BAKER, an alleged incapacitated person NO. 21-96-173 IN RE: PETITION FOR GUARDIANSHIP BEFORE OLER. J. OPINION AND ORDER OF COURT Oler, J. At issue in the present case is whether Charles R. Baker should be adjudicated an incapacitated person and, if so, whether Arnold Joseph Whitehouse, who is his brother-in-law, should be appointed plenary guardian of his person and Financial Trust services company should be appointed plenary guardian of his estate. A hearing was held on the matter on Thursday, April 25, 1996, before the undersigned judge. Based upon the evidence presented at the hearing, the following Findings of Fact, Discussion and Order of Court are made and entered: FINDINGS OF FACT 1. The allegedly incapacitated person is Charles R. Baker, a domiciliary of Cumberland County, Pennsylvania, residing at 222 East North Street, Carlisle, Cumberland County, Pennsylvania. 2. Mr. Baker was born on July 24, 1909, and, until the recent death of his wife, resided with her at the above address; for the past several months, he has been at the .. '. Carlisle Hospital. 3. Petitioner is the Carlisle Hospital, a Pennsylvania nonprofit corporation with a place of business at 246 Parker street, Carlisle, Cumberland County, Pennsylvania. 4. The allegedly incapacitated person, Charles R. Baker, suffers from dementia (Alzheimer's type), a condition which has apparently existed for several years but has been progressive in nature. 5. As a result of the aforesaid condition, the allegedly incapacitated person is an adult whose ability to receive and evaluate information effectively and communicate decisions is impaired to such a significant extent that he is totally unable to manage his financial resources and totally unable to meet essential requirements for his physical health and safety. 6. The aforesaid condition is apparently of an indefinite and possibly permanent nature. 7. Based upon the aforesaid condition, the Court finds that it is necessary to establish plenary guardianships with respect to the estate and person of Charles R. Baker. 8. In view of the absence of a more favorable prognosis at this time, the duration of the guardianships required must be said to be indefinite, pending further Order of Court and apparently permanent. 9. The guardianships to be established herein are necessary notwithstanding the personal assistance which Mr. Baker's ramily has been able to provide. 10. The proposed guardian or the person or Charles R. Baker is Arnold Joseph Whitehouse, a resident or New York state with an address of 24 Milford street, Binghamton, New York. 11. The proposed guardian of the estate of the allegedly incapacitated person is Financial Trust services company, a division of Farmers Trust company, with offices located at 1 West High street, Carlisle, Cumberland County, Pennsylvania. 12. The proposed guardians are found to be an individual and entity qualified under 20 Pa. C.S. Section 5511(f) to serve as plenary guardians of Mr. Baker's person and estate respectively. 13. The foregoing Findings of Fact are made on the basis of clear and convincing evidence. DISCUSSION The provisions respecting an adjudication of incompetency have been recently amended and are contained in 20 Pa. C.S. section 5501 et. sea. Petitioner has fully complied with these provisions, and, based upon the foregoing Findings of Fact, the following Order of Court will be entered: ORDER OF COURT AND NOW, this 25th day of April, 1996, upon consideration of the Petition for Adjudication of Incapacity and Appointment of a Guardian of His Person and of His Estate, and following a hearing held on this date, Charles R. Cumberland County. Pennsylvania 17013. 4. The names and addresses of the spouse. parents and presumptive adult heirs of the alleged incapacitated person are as follows: Spouse: Deceased. Parents: Deceased. Presumptive Heirs: None. 5. Petitioner believes, and therefore avers. that the only sUlviving relative of the alleged incapacitated is his brother-in-law, Arnold Whithouse, who has a residence at 8039 State Road. S4, New Port Richy. FL 34653. Mr. Whitehouse is not a resident of Pennsylvania. has had little contact with the alleged incapacitated and has recently experienced health problems. For these reasons, Mr. Whitehouse has indicated that he does not desire to act as guardian to the alleged incapacitated. 6. There is no person or institution providing residential services to the alleged incapacitated person. The alleged incapacitated person is currently an inpatient at Carlisle Hospital. 7. Guardianships are sought because the ability of the alleged incapacitated person to receive and evaluate information effectively and communicate decisions is impaired to such a significant extent that he is totally unable to manage his mcdical condition to mcct csscntial requircments for his physical hcalth and safcty, and is totally unablc to manage his financial resources. 