heretofore made by me.
ARTICLE SECOND
I direct my Executrix to pay my funeral and
administration expenses, the expenses of my last illness, and all
of my juot debt 0 as soon as may be practical after my death.
ARTICLE THIRD
I direct that all estate, tranofer, inheritance, and
succeosion taxes, including any interest and penalties thereon,
if any, which shall become payable by reason of my death, shall
be paid out of and be charged generally against the principal of
my residuary estate, without reimbursement from any person.
ARTICLE FOURTH
I absolutely give, devise, and bequeath to my beloved
daughter, PARTICIA CORDICK, all the rest, residue, and remainder
of my estate, both real and personal, of every name, nature, and
kind whatsoever and wheresoever the same may be situated.
ARTICLE FIFTH
In the event, however, that my beloved daughter,
PATRICIA CORDICK, shall predecease me, or in the event that our
deaths occur simultaneously, or approximately so, or in the same
common accident or calamity, or under any circumstances causing
doubt as to which one of us survived the other, then I absolutely
give, devise, and bequeath to my beloved grandson, LEON SOBCZAK
III, all the rest, residue, and remainder of my estate, both real
and personal, of every name, nature, and kind whatsoever and
wheresoever the same may be situated.

Court that Leon J. Sobczak, Sr. was served with a Citation and

Notice of his hearing on February B, 1996, and waR pr~R~nl aL chB-
hea,[;"~ {~) the Court finds that the physical or mental condition
of Leon J. Sobczak, Sr. would be harmed by his presence at hearing,
and further finds from the testimony:
1. That Leon J. Sobczak, Sr. suffers from Alzheimer's Disease,
a condition or disability which totally impairs his capacity to
receive and evaluate information effectively and to make and
communicate decisions concerning his management of financial
affairs or to meet essential requirements for his physical health
and safety.
2. That there are insufficient supports available to assist
Leon J. Sobczak, Sr. in such decisions and that there exists no
other less restrictive alternative mechanism for decision making.
3. That based on the total incapacity of Leon J, Sobczak, Sr.
to receive and evaluate information and to make or communicate
decisions, a plenary Guardian of the Person and a plenary Guardian
of the Estate are required on a permanent basis.
NOW, THEREFORE, based on the clear and convincing evidence

supporting the foregoing findings it is ORDBRID, ADJUDCJID and
DBCRBID that Leon J. Sobczak, Sr, be and is hereby adjudged a
totally incapacitated person and patricia M, Cordick is appointed
Plenary Permanent Guardian of the Person and Patricia M. Cordick is
appointed Plenary Permanent Guardian of the Estate,
If there is a safe deposit box in the name of the incapacitated
person alone or in the names of the incapacitated person and
another or others, said safe deposit box shall not be entered by
the guardian except in the presence of a representative of the
financial institution where the box is located or in the presence
of a representative of the Orphans' Court Division. The
representative present at the time of entry shall make or cause to
be made a record of the incapacitated person's property, and said
record shall be filed with the Clerk of the Orphans' Court
Division.
None of the incapacitated person's property may be
removed until after the aforesaid inventory is completed,
A reasonable fee for the services of the representative may be
made and shall be payable from the estate of the incapacitated
person. If the safe deposit box is jointly owned, five (5) days
notice of the proposed entry shall be given to the other owners by
the guardian.

of Leon J. Sobczak, Sr. would be harmed by his presence at hearing,
and further finds from the testimony:
1. That Leon J. Sobczak, Sr. suffers from Alzheimer's Disease,
a condition or disability which totally impairs his capacity to
receive and evaluate information effectively and to make and
communicate decisions concerning his management of financial
affairs or to meet essential requirements for his physical health
and safety.
2. That there are insufficient supports available to assist
Leon J. Sobczak, Sr. in such decisions and that there exists no
other less restrictive alternative mechanism for decision making.
3. That based on the total incapacity of Leon J. Sobczak, Sr.
to receive and evaluate information and to make or communicate
decisions, a plenary Guardian of the Person and a plenary Guardian
of the Estate are required on a permanent basis.
NOW, THEREFORE, based on the clear and convincing evidence
supporting the foregoing findings it is ORDERED, ADJUDGED and
DECREED that Leon J. Sobczak, Sr. be and is hereby adjudged a
totally incapacitated person and Patricia M, Cordick is appointed
Plenary Permanent Guardian of the Person and Patricia M, Cordick is
appointed Plenary Permanent Guardian of the Estate.
If there is a safe deposit box in the name of the incapacitated
person alone or in the names of the incapacitated person and
another or others, said safe deposit box shall not be entered by
the guardian except in the presence of a representative of the
financial institution where the box is located or in the presence
of a representative of the Orphans' Court Division. The
representative present at the time of entry shall make or cause to
be made a record of the incapacitated person's property, and said
record shall be filed with the Clerk of the Orphans' Court
Division.

