STATEMENT OF PROPOSED FINAL DISTRIBUTION
TO THE HONORABLE JUDGE OF SAID COURT:
The Executors of the Estate of George T. Fahnestock, set forth the following
statement of Proposed Final Distribution in said Estate:
On December 13, 1995 George T. Fahnestock died.
The decedent, a single man, died testate leaving his entire estate less eight silver
dollars to his daughter Dorothy and on January 23, 1996 his will was probated,
On January 23, 1996, testator's daughter, Dorothy V. Fahnestock, after a
renunciation by her brother George T. Fahnestock, Jr" was appointed administratrix of the
estate.
Testator, a single man at the time of his death, directed in his will that his entire
estate was to go to his daughter Dorothy and that eight silver dollars in his safe-box were
to be divided between his son, George, Jr., and his step-daughter, Connie, No safe box
was found in testator's property and no safe-deposit box was discovered in any local bank.
One silver dollar was discovered and delivered to George, Jr. The testator had a small
checking account an IRA account with Mellon Bank. He also owned several motor
vehicles, a boat and a trailer, most of which were junk. The administratrix sold the only
vehicle that had value and turned the title of the others to the junk man. Testator owned a
lot of ground in Mt. Holly Springs on which were two condemned mobile homes and an
out building each of which were filled with trash and debris, The land is on Mountain
Stream in the flood zone and could not be built up in accordance with local ordinances,
The property was deemed valueless and removed from the tax roles, After months of hard
work by the Administratrix, the property was cleared and cleaned and then an offer to
purchase the lot came from the adjoining land owner, It was accepted,

Dear Pauline:
This Is to confirm the telephone conference which we had in January. 1996, regarding
the writing which hed been offered as the Will of the above-named decedent. The writing
wes made across two pages of a smell spiral bound notebook. The writing consisted of the
statement. "If I die before I awake, my estate is to go to my daughter, Dorothy. except 4
silver dollara In sevingl box goes lsic) to my son. George, Jr. and 4 to Connie -", The
statament Is then signed by the decedent. Below the decedent's signature there is a number
which eppears to be a military Identification number. The number 4 following the word
"except" appeara to be a revis/on from what was Initially the number 8. Preceding the word
"Connie" the word "my" has been stricken out.
It Is our opinion that the writing discussed above is e valid Will. The phrase "If I die
before I awake" Is best construed as an explanation for the reason of the decedent's making
of the Will, I.e., he was at that time contemplating hla death, rather than an express condition
that the writing WII to be given effect only If the Testator were to die during the next time
he slept or otherwise IoIt conaclousness. By the spacing of the writing, it appearl thet the
revisions which ware made to the writing were done so as the Testator was actually drafting
the writing, and not at some time subsequent to his signing of the writing. Therefore, as we
advised you by telephone, we are of the opinion thet the above-discussed writing Is a valid
Will and may be admitted to probate.
