BE IT REMEMBERED THAT
I, ST~LEY BAUBLITZ, a resident of Cumberland County,
Pennsylvaniar being of sound and disposing mind, memory and
understanding, do make, publish and declare this to be my LAST WILL
and TESTAMENT, hereby revoking any and all wills and Codicils
previously made by me.
I
I declare that I am not married, and that I have three (3)
children, LESLIE RAVER, RICHARD BAUBLITZ, and KIRK BAUBLITZ.
II
I direct that all my just debts and funeral expenses shall be
paid from my residuary estate as soon as practicable after my
decease.
III
I direct that all taxes that may be assessed in consequence of
my death, of whatever nature and by whatever jurisdiction imposed,
shall be paid from my residuary estate as a part of the expense of
the administration of my estate.
IV
I hereby make the following specific bequests:
A. To my daughter, LESLIE RAVER, I hereby bequeath my
coin collection and my York safe1
B. To my son, RICHARD BAUBLITZ, I hereby bequeath my
1950 McCormick Deering Tractor1 and
C. To my son, KIRK BAUBLITZ, I hereby bequeath my gun
cabinet and all my guns.
V
I give, devise and bequeath all my residuary property, whether
real or personal, wherever situate, including any property over
which I may have a power of appointment to my children, LESLIE,
RICHARD and KIRK, in equal shares, per capita.

paid from my residuary estate as soon as practicable after my

I direct that all taxes that may be assessed in consequence of

That any unusual questions requiring adjudication which counsel may deeM
helpful to the Court ara as follows:
On or about August 21, 1995, the Estate received a letter froM Robert J. Wire,
Jr., Esquire, on behalf of Robert S. Knaub, a ~ephew of the decedent wherain a claim
was asserted by ~r. Knaub in the amount of $12,480.00 for care and services he allegedly
supplied to the decedent approximately one and one-half years prior to her death. On
or about September 14, 1995, the Estate responded with a letter to Robert J. Wire, Jr.,
Esquire, denying any responsibility or obligation for payment of any monies to ~r. Knaub
on the grounds that there was no express contract between the decedent and ~t. Knaub
suggesting that he be compensated for the care and services he allegedly provided to
the decedent, that there was no demand for payment by Mr. Knaub to the decedent during
her lifetime and that there was a presumption of either payment in full satisfaction of
the claim or that the services and care were gratuitous. Further, the Estate has
evidence to support thac the decedent always paid Mr. Knaub for work he did at the time
the work or services were performed. Mr. Knaub did receive the proceeds of two (2)
Certificates of Deposit which were jointly held with the decedent and ~r. Knaub, namely,
a Certificate of Deposit with PNC Bank in the face amount of $1,000.00 and a Certificate
of Deposit with Drovers & ~echanics Bank in the amount of $1,500.00. Further, ~r. Knaub
was also the beneficiary under a life insurance policy on the decedent's life through
Providian Insurance Company in the face amount of $1,500.00. Further correspondence
was exchanged between counsel in September and October of 1995. On October 6, 1995,
the Estate clearly communicated to ~r. Knaub's counsel that with the exception of the
life insurance policy and :he Certificates of Deposit proceeds, there would be no ocher
distribution or payment from the Estace to ~r. Knaub and that he should accepc those sum.
in full sacisfaction of any claim he may have. The Estate requested formal conformation
from Mr. Knaub that he would release any claim he may have had against the Estate in
exchange for the items previously distributed to him. No response was received either
from ~r. Knaub directly or through counsel despite further correspondence being senc
on November 29, 1995, January 11 and ~arch II, 1996. The Estate, however, has recaived
word from Robert J. Wire, Jr., Esquire, that he would not file a formal claim with the
Court and suggested to ~r. Knaub thac he seek other counsel. To date, no filings
have been made and the Estate would therefore request that ~r. Knaub's claim for alleged
care and services provided to the decedent in the amount of $12,489.00 be dismissed as
part of the final Audit and Adjudication.

Stanley E. Baublitz: my father's 1950 McCormick Deering Tractor;
and, $25,572.36, in full satisfaction and payment of all such
sum, or sums of money, and share, or shares, of said Estate due,
owing, payable and belonging to me, by any means whatsoever, for
or on account of my status as a beneficiary to the Estate of
Stanley E. Baublitz, with the exception of my entitlement to a
one-third (1/3) share of any balance remaining from a reserve of
Four Hundred Eighty ($480.00) Dollars retained by the Executor
for the preparation of federal and state Fiduciary Income Tax
Returns, and payment of any tax which may be due.
AHD, THEREFORE, I do by these presents, remise, release and
forever discharge the Estate of Stanley E. Baublitz, its
executor, Richard S. Baublitz, and its attorney, Richard F.
Maffett, Jr., Esquire, of and from any liability beyond the
receipt of the aforesaid share, and from all actions, suits,

adult individual residing at 1681 Valley Road, Camp Hill,
Pennsylvania, 17011, hereby aver the following:
KHBREAS, Stanley E. Baublitz, who resided in Mechanicsburg,
Cumberland County, Pennsylvania, died testate on November 30,
1995~ and
KHBRBAS, on January 4, 1996, Richard S. Baublitz was
appointed as Executor of the Estate of Stanley E. Baublitz,
Deceased~ and
KHERBAS, the heirs of the Estate of Stanley E. Baublitz,
Deceased, are:
(1) Leslie J. Raver, Daughter~
(2) Kirk E. Baublitz, Son~ and

KHBRBAS, having reviewed the Executor's Accounting, Final