The attached affidavit was sent to Mary Szarejko on June 7,
1996 by first class mail, Mary Szarejko informed me by phone on
June 18, 1996 that this consent was signed and returned to me some
time during the week of June 10, 1996, I have not yet received the
signed consent, Mary Szarej ko consented to the sale of the
property for $122,000.00. Due to time constraints of the sale, I
am filing this affidavit on her behalf.

of Leon J. Sobczak, Sr. would be harmed by his presence at hearing,
and further finds from the testimony:
1, That Leon J. Sobczak, Sr. suffers from Alzheimer's Disease,
a condition or disability which totally impairs his capacity to
receive and evaluate information effectively and to make and
communicate decisions concerning his management of financial
affairs or to meet essential requirements for his physical health
and safety.
2. That there are insufficient supports available to assist
Leon J. Sobczak, Sr. in such decisions and that there exists no
other less restrictive alternative mechanism for decision making.
3. That based on the total incapacity of Leon J. Sobczak, Sr.
to receive and evaluate information and to make or communicate
decisions, a plenary Guardian of the Person and a plenary Guardian
of the Estate are required on a permanent basis.

If there is a safe deposit box in the name of the incapacitated
person alone or in the names of the incapacitated person and
another or others, said safe deposit box shall not be entered by
the guardian except in the presence of a representative of the
financial institution where the box is located or in the presence
of a representative of the Orphans' Court Division. The
representative present at the time of entry shall make or cause to
be made a record of the incapacitated person's property, and said
record shall be filed with the Clerk of the Orphans' Court
Division.
None of the incapacitated person's property may be
removed until after the aforesaid inventory is completed.
A reasonable fee for the services of the representative may be
made and shall be payable from the estate of the incapacitated
person. If the safe deposit box is jointly owned, five (5) days
notice of the proposed entry shall be given to the other owners by
the guardian.

IDENTIFYING INFORMATION:
The patient is an 85-year-old widowed white male, He is
currently a resident at Country Meadows Living Center,
He said he is a retired machine shop worker, has 2
children a son and a daughter,
The patient said he has been widowed since the mid 1940's
when the patient was approximately in his middle thirties.
The patient is retired again as a machine shop worker.
Said he has 8 years of formal education and 3 years of trade
school vocational training.
REFERRAL SOURCE:
Dr. Torchia.
HISTORY OF PRESENT ILLNESS:
This patient has been referred to me for a
neuropsychiatric evaluation and review of current medication.
I see there is a letter from the family's attorney
stating that they want a deposition regarding this patient's
case in terms of an evaluation of an incapacitated person.
The attorney's name is William Adler of Harrisburg,
Pennsylvania.
According to the Country Meadows information sheet this
evaluation was also requested by the family to help prepare
the legal paperwork required for guardianship.
There were no family members available to ask questions
of during the evaluation. The patient's children were not
available to talk to on the phone during my evaluation.
However after I completed the evaluation I was able to reach
the patient's daughter via telephone. She stated the patient
has been having many recent memory difficulties including

wandering behavior and delusions that other people were out to
harm him and to steal his belongings. When he was moved from
his former residence to the basement living quarters of his
daughter, he called 911 complaining to the police he was
"being imprisoned." The cognitive decline has been of a slow
down hill course. He does not have a history of stroke or
TIA's as far as the family knows.
According to Dr. Torchia's initial evaluation, the
patient has a history of senile dementia, Alzheimer's type of
unspecified duration, He is also said to be status post
colostomy due to colon cancer in 1988.
The patient apparently was seen by Dr, Torchia for his
first evaluation by Dr, Torchia on 12/19/95. Before that he
was seeing his family practitioner Dr. Mueller.
The patient's current medications include the following:
1. Ativan 0.5 mg. 1 p,o. q.8 hours PRN.
2. Haldol 0.5 mg, 1 p,o. b.i.d.
3. Mylanta 15 cc. p,o. PRN indigestion.
The patient reports to me that his sleep pattern has been
intact. He denies any problems with initial phase insomnia or
early morning awakenings. Appetite is said to be good. His
current weight is 158 pounds. His height is about 6 foot 1.
The patient reports his normal weight is between 155 to 160
pounds.
The patient said his memory is "so so." Said he has no
real hobbies but does have some interest that include doing
push-ups and occasionally doing gardening. He said his
energy level is good. He does not complain of fatigue.
Denies any suicidality or homicidality.
In terms of habits the patient said he does not smoke
cigarettes. Does not abuse alcohol. He said he drinks
perhaps 1-2 "glasses of coffee daily."
The patient denies any past psychiatric history.
PAST MEDICAL HISTORY:
There is no known drug allergies.

