VOGELSONG, of the Township of Silver Spring, County of Cumberland and State of Pennsylvania, being of sound and disposing mind, memory and understanding, do make, publish and declare this my Last Will and Testament, hereby revoking and making void any and all prior Wills by me at any time heretofore made. 1. I direct the payment of all my just debts and funeral expenses as soon after my decease as the same can conveniently be done. 2. I give, devise and bequeath to my son, Larry L. Vogelsong, my farm of 134 acres, formerly the Snelbaker Farm, in Silver Spring Township, together with any and all cattle, machinery, implements and household effects in the dwelling absolutely and in fee simplel subject however, to the provisions of Paragraph 6 of this Will. 3. I give and devise to my son, Lawrence B. Vogelsong, my 6a acre farm in Silver Spring Township, less however, that portion thereof adjoining the residence of my daughter, Joyce A. Westhafer. I direct my Executor to have a surveyor layoff a tract of land bounded 155 feet, more or less, on the East by the Rich Valley Road extendi~, from the land of Joyce A. Vogelsong, set forth in Paragraph 3 hereof. This gift to Joyce A. Westhafer is subject to the provisions of Paragraph 6 of this Will. 5. All the rest, residue and remainder of my estate, I give, devise and bequeath as follows: One-half to my daughter, Joyce A. Westhaferj One-half to my son, Larry L. Vogelsong. 6. It is my intention that all debts, costs of administration, funeral expenses, Pennsylvania Inheritance Tax and the Federal Estate Tax be paid from assets not specifically devised in Paragraphs 2, 3 and 4 of my Will. In the event there are insufficient funds to pay these items so there is no residue remaining for distribution under Paragraph 5 of my Will, I direct the specific legatees under Paragraphs 2, 3 and 4 shall be responsible for payment of the deficiency. I direct the following procedure be followed by my Executor: (a). All real estate shall be appraised by a competent appraiser and the appraised value used in calculating the contribution of each specific legatee toward the deficiency. (b). (d). Each specific legatee shall be immediately notified in writing of the deficiency and the contri- bution of each'which shall be calculated by multiplying the deficiency by a fraction the numerator of which shall be the appraised value of the land devised to each and the denominator of which shall be the total appraised value of all land specifically devised. (e). Each specific legatee shall pay the deficiency for which each is liable within forty (40) days from the date of notice. (f). In the event any legatee fails or refuses to pay said deficiency within the forty (40) day period, time being of the essence, I direct my Executor to sell the land devised to said legatee at private or public sale and for such price as can be obtained without any duty on his part to receive the appraised value therefor. The deficiency for which said legatee would be responsible as set forth above shall be deducted from the sale price and applied to the deficiency and the balance after payment of costs of sale are deducted shall be paid to the legatee in lieu of the land devised to him or her. -3- '.