8. A dcscription of the functional limitations and physical and mental condition of the alleged incapacitated pcrson is set forth in the sworn dtatcmcnt of Rocco L. Manfredi. M.D. attached hereto and made a part hereof as Exhibit "A". 9. The specific areas of incapacity ovcr which it is requcsted that thc guardians be assigned powers are the management of all aspects of the physical care and well-being of the alleged incapacitated person, as to the guardian of the person. and the management of all financial resources and propcrty in the alleged incapacitated person's estate, as to the guardian of the estate. 10. Petitioner proposes that Capitol-Public Guardianship Agency. P.O. Box 1113 Camp Hill, Pennsylvania, owned and operated by Ann Thorek, be appointed guardian of the person of the alleged incapacitated person. The qualifications of the proposed guardian of the person is that said entity has skill and experience in arranging care for persons unable to do so on their own. I \. Petitioner proposes that Financial Trust Services Company. I West High Street. Carlisle Pennsylvania 17013. be appointed as guardian of the estate of the alleged incapacitated. The qualifications of the proposed guardian of the estate is that said entity has skill and experience in handling financial and monetary matters in fiduciary capacities. 12. The proposed guardians have no interest adverse to the alleged incapacitated person. 13. The aforesaid sworn statement of Rocco L. Manfredi, M.D. further states that the physical and mental condition of the alleged incapacitated person would be harmed by his presence at the hearing on this Petition. 14. Petitioner believes that there are no less restrictive alternatives to guardianship. There are no durable general powers of attorney. trusts or other advance directives in existence. The alleged incapacitated person lacks sufficient capacity to appoint an attorney-in-fact. The diagnosis and prognosis of the alleged incapacitated person are as set forth in the aforesaid sworn statement of Rocco L. Manfredi. M.D. For these reasons, Petitioner respectfully submits that there is no less restrictive alternative to plenary guardianship of thc person and of the estate. IS. The gross value of the alleged incapacitated pcrson's estate is estimated to be S I 50,000.00. To the extent Petitioner has been informed, it is believed that these assets are comprised of cash and real cstatc. Thc foregoing is bascd upon consultations with friends of the allcged incapacitatcd person. No appraisals have bccn pcrformcd, nor inventorics conducted. 16. The allcged incapacitated person's annual net income from all sources is unknown. 17. No other court has assumcd jurisdiction in any procceding to dctermine the capacity of the alleged incapacitated person and no othcr Court or other body has appointed a limited or plenary guardian for the alleged incapacitated person or his estate to thc best of the knowledge and information of the Petitioners. 18. On or about February 21, 1996, Carlisle Hospital filed a Petition for Adjudication of Incapacity and Appointment of a Guardian of his Person and of his Estate (the "Guardianship Petition") was filed to the above captioned docket. 5. In the Guardian Petition Carlisle Hospital sought judicial determination of Charles R. Baker's mental capacity and, if appropriate, appointmcnt of guardians for his estate and person. 6. A hearing on said Guardianship Petition was held on April 25, 1996. 7. By Order dated April 25, 1996, this Court adjudicated Charles R. Baker incapacitated and appointed Arnold Joseph Whitehouse plenary guardian of his person and Financial Trust Services as plenary guardian of his estate. A copy of aforesaid Order is attachcd hcreto as Exhibit A. 8. As a result of said Guardianship Petition Charles R. Baker now has appropriate fiduciaries charged with caring for his physical and financial well being, 9. In conncction with the Guardianship Petition and on behalf of Charlcs R. Baker, Carlisle Hospital incurred legal fees for the services providcd by thc law firm of Martson, Dcardorff, Williams & Otto in the amount ofS3,228.00. A copy of the billing statcmcnt rcpresenting said costs and fees is attached hereto as Exhibit "B". I O. In connection with the Guardianship Petition and on bchalf of Charles R. Baker, Carlisle Hospital incurred filing fee costs ofS32.00, deposition transcription costs ofS137.75, and expenses for certified copies of the aforementioned April 25, 1996 Order ofS4.00. See, Exhibit "B". II. Carlisle Hospital has expended S3,401.75 in costs and fees in connection with the Guardianship Petition and for the benefit of Charles R. Therefore the estate may escheat to tho Commonwealth of Pennsylvania upon Hr, Baker's death. 