The limited history I have from Dr. Torchia is as
described above with senile dementia Alzheimer's type and
status post colostomy due to colon cancer in 1988.
There is a denial of head injury to seizure disorder,
PAST PSYCHIATRIC HISTORY:
The patient reports to me that he has never had any
former psychiatric assessments or evaluations done in the
past.
FAMILY HISTORY:
died of tuberculosis
around age 56. He was
The patient's father reports
somewhere in the 1950's when he was
formerly employed as a mechanic.
The mother died of cancer of an unspecified type about
age 65.
The patient reports he has one sister alive at age 75 who
he sees on an occasional basis.
He had a sister age 40 who passed away and another sister
age 35 who also passed away.
MENTAL STATUS EXAMINATION:
The patient is an 85-year-old white male who appears to
be younger than his stated age. His attitude is one of fairly
good cooperation. His eye contact is fair. There is no
evidence of psychomotor retardation or agitation.
The patient is alert. He is oriented to person, not to
place, partially to time.
He was administered the Folstein mini mental state
examination. In terms of orientation he felt the year was
either 92 or 95. He got the season of the year right naming
winter, He got the day of the week wrong by one day saying it
was Sunday when in fact it was Monday. He guessed the date of
the month would be the 28th or the 29th. He felt the month
of the year was February,
When asked where he was he stated that he was in state of
New Jersey. He said the town he was in at the present was
South Amboy, Did not know that he was in a nursing home.

When asked what floor he was on he said "the main floor" even
though he was on the second floor.
He had poor object recall with 0 out of 5 objects
recalled at 5 minutes. He had trouble with serial 7's
performing only 2 mathematical operations correctly. He did
not show evidence of anomia being able to identify a pencil
and watch correctly. He could follow a 3 stage command, He
could obey a command to close his eyes, He did have trouble
reproducing a geometric design and had severe problems drawing
a clock face.
Overall his total score was 12 out of a possible total
score of 30.
BRIEF NEUROLOGICAL EVALUATION:
Revealed the patient to have a blood pressure of 118/74.
The patient had pupils that were about 3 mm. and reactive
to light and accommodation. There was equal ocular motion.
The patient did appear to have some cataract formation
bilaterally. Grip strength was equal in left and right hands.
There was noticeable absence of the second rayon the right
hand. He said this was secondary to a past work related
industrial accident. Deep tendon reflexes were basically 1+
and symmetric in upper and lower extremities. When the
patient stood up he did have some evidence of Romberg sway but
did not actually fall over. He had some difficulties
performing a heel to toe tandem gait forwards. He could not
perform this at all backwards.
ASSESSMENT:
This is the first neuropsychiatric evaluation on this 85-
year-old white male. The patient carries a history of
Alzheimer's type dementia.
He does appear in general to meet the criteria for a
dementia and he does not have focal neurological deficits
suggestive of a multi-infarct dementia.
I also don' t have any laboratory studies in order to
review in order to ascertain the extent to which concurrent
neuromedical or metabolic disorders may be contributing to his
current difficulties.

Pursuant to a request regarding the above referenced Interests, please
be advised that according to our records the indicated number of
Interests are held as shown.
At the present time, there is no formal market for the Interests in the
Partnership, nor is one expected to develop. As there is no formal
market, the sale price of the Interests would be individually
established by the particular buyer and seller involved. Enclosed is a
schedule indicating recent purchases and sales of Interests which have
been reported to us. The prices are expressed as dollar amounts per
$1,000 investment (one Interest) in the Partnership. While we request
that new trade prices be reported to us, we cannot require such reporting.
We rely exclusively on the information furnished to us in preparing the
schedule. We have no ability to verify or confirm any of the resale
prices or the completeness of the schedule.
You may wish to bear in mind the fact that the Partnership's stated
objective has been to sell pro~erties when that appeared advantageous
in terms of the Partnership's ~nvestment objectives. The original
expectations as outlined in the Partnership's prospectus were that the
Partnership's properties would be sold or refinanced before or around
the twelfth year after acquisition. It is important to note that the
results which could be achieved if the Interests are held until all of
the Partnership's pro~erties are sold and the Partnership is liquidated
could differ substant~ally from the resale prices shown on the enclosed
schedule. Limited partnership Interests generally sell at a substantial
discount from their estimated underlying asset values.
Should disposition of the Interests be considered, we suggest that Federal
Income Tax considerations be taken into account. We recommend that tax
advisors be consulted prior to any disposition. The Partnership is unable
to offer tax planning advice to its Limited Partners.
The Partnership Agreement generally requires the Partnership to distribute
the net proceeds of any sale or refinancing of Partnership properties
(subject to working capital requirements) rather than reinvesting such
