I hereby expressly revoke all Wills and Codicils heretofore made by me. 2. I hereby direct my Executor to pay all my just debts, funeral and administrative expenses out of my estate, as soon as practicable after my death. 3. I direct that all taxes that may be assessed in consequence of my death of whatever nature and by whatever jurisdiction imposed shall be paid out of my estate as a part of the administration of my estate. 4. Objectant, Linda Gibbs is an adult individual residing at 50 West Keller Street, Mechanicsburg, Cumberland County, Pennsylvania, and is a residuary beneficiary under the above.. named estate. 3. On or about December 9, 1996, John L. Radabaugh, Executor of the Estate of Warren S, Radabaugh, filed his First and Final Account and Proposed Schedule of Distribution. 4. Accountant has failed to include among the assets of the decedent's estate the value of certain real estate previously owned by the decedent, known and numbered as 126 South Locust Point Road, Monroe Township, Cumberland County, Pennsylvania, which was deeded August 11, 1995 to Jack R. Franklin and Shelly A, Franklin. 5. Said Deed was conveyed at a time when the decedent was , , incapacitated, suffering from senile dementia, and was unaware of his actions in executing the Deed. 6, Further, said Deed was reported to be from grandparent to grandchildren, when the Grantees were not related by lienal decent from the decedent. 7, Further, the property was conveyed to the decedent for less than fair market value of the property; once it was realized that the Grantees were not the granddaughter and her husband of the decedent, transfer tax was paid in the estate in the equivalent of $560.00, which represented 1% of the value proported to be on the property in the amount of $56,000.00. A more realistic appraisal of the property would be between $90,000.00 and $120,000.00, which far exceeds the $56,000.00 value as placed on the home for this conveyance prior to decedent's death. 8. If the property was sold for its true fair market value, additional $34,000,00 to $64,000.00 would have been received by the e~tate and available for distribution to the residuary heirs. 9. Further, the assets of the estate lists a payoff of a mortgage from Shelly A. and Jack R, Franklin to the decedent in the amount of $31,641.71. Morgenthal, Esquire, the opportunity to try to resolve this case amicably without need to have an auditor. As it doee not appear that there is any way to resolve this short of having an auditor appointed, I would request that you go ahead and appoint an auditor, I am in receipt of a letter to you dated March 7, 1997 from Roger M. Morgenthal, I, too, agree that an auditor can be appointed initially to determine the issue of standing so that if it is found my clients do not have any, which I believe they do, there would not have to be testimony taken and unnecessary costs and expenses incurred by either my clients or the Estate. Radabaugh, Executor of the Eetate of the above named decedent, filed a First and Final Account. Thereafter on January 3, 1997, Lois Kramer and Linda Gibbs, residuary beneficiaries of the Estate, filed Objections to the Account and Schedule of Proposed Distribution. On May 1, 1997, the undersigned was appointed by Honorable Harold E. Sheely to pass on the Objections. The undersigned Auditor officially assumed his duties on May 5, 1997, A meeting was held with counsel for both parties on May 22, 1997, at which time counsel for both parties agreed to cooperatively obtain and exchange information to simplify issues or perhaps resolve the issues. A pre-hearing conference was schedule for July 15, 1997 and an Auditor's hearing for July 17, 1997, Prior to the hearing counsel for both sides requested the Auditor to postpone the hearing to enable them to obtain and exchange information. Pureuant to those requests, the Auditor's hearing was continued. Subsequent, the Auditor was advised by counsel for both parties that a tentative Settlement Agreement had been reached, On July 24, 1996, the Auditor filed a Petition for Extension of his appointment for an additional ninety (90) days, and on the same date Honorable Harold E. Sheely entered an Order granting the requested extension. On September 26, 1997, counsel for the parties delivered to the Auditor an Agreement and Withdrawal of Exceptions. Therefore, the Auditor makes the following" ~r' 1. The parties have reached a written Agreement being filed with this Report, and marked Exhibit "A", which makes amendments to the First and Final Account and contains a Withdrawal of Objections, The Agreement provides that the Estate shall pay t'~ fees and costs of the Audit. 2. The fees and expensee in connection with the audit are as follows: 1. Dale F, Shughart, Jr., Esquire, Auditor's fees, $450.00 2, Dale F.