7, It is believed it would be grossly unfair to require Hr, Whitehouse, as guardian for the person, to pay the reasonable legal fees incurred to the benefit of Mr. Baker in regard to the incapacity proceeding, 8, The undersigned believes and therefore avers that if concerned relatives hiring legal counsel to act for the benefit of incapacitated love ones are subsequently held personally financially responsible for their efforts, when the incapacitated person has the financial ability to make the payment, people will hesitate to come forward, It is believed that the critical question is whether the fees were incurred for the benefit of the incapacitated person, 9, On three prior occasions the undersigned has served as court-appointed guardian for incapacitated persons and minors, in one case before Honorable Edgar B, Bayley and two cases before Honorable George E, Hoffer, In each case, in his capacity as counsel for the incapacitated person/minor, the undersigned has recommended to the Court that reasonable fees incurred by the guardians of the person be reimbursed from the Estate, On all three occasions, the court has done so, 10, The undersigned has spoken in regard to the matter on two occasions with John Wesley Weigel, III, Esquire, court- appointed counsel for the incapacitated person, It is the undersigned's understanding, based upon those conversations, that Attorney Weigel agrees that payment of legal fees incurred by Arnold J, Whitehouse should be paid by the guardian of Mr. Baker's Estate, Financial Trust services company, 11, Based upon the experiences of the undersigned in the three cases above referred to, he has recommended to Arnold J, Whitehouse to work directly with Attorney Weigel and Financial Trust Services Company in the future, and expects that all legal ,. , matters affecting the guardianship can be handled through Attorney Weigel without further involvement by the undersigned, 12, As the undersigned indicated in Judge Oler's Chambers prior to the hearing in this matter, section 5536 of the PEF Code authorizes the court to change estate planning of incapacitated persons upon Petition to the Court. Hr, Baker's situation may be one in which revised estate planning is in the best interest of the incapacitated person, The undersigned believes that any steps taken in that regard should originate by Petition of Attorney Weigel, and that Hr, Whitehouse should not be involved in regard to such decision making, 13, For the foregoing reasons as stated in Paragraphs 11 and 12, the undersigned believes that his service as attorney for Hr. Baker was admitted to Movant's facility after displaying symptoms of dementia. 4. On or about February 21, 1996, Movantliled to the above captioned docket for the benefit of Charles R. Baker, a Petition for Adjudication of Incapacity and Appointment of a Guardian of his Person and of his Estate (the "Guardianship Petition"). 5. A hearing on said Guardianship Petition was hcld on April 25. 1996. 6. By Order dated April 25, 1996, this Court adjudicated Charles R. Baker incapacitated and appointed Arnold Joseph Whitehouse plenary guardian of his person and Financial Trust Services Company, plenary guardian of his estate. A copy of aforesaid Order is attached hereto as Exhibit" A". 7. In connection with filing and prosecuting the Guardianship Petition Movant incurred legal fees and costs in the amount ofS3,40\.75. 8. On or about May 28, 1996, Movant filed a Petition for Reimbursement of Fees and Costs Incurred For the Bcnefit of Charles R. Baker (the "Pctition for Reimbursement"), wherein Movant sought reimbursement of the above refcrcnced costs and fees from the estate of Charles R. Baker. 9. Upon considcration ofthc pctition for Reimburscmcnt, this Honorablc Court issucd a Rule dated May 30, 1996 (the "Rule"). upon Arnold Joseph Whit chouse, guardian ofthc pcrson of Charles R. Baker, and financial Trust Scrvices Company, guardian of the estate of Charlcs R. Baker, to show cause why the rclicfrequested by Movant in its Petition for Rcimbursement should not be granted. Baker, have not filed any objection or answer to the Petition for Reimbursement nor have they shown cause why the relief requested therein should not be granted. 13. The Rule returnable period of twenty days from service has expired with no cause being shown why Movant should not be reimbursed as requested in its Petition for Reimbursement. WHEREFORE. I represent Carlisle Hospital in the incapacity 12 petition that'S been filed with regard to Mr. Charles Baker. :=> 13 There is a hearing coming up on Mr. Baker's incapacity this 14 Thursday, So, we are here today to take your deposition 15 testimony for that hearing. 