Companies, D/B/A MNC Mortgage, filed the Complaint in
this matter.
2. The Complaint alleges that Plaintiffs cause of action
is based on a Mortgage.
3. Paragraph 3 of the Complaint further alleges that
Defendants executed and delivered the Mortgage.
4. The Mortgage is not attached to either of the Complaints
that were served on Defendants.

Paragraph 3 ofPlaintifJ's Complaint avers that the mortgage that is the subject of the instant
action was recorded in the Ofliee of the Recorder of Cumber/and County in Mortgage Book /324 page
16G. As such, this averment falls squarely within the provisions ofRulc 1019(g) and/or Rule /0/9(d).
The writing need not be attached under these circumstanccs beeause it is properly incorporated by
reference. See generally 2 Goodrich-Amram 2d Section 10 19(9):2. See London v. Kinl!slev (No.3), 51
Lack. JUl'. 59 (1950) (rcfcrencc to the deed book incorporated the entire deed into the pleading).
Moreover, even if the Defendant is correct in their assertion that the mortgage document should
have been attached to the Complaint pursuant to Rule 10 19(h), Plaintiff has attached a true and correct
copy of the document to thc instant pleading as Exhibit "A". It has long been recognized that if a copy of
the document sought by Defendant is furnished by Plaintiff, the Preliminary Objection becomes moot.
Dell!ross v. Gruerio, 389 A.2d 1/9 (Pa. Super. 1978).
IV. CONCLUSION
For the reasons set forth herein, the Preliminary Objections are meritless and have been
interposed for the purpose of delay only. Plaintiff respectfully requests that this Honorable Court enter
an Order overruling Defendants' Preliminary Objections and directing Defendants to file an Answer to
Plaintifrs Complaint within twenty (20) days of the Court's Order.
WHEREFORE, Plaintiff respectfully requests that the Court overrule Defendants' Preliminary
Objections and direct the Delendants to file an Answer to Plaintiff's Complaint.

(A) Cbaoge Date
The interest rate may cbange on the first day of OCTOBER . IUg7 I and on that day of
each succeeding year. "Change Date" means each date OD which the interest rate could change.

Beginning wilh lhe first Change Date, the interest rate will be based on an Index. "Index" means the
weekly average yield on United States Treasury Securities adjusted to a constant maturity of one year, a.s
made available by the Federal Reserve Board. "Current Index" means the most rec:ent Indcl figure
a't.il.i1able 30 days before the Changc Date. If the Index (as defined above) is no longer available, Lender
will use as a new Index any index prescribed by the Secretary of Housing and Urban Development or his
or her designee. Lender wiIJ give Borrower notice of the new Jndex.
(0 Caleulallon of Ioterest Rate Changes
Before each Change Date, Lender will calculate a new interest rate by adding a margin of
TWO AND 3/4THS percentage points (2.750,%) to thc Current Jndex and
rounding the sum to the nearest one-eighth of one percentage point (0.125%). Subject to the limits stated
in Paragraph (D) below. this rounded amount will be the new interest rate until the next Chan!c Date.
(0) Limits on interest Rate Changes
The existing interest rate will nevcr increase or decrease by more than one pcrcenlage point (1.0%) on'
any single Change Date. The interest rate will never be mon'; than five percentage points (5.0%) higher or
lower than the initial interest rate stated in Paraa:raph 2 of the Note.
(E) Calculation of Payment Change
If the interest rate changes on a Change Date. Lender will c:dculate the o.mount of monthly payment
of prinCipal and interest which would be necessary to repay the unpaid principal balance in full at the
maturity date at the new interest rate through SUbstantially equal payments. In making such calculation,
under will use the unpaid principal balance which would be owed on the Change Date if there had been
nodefaull in payment on the Note, reduced by the amount of any prepayments to prinCipal. The result of
this calculation will be the amount of the new monthly payment of principal and interest

Lender will give notice to Borrower of any change in the interest rate and monthly payment amount
