Defendant's Post-Trial Motion.
DEFENDANT'S MOTION FOR LIQUIDATED DAMAGES PURSUANT
TO 42 Pa.C.S.A. S8104(b) FOR PLAINTIFFS' FAILURE
TO TIMELY MARK THE JUDGMENT AS SATISFIED
AND NOW COMES, Defendant Country Side Village Homes, Inc.
("Country Side"), by and through its attorneys, McNees Wallace &
Nurick LLC, and moves the Court for an award of liquidated
damages in the amount of two thousand five hundred ($2,500)
Dollars as a result of Plaintiffs' failure to mark the judgment
as satisfied in a timely manner.
Country Side avers as follows:
1. This matter was tried before a jury on January 31,
In support of this motion,
2000 through February 2, 2000. On February 2, 2000, the jury
rendered a verdict in favor of Plaintiffs and against Country
Side in the amount of $15,900.
The jury also rendered a verdict
in favor of Country Side and against Plaintiffs on Country
Side's counterclaim In the amount of $784. A copy of the docket
entries reflecting the procedural history of this case is
attached as Exhibit A.
2. On April 11, 2000, judgment was entered in favor of
Plainti,ffs and against Country Side in the amount of $15,116,
which was the net amount of the verdict in favor of Plaintiffs
and against Country Side.

3. On May 16, 2000, Country Side satisfied the judgment by
paying Plaintiffs and their mortgagee $16,174.85.
(Exhibit B) .
At this same time, Country Side's attorney requested Plaintiffs'
attorney to "file a praecipe with the Prothonotary indicating
that the judgment has now been satisfied."
(Exhibi t C) .
4. On June 27, 2000, Plaintiffs' attorney sent Country
Side's attorney a check in the amount of $803.40, which was to
pay the verdict in favor of Country Side and against Plaintiffs.

(Exhibit D). Although the letter and check reference that
Plaintiffs were paying a "judgement", there was never a judgment
entered in favor of Country Side and against Plaintiffs.
(Exhibit D). Rather, the Prothonotary essentially molded the
verdict in favor of Plaintiffs to deduct the verdict in favor of
Country Side before entering judgment in favor of Plaintiffs and
against Country side.
(Exhibit A). However, since Plaintiffs'
counsel was holding certain money In its escrow account to pay
for the verdict in favor of Country Side, the parties simply
paid each other the amount of the verdicts, together with
interest.
5. On July 6, 2000, Country Side's counsel sent a letter
to Plaintiffs' counsel with an enclosed Praecipe for
Satisfaction of Judgment and Verdict, and requested that he sign
and file the document.
(Exhibit E) .
6. In October, 2004, Country Side was notified by a title
examiner that there was an outstanding judgment in favor of
Plaintiffs and against Country Side that had never been
satisfied.
Country Side then checked the docket entries, and
discovered that the Plaintiffs had never filed the Praecipe for
Satisfaction of Judgment and Verdicts which was sent to
Plaintiffs' counsel for filing on July 6, 2004.

7. On November 9, 2004, Country Side's counsel sent
Plaintiffs' counsel another signed Praecipe for Satisfaction of
Judgment and Verdict.
(Exhibit F).
Plaintiffs' counsel
eventually filed this Praecipe on November 29, 2004, and the
docket now reflects that the judgment has been satisfied.
(See
Exhibi t A) .
8. Country Side's request for liquidated damages is
governed by 42 Pa.C.S.A ~8104, which provides that:
(a) General r~le.--A judgment creditor who has
received satisfaction of any judgment in any tribunal of
this Commonwealth shall, at the written request of the
judgment debtor, or of anyone interested therein, and tender
of the fee for entry of satisfaction, enter satisfaction at
the office of the clerk of the court where such judgment is
outstanding, which satisfaction shall forever discharge the
judgment.
(b) Liquidated damages--A judgment creditor who shall
willfully or unreasonably fail without good cause or refuse
for more than 90 days after written notice in the manner
prescribed by general rules to comply with a request
pursuant to subsection (a) shall pay to the judgment debtor
as liquidated damages 1% of the original amount of the
judgment for each month of delinquency beyond such 90 days,
but not less than $250, nor more than $2,500. Such
liquidated damages shall be recoverable pursuant to general
rules, by supplementary proceeding in the matter in which
the judgment was entered.
9. Country Side made a written request on both May 16,
2000, and July 6, 2000 that Plaintiffs file a praecipe to have
the judgment marked as satisfied.
(Exhibits C and E) .

10. Country Side was not required to tender Plaintiffs a
fee to file the praecipe for satisfaction of judgment since this
Court does not require a separate fee to file a praecipe for
satisfaction of judgment.
11. Plaintiffs unreasonably failed without good cause to
file the praecipe for satisfaction of judgment for more than 90
days after Country Side requested in writing that the praecipe
be filed on May 16, 2000, and July 6, 2000.