16 17 A. 18 Q. 19 today? 20 A. 21 Q. Have you given deposition testimony previously? Yes, I have. So, you understand that you're under oath here Correct. And there's a court reporter sitting next to you 22 and she'll be taking down your responses. 23 24 A. Okay. Q. For the record, Dr. Manfredi, could you 5 state your full name and occupation? 6 A. 7 Q. 8 A. 9 Q. 10 A. 11 Q. 12 A. 0 13 Q. 14 A. 15 Q. ROCCO Louis Manfredi, and I'm a pSychiatrist. where do you maintain your offices? In carlisle, pennsylvania. Dr. Manfredi, where did yOU attend medical school? Hershey Medical Center, penn State university. And did you graduate from Hershey Medical? Yes, I have. And what year was that? 19B3. Did you do any residency or anything after your 16 graduation? 17 18 19B7. 19 20 A residency in psychiatry, and I finished that in A. Q. And what did you do after your residency? 21 for five years and have been at Carlisle Hospital since 22 1992. And I am board certified in general adult, as well as 23 in geriatric psychiatry. 24 ~ 25 A. I continued employment at Hershey Medical Center Q. Do you have staff privileges at any hospital? A, At Carlisle HOspital. C.p.C.R.S. (717) 25B-3657 or (BOO) 863-3657 (7) '" 6 1 able to be involved. 2 unfortunately, all of those resourccs were 3 exhausted and no one could provide any serviccs for the 4 patient. So, he was admitted to the medical surgical floor 5 so that they could manage him while his wife was 6 hospitalized. On Monday morning, two days later, his wife 7 expired, He was still in the hospital on the med surg B floor. That day he became extremely aggressive, 9 rambunctious, cantankerous. He was wandering allover the 10 hospital and the staff could not control him because he 11 would become aggressive when they'd try to escort him back 12 to his room. So, they consulted me at that time to come see <:) 13 him, which I did. 14 He would have periodS at that time where he was 24 He's demented in all spheres. He's disoriented to time and ~ 25 place, His thought perceptions are very incoherent. It's 15 oriented. He knew his wife had died. He knew he was in the 16 hospital. But that would be temporary and then he would 17 become extremely confused again and think his wife was still 18 living, thinking that he was at home, wanting to leave, 19 became aggressive again. So, based on our observations it 20 was decided to admit him psychiatrically to try to stabilize 21 his condition, as well as to develop a disposition for him. 22 So, he was admitted to our floor on 2/5/96. Since 23 he's been admitted his mental status really hasn't changed. C.P,C.R,S. He requires constant nursing input to manage his 3 day-to'day activities. It's very apparent that without this 4 supervision he would not function in the outside 5 environment, 6 Social work services have been involved with the 7 neighbors discussing with them the patient's condition. 8 They say that if it were not for his wife he would never 9 have been functioning at home. He wandered out of the home 10 constantly. They had to chase him down the street. His 11 wife had to monitor him 24 hours a day. So, based on this 12 our recommendations were for a nursing home placement so ~ 13 that he could have 24 hour supervision. unfortunately, he 14 had no power of attorney guardian so there was no way we 15 could place him outside of the hospital into an extended 16 care facility, and that is why we pursued guardianship. 17 Q. You had indicated that your initial consultation 18 with Mr. Baker occurred on February 5th, 1996? 19 20 A. Correct. Q. At that time could you explain any tests that you 21 administered at that initial consultation? 22 A. They were just screening lab tests. We did oxygen 23 monitoring, because he has a history of obstructed pulmonary 24 disease, and a physical examination, neurological ~ 25 assessment. There were no focal neurological signs to C.P.C.R.S. (717) 258-3657 or (800) 863-3657 B ;-) 1 indicate that he had a stroke. By taking further history 2 it's apparent that it's been a progressive downhill courBe 3 consistent with senile dementia primarilY of the Alzheimer's 4 type, and that has been our working diagnosis. And since 5 he's been here our observations certainly are consistent 6 with that diagnosis, 7 Q. Have you had contact with Mr. Baker subsequent to B the February 5th, 1996 consultation? 9 10 A. On a daily basis except Sundays. Q. And could you describe any changes in his 11 condition throughout that point? .::> 13 his level of cognition. Sometimes he's a bit more oriented 14 than others, but for the most part he's disoriented. His 12 A. He's had no changes. He has waxing and waning of 15 mini-mental status exam, which is a psychological test to 16 assess cognitive functioning, indicates that he is fully 17 severely deranged. 