Additionally, Rule 10 I 9(d) provides: In pleading an oflieial document or oftieial act, it is sufficient to identily it by reference or aver that tbe doeument was issued or the aet done in compliance with law. Paragraph 3 ofPlaintifJ's Complaint avers that the mortgage that is the subject of the instant action was recorded in the Ofliee of the Recorder of Cumber/and County in Mortgage Book /324 page 16G. As such, this averment falls squarely within the provisions ofRulc 1019(g) and/or Rule /0/9(d). The writing need not be attached under these circumstanccs beeause it is properly incorporated by reference. See generally 2 Goodrich-Amram 2d Section 10 19(9):2. See London v. Kinl!slev (No.3), 51 Lack. JUl'. 59 (1950) (rcfcrencc to the deed book incorporated the entire deed into the pleading). Moreover, even if the Defendant is correct in their assertion that the mortgage document should have been attached to the Complaint pursuant to Rule 10 19(h), Plaintiff has attached a true and correct copy of the document to thc instant pleading as Exhibit "A". It has long been recognized that if a copy of the document sought by Defendant is furnished by Plaintiff, the Preliminary Objection becomes moot. Dell!ross v. Gruerio, 389 A.2d 1/9 (Pa. Super. 1978). IV. CONCLUSION For the reasons set forth herein, the Preliminary Objections are meritless and have been interposed for the purpose of delay only. Plaintiff respectfully requests that this Honorable Court enter an Order overruling Defendants' Preliminary Objections and directing Defendants to file an Answer to Plaintifrs Complaint within twenty (20) days of the Court's Order.