12. There were over 52 months between when Country Side
requested in writing that the praecipe be filed, and the actual
filing of the praecipe.
13. Pursuant to 42 Pa.C.S.A. S8104(b), Country Side is
entitled to liquidated damages in the amount of $2,500.
Although the statute provides for liquidated damages of 1% of
the judgment amount for every month beyond 90 days that the
judgment is not marked as satisfied, this would amount to over
$7,400 ($15,116 x .01 at 49 = $7,406). Accordingly, Country
Side is limited to the statutory cap of $2,500.
14. Country Side has made a good faith attempt to resolve
this issue with Plaintiffs' counsel, but Plaintiffs' counsel has
refused to pay any amount as either compensatory or liquidated
damages. As such, Country Side has no choice but to request

that this Court intervene and award liquidated damages pursuant
to the statute.
WHEREFORE, Defendant Country Side village Homes, Inc.
respectfully requests that the Court award it liquidated damages
in the amount of two thousand five hundred ($2,500) Dollars as a
result of Plaintiffs' failure to mark the judgment as satisfied
in a timely manner.

We are enclosing a letter we sent to Chase Manhattan
Mortgage Corporation with the checks in payment of the judgment
and interest. We were instructed by Chase Manhattan Mortgage
Corporation by letter dated May 3, 2000 to make the checks
payable to the McKees and Chase Manhattan Mortgage Corporation,
but to send the checks to Chase Manhattan Mortgage Corporation.
Presumably, Chase Manhattan will work with the McKees to disperse
the funds upon performance of the repairs to the house as set
forth in the proposal submitted by the McKees at the trial of
this matter.
Please file a praecipe with the Prothonotary indicating that
the judgment has now been satisfied. It was a pleasure working
with you on this matter, and I wish you and your clients the best
in their future endeavors.

Dear Ms. McClinton:
In accordance with the instructions of Cheryl Gray, in her
letter to me of May 3, 2000, I am sending to you two checks made
payable to Gary and Roxann McKee and Chase Manhattan Mortgage
Corporation. The one check is for the amount of the judgment and
interest through May 10, 2000. It took Countryside longer to get
me the checks than I expected, so I asked them to send me an
additional check for $18, which is the amount of interest on the
judgment for one week.
We are sending the McKees' counsel a copy of this letter and
the checks and would request that you deal directly with the
McKees' counsel with respect to releasing the money from escrow
once the repairs have been done in accordance with the repair
proposal which was submitted by the McKees at the trial of this

ANSWER TO DEFENDANT'S MOTION FOR LIQUIDATED
DAMAGES PURSUANT TO 42 Pa.C.S.A. &8104(b)
FOR FAILURE TO TIMELY MARK THE JUDGMENT AS SATISFIED
AND NOW come the Plaintiffs, Gary and Roxann McKee and files the following Answer
to the Defendant's Motion for liquidated damages pursuant to 42 Pa.C.S.A 98104(b) for
plaintifTs failure to timely mark the judgment as satisfied, averring as follows:

6. Denied. Plaintiffs deny that they never filed the Praecipe for Satisfaction of
Judgment and Verdicts. Plaintitfs respectfully submit that such documents were filed but were
not entered by the court prothonotary's office. Such error did not come to the Plaintiffs
attention until five (5) years later because opposing counsel failed to notifY the plaintiff during
that time period.
7. Denied. Approximately five (5) years ago, a praecipe to satisfY the judgment was
signed and sent to the prothonotary's office at the courthouse. At that time, there was no reason
to believe that that praecipe was not filed and entered properly. During November 2004,
Plaintiffs were notified that the praecipe did not in fact go through and as soon as Plaintiffs
became aware ofthis, Plaintiffs' counsel prepared a second praecipe and sent the subsequent
document to the prothonotary to be filed and entered. One month later in December 2004,
Plaintiff received notice that the judgment still had not been satisfied and a letter of inquiry was
sent by the Plaintiffs counsel to the court administrator as to when a time-stamped praecipe will
be entered in order to satisfY the judgment. Plaintiffs' counsel finally received a dated praecipe;
however said praecipe was dated December 2004. The date of December 2004 reflects the
second time the prothonotary had to be contact and not the November 2004 date of when notice
was received that the original praecipe was never satisfied. It is the Plaintiffs' position that the
reason the judgment was not satisfied five (5) years prior is due to the acts of the prothonotary
and not any willful acts on the part of Plaintiff. This is apparent through the continued actions of
the Plaintiffs and Plaintiffs' counsel that upon notice the prothonotary's failure to enter the
praecipe, Plaintiffs made every effort to rectify this error.

II. Denied. Plaintiffs deny there was any willful failure on their part to secure a timely
satisfaction of the judgment. Every reasonable effort was made to file the praecipe for
satisfaction of judgment and such resulting error to satisfy such judgment was the failure of the
Cumberland county prothonotary's otlice to enter such praecipe.
12. Admit.
13. Denied. Plaintiffs do not agree that Country Side is entitled to such damages.
14. Denied. Plaintiffs' counsel does not agree that a good faith effort has been made to
resolve such issue and asks the court to dismiss Country Side's request to award liquidated
damages in this matter.
WHEREFORE, Plaintiffs Gary and Roxann McKee respectfully request that the Court
deny Defendant Country Side Village Homes, Inc.'s request for an award ofliquidated damages
in the amount of two thousand five hundred ($2,500) Dollars because it was not the PlaintiFFs'
failure to mark the judgment as satisfied and upon notification that such error existed, a good
faith elfort was made on the part of the Plaintiffs to rectify such error.