18 Q. You referenced a mini-mental exam. could you 19 explain what that exam is? 20 A. It's a screening exam that assesses orientation, 21 registration, attention and calculation, memory, language, 22 and gives you some screens in each of those areas to assess 23 how one does. He does poorly in all those areas, which is 24 consistent with dementia. ~ 25 Q. Is there .- is the mental mini exam scored C.P.C.R.S. (717) 25B.3657 or (800) B63-3657 9 (J) 1 numerically? 2 A. Correct. Out of a total score of 30, that would 3 be a perfect score, which would mean someone functioning 4 normally. When you get down below 25 there's a serious 5 question of dementia. He has scored consistently below 15, 6 which is very severely demented. 7 Q. Did you do any other tests at that point? B A. No others at that point. 9 Q. When was the last date of your last consultation 10 with Mr. Baker? 11 A. Would be yesterday. 12 Q. What is your opinion as to whether Mr. Baker has <:) 13 the ability to receive and evaluate information effectively? 14 A. Your question again? I'm sorry. 15 Q. Your opinion as to whether Mr. Baker can receive 16 and evaluate information effectively? 17 A. Oh, he cannot. 18 Q. Does Mr. Baker's incapacity affect his ability to 19 manage financial resources? 20 A. He has no idea of what his financial resources 21 are. His wife always managed it for them over these past 22 few years. 23 Q. Would Mr. Baker's incapacity affect his ability to 24 meet essential health needs? f~"~ U 25 A. Yes. It's apparent that without nursing C.P.C.R.S. (717) 258-3657 or (800) 863-3657 i l~ 10 ~ 1 supervision he does not bathe. lie will defecate or urinate 2 in the hallway, in the bedroom, and will not manage his 3 daily needs. 4 Q. what is your prognosiS for the future of Mr. 5 Baker'B condition? 6 A. To remain the same, but more likely to get worse 7 over time. B Q. And is iL your opinion that Mr. Baker indeed needs 9 a guardian appointed for his supervision? 10 A, That's my opinion, yes. 11 Q. And have all the opinions that you've expressed 12 today been within a reasonable degree of psychiatric c:; 13 certainty? 14 A. Yes, they have. 15 MR. POWELL: That's all that I have. 16 BY MR. WEIGEL: 17 Q. For the record my name is Attorney -- I am 18 Attorney John weigel. I've been appointed by the court to 19 represent Mr. Baker in this proceeding, and I also have some 20 questions for you. 21 22 23 24 0 25 In looking at your medical record it does appear, I think, that you did do some sort of testing besides a mini-mental exam, something about not being able to do serial sevens. A. Correct. That's a part of the mini-mental exam. c.P.C.R.S. (717) 25B-3657 or (800) B63-3657 11 o could you explain what that is? o. Yes. You start with a hundred and subtract seven 1 2 A. 3 from that and consistentlY subtract seven from that as far 4 as you can go. 5 o. And I guess __ could you give an example of what 6 kinds of other questions the mini-mental statuS exam 7 involves? sure. under orientation. would be the year. the 8 A, 9 season. the day of the week. the month of the year. You 10 would ask where he lived. what country are we in. what 11 county are we in. where are we right now. becoming more and 12 more specific. For memory. it would be have them name three c:> 13 objectS. like ball. car. and door and then three to five 14 minutes later ask them to repeat that to assess 15 immediate __ well. you ask them to say it then. That would 16 be immediate recall. Then later. that would be later 17 retention. you ask them to name things. YoU hold up a 1B 19 pencil. ask them to name it. Hold up a watch. ask them to 20 name it. Ask them to read something. read it back to you, 21 Ask them to write something and ask them to draw a figure 22 with interlocking corners. which is an assessment of 23 eye-hand coordination and perception. 24 0, Okay. How does this test distinguish between ~ 25 someone who suffers from dementia and someone who suffers C.p.C.R.S. (717) 25B-3657 or (BOO) 863-3657 12 ,-:) 1 from a substandard education? 2 A. Very easily. I mean with any type of education 3 you should know where you are, you should know what day it 4 is pretty much, you should be able to know the season of the 5 year. If they can't do like the serial sevens, you have 6 them do something else. Like spell cat, spell it 7 backwards. It's more of a matter of whether or not the B person can pay attention to what they're doing. So, there 9 are different tasks for different abilities. 10 Q. Okay. Was Mr. Baker asked to do simple spelling 11 tests? 12 A. Yes, he was. He was asked to spell cat. He was 0 13 asked to spell world, and he really can't do it. 14 Q. Okay. Now, I heard you give some testimony as far 15 as neighbors or possible relatives being checked out as 16 alternatives. Did you do that yourself? 