of Assembly of Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto have hereunto set their hands and
seals this 24th day of June, 1998.

ALL THAT CERTAIN traot of land situate in south Middleton Township, cunilierland
County, pennsylvania, mora particularly bounded and described pursuant to subdivision
Plan for cobblestone Estates, Shoet No.2, recorded in cumberland county plan Book
70, Page 130A, as follows:
BEGINNING at a point on the northern right-of-way line of Cobblestone Drive fifty
(SO) (feet wide right-of-way) at the southeastern corner of Lot No. 44 as shown on
the above described subdivision plan; thence by said Lot No. 44, North one (01)
degree forty-seven (47) minutes twenty-eight (28) seconds East, one hundred
ninety-five and seven one-hundredths (195.07) feet to a point in line of Lot No. 47
as shown on the above described subdivision plan; thence by said Lot No. 47 and Lot
No. 40 as shown on said Plan, South eighty-four (84) degrees eleven (11) minutes one
(01) eeconds East, eighty-three and sixty-one one-hundredths (83.61) feet to a point
in line of Lot No. 40 at the northwestern corner of Lot No. 42 as shown on said plan;
thence by said Lot No. 42, south one (01) degree forty-six (46) minutes three (03)
seconds East, one hundred eighty-four and ninety-four one-hundredths (184.94) feet to
a point on the northern right-of-way line of cobblestone Drive; thence by the
northern right of way line of Cobblestone Drive, South eighty-nine (89) degrees zero
tOO) minutes twelve (12) seconds west, ninety-five and zero one-hundredths (95.00)
feet to a point on said right-of-way line, the point and place of BEGINNING.
CONTAINING 0.3884 acres or 16,918.92 square feet and being designated Lot No. 43 as
shown on the above described subidivision Plan.
BEING PART OF THE SAME PREMISES WHICH Rockwell Farms, a Pennsylvania General
Partnership by Deed bearing date the 17th day of November, 1994, and recorded in the
,office of the Recorder of Deeds for cumberland County, Pennsylvania, on the 17th of
November, 1994, in Deed Book 114, page 1112, granted and conveyed unto petersburg
Road Associates, a Pennsylvania General Partnership.
UNDER AND SUBJECT TO restrictions and conditions as now appear of record.