17 A, I spoke with his brother-in-law who was in Florida 18 at the time and I met with him here subsequently. Social 19 work services was in contact with the neighbors and reported 20 the information to me. 21 Q. But it was social workers who spoke with the 22 neighbors? 23 24 A. Correct, Q. Tell me, Doctor, did Mr. Baker sign his own o 25 admission forms? C,P.C.R.S. Or 7 maybe I am assuming something I shouldn't. Are you aware of 8 whether Mr. Baker has had a treating physician? 9 A. The treating physicians are the ones that were 10 managing him in the hospital who continue to follow him for 11 his medical needs. 12 Q. Okay. You mean since his admission? :) 13 A. Correct. 14 Q. Had he had a treating physician before being 15 admi tted to this hospital? 16 A, That I'm not aware of. 17 Q. What are the names of his treating physicians? 18 A. It' s the Belvedere Medical Group. 19 Q. Does that include Drs. Albright and Carey? 20 A. Correct, 21 Q. Is a diagnosis of dementia including Alzheimer's 22 more typically made by a physician or by a psychiatrist? 23 A. Either can make that. Psychiatrists are 24 physicians. o 25 Q. How long does a typical visit last with Mr. Baker C,P,C.R.S. (717) 258-3657 or (800) 863-3657 14 16 .~ 1 to his room. He's tried to damage property when he gets in ~~ 2 his confused states. 3 Q. 4 hospital? 5 A. Has he expressed a desire to be released from the He doesn't say that specifically. Sometimes he 6 doesn't think he's in the hospital. Many times he doesn't 7 think he's in the hospital, 8 Q. But at that time on February 5th his speech was 9 fluent, coherent, and goal directed? 10 A. Correct. Like I said, when he has his good 11 periods of time it will be that way again. 12 Q. okay. So, what YOU're saying then is you happened (:) 13 to catch him during a good period with your evaluation? 14 A. 15 Q. Yes. That particular time was a good period. Did you know that that was going to be a good 16 period or did you just walk in? 17 A. 18 19 20 21 22 23 Hospital? 24 o 25 It was my first contact with him randomly. Q. And at that time he knew the month and the year? A. Correct. Q. And he did know the day of the week? A. Yes. Q. And he knew his location was in the Carlisle A. Correct. Q. Did you explain to him what his stay here at the C.P.C.R.S. (717) 25B-3657 or (800) 863-3657 17 ~ 1 hospital would involve at the time you admitted him? 2 3 A. Yes, I did. Q. And you explained that you might be prescribing 4 medication for him? 5 6 A. Correct. Q. And did you explain to him whether he would have a 7 right to leave? 8 9 He had a 72-hour notice definitely. A. Q. So, if he told you I want to go now, you would let 10 him go 72 hours later? 11 A. We would have a court hearing to let the Judge 12 decide, the magistrate decide if he could leave, but he's ,::) 13 never signed a 72-hour letter or asked for one. I don't 14 feel he would be safe to leave the hospital. 15 Q. You mentioned your belief that without nursing 16 supervision he might relieve himself in the hallway. 17 1B 19 20 currently. 21 A. Yes. Q. Has he actually done that? A. Yes, on several occasions, and he wears a diaper Q. DO you know how frequently he was visited by 22 visiting nurses before the stay here? 23 24 A. No, I don't. Q. The nurses know who they are. what medication is Mr. Baker currently on? He's on medications prescribed by the Belvedere l~ 13 Group. I can give it to you. He's on a prevental inhaler 14 for his COPO, Coumadin, a blood thinner, potassium, Lanoxin 15 for his cardiac arrythmia, and Lasix for his fluid 16 retention. I have used medication intermittently with him. 17 He's not on any psychiatric medication at this time. 18 19 20 21 placement 22 23 Q. what is COPO? A. Chronic obstructive pulmonary disease. Q. Has Mr. Baker stated any preference regarding A. No. Q. ._ where he wants to go? Hasn't he said that he 24 wants to go home? :J 25 A. Yes. c.P.C.R.S. He would rather be home. He does not particularly 6 want to go to a nursing home. He doesn't think he needs 7 one. 8 Q. You may not be able to answer this question, but 9 does the hospital have any services which might allow Mr. 10 Baker to live at home? 11 A. He would require 24 hour in-home care. 12 Q. 24 hours. Have you performed any exams or tests, ,~ 13 such as the mini-mental status exam, since his initial 14 evaluation? 15 A. Oh, yes. He gets one a week, at least, by the 16 nurses, and I do my own almost daily. 17 Q. SO, they are essentially repeating the original 18 exam. Is that what' s happening? 19 A. Correct. 20 Q. And how have his scores been? 21 A. Consistently below 15. 22 Q. SO, the ini tial 19 out of 3D, was that his highest 23 exam? 24 A. Correct. o 25 Q. He's unaware of the extent of his incapacities. 2 He doesn't feel he needs any help in any way. He's never 3 asked for help. Q. So, he never asks somebody to help him dress? A. No. Q. Or bathe? A. ~. Q. Have you formed any opinion regarding the ability of my client to be present in court at his hearing on Thursday? A. I think it would really agitate him. I don't think he'd understand exactly what's going on. It would probably result in him feeling extremely anxious and agitated. Q. Okay. Wel1-- A. Plus, he's not feeling very well physically at 17 this point. 18 Q. Does he know that there is a hearing on Thursday? 19 A. He's been told. He can't recall it when you ask 20 him later that day. 21 Q. Do you have any specific nursing home in mind that 22 you would prefer to see him lodged at? 23 A. " 5, Petitioner believes, and therefore avers, that the only surviving relative of the alleged incapacitated is his brother-in-law, Arnold Whithouse, who has a residence at 8039 State Road, S4, New Port Richy, FL 34653, Mr. Whitehouse is not a resident of Pennsylvania, has had little contact with the alleged incapacitated and has recently experienced health problems. For these reasons. Mr. Whitehouse has indicated that he does not desire to act as guardian to the alleged incapacitated. 6, There is no person or institution providing residential services to the alleged incapacitated person. The alleged incapacitated person is currently an inpatient at Carlisle Hospital. 7, Guardianships are sought because the ability of the alleged incapacitated person to receive and evaluate information effectively and communicate decisions is impaired to such a significant extent t/ult he is totally unable to manage his medical condition to meet essentia1 requirements for his physical health and safety, and is totally unable to manage his financial resources, 8. A description of the functional limitations and physical and mental condition of the alleged incapacitated person is set forth in the sworn statement of Rocco L. Manfredi, M.D. attached hereto and made a part hereof as Exhibit "A". 9. The specific areas of incapacity over which it is requested that the guardians be assigned powers are the management ofall aspects of the physical care and well-being of the alleged incapacitated person, as to the guardian of the person, and the management of all financial resources and prop~ in the alleged incapacitated person's estate, as to the guardian of the estate. 10. Petitioner proposes that Capitol-Public Guardianship Agency, P.O. Box 1113 Camp Hill. Pennsylvania, owned and operated by Ann Thorek, be appointed guardian of the person of the alleged incapacitated person. The qualifications of the proposed guardian of the person is that said entity ,has skill and experience in arranging care for persons unable to do so on their own. 11. Petitioner proposes that Fmancial Trust Services Company, 1 West High Street, Carlisle Pennsylvania 17013, be appointed as guardian of the estate of the alleged incapacitated. The qualifications of the proposed guardian of the estate is that said entity has skill and experience in handling financial and monetary matters in fiduciary capacities. 12. The proposed guardians have no interest adverse to the alleged incapacitated person: 13. The aforesaid sworn statement of Rocco L. Manfredi, MD. further states that the physical and mental condition of the alleged incapacitated person would be banned by his presence at the hearing on this Petition. 14. Petitioner believes that there are no less restrictive alternatives to guardianship, There are no durable general powers of attorney, trusts or other advance directives in existence. The alleged incapacitated person lacks sufficient capacity to appoint an attorney-in-fact. The diagnosis and prognosis of the alleged incapacitated person are as set forth in the aforesaid sworn statement of Rocco L. Manfredi. M,D, For these reasons, Petitioner respectfully submits that there is no less restrictive alternative to plenary guardianship of the person and of the estate. IS. The gross value of the alleged incapacitated person's estate is estimated to be $150,000,00, To the extent Petitioner has been informed. it is believed that these assets are \ comprised of cash and real estate. The foregoing is based upon consultations with friends of the alleged incapacitated person. No appraisals have been perfonned, nor inventories conducted. 16. The alleged incapacitated person's annual net income from all sources is unknown. 17, No other court has assumed jurisdiction in any proceeding to determine the capacity of the alleged incapacitated person and no other Court or other body has appointed a limited or plenary guardian for the alleged incapacitated person or his estate to the best of the knowledge and information of the Petitioners, 18.
