owners of a home in East Pennsboro Township, Cumberland
County, Pennsylvania. If my wife survives me and at my death
our home is held in any manner which will not result in
passage of full title to her by operation of law, I de\'ise my
entire interest in said home to her.
3. I give and bequeath to my wife, Barbara A. Hoover,
if she survives me, all furniture, clothing, jewelry,
pictures, statuary, works of art, silver, plate, ornaments,
bricabrac. tapestry, household goods or supplies, books,
I inen. china, glass, automobiles, trucks, trai lers, horses,
boats, and all implements, plants and tools that may be in or
upon our home at the time of my death, together with all
policies of insurance thereon, If my said wife shall
predecease me, then I give and bequeath all of said property
to my chi ldren who arc al ive at the time of my death, in
equal shares. Should such children be unable to agree upon
a division of said property, alternate choice of such items
shal I be made by them until distribution is completed, my
executor to represent minors in the division of such proper
ty. The first choice to be made by the oldest of my
children, the next choice to be made by the next oldest of
my children, and so on until distribution is completed.
4. I give, devise and bequeath all the rest of my
property of whatsoever nature and wheresoever situate,
including property over which I hold a power of appointment,
to mj' wife, Barbara A. Hoover, if she should survive me.
5, In the event that my wife, Barbara A. Hoover, shall
predecease me, then I give, dedse and bequeath all the rest
of my property of whatsoever nature and wheresoever situate,
including property over which I hold a power of appointment,
outright to my issue per stirpes, except for that share that
will go tu my son Daniel Joseph Huover, which share I give to
Mary Ann Hoover to hold IN TRUST for Daniel in accordance
with the following terms and conditions:
(a) The Trustee shall payor apply such portion or
portlona of the Income or principal, or both, to the uae or
for the bunuflt of my Gon Daniel as the Trustee In ita
discretion shall determine. It Is my Intention that this
trust shall be used for the benefit of Daniel In the snme
manner as I would have used it were I alive, that is with
regard to the needs of Daniel, In addltien to being used to
meet the ordinary living expenses of Daniel, I would like the
fund used to the extent that it is available, for the
expenses of serioua Illness. and for such other unusual or
emergency needs as may seem proper to the Trustee. All
undistributed accumulations of income shall be added to and
become a part of the principal of this Trust. The Trustee is
directed to take into consideration the amount that Daniel
is able to earn for himaelf before expending Trust Funds.
(b) When Daniel dies, this share shall be divided
equally among my remaining issue per stirpes.
(c) In the event that Mary Ann is unable or
unwilling to serve, then Helen M. Hoover shall be Trustee.
6. No interest of any beneficiary of my estate or any
trust herein created shall be subject to anticipation or to
pledge, assignment, sale or transfer in any manner, nor
shall any beneficiary have power in any manner to charge or
encumber his interest, either in income or principal, nor
shall the interest of beneficiary be liable or subject in
any manner while in the possession of the executor, trustee,
or guardian for the liability of such beneficiary whether
such liability arise5 from his debts, contracts, torts or
engagements of any type.
7. In the administration of my estate and any trusts
herein created, my fiduciaries shall have the following
powers, in addition to such powers as they may have by law:
(a) To retain all or any part of my property, real
or personal, in the form in which it may be at the time of my
decease, including any business owned or controlled by me, or
any closed corporation, partnership, or family enterprise in
which I have an interest, as long as in the exercise of their
discretion it may be advisable so to do. notwithstanding that
said property may not be of a character authorized by law,
and to operate any such business as a sole proprietorship,
partnershiP or corporation.
(b) To invest and reinvest any funds held by them
in any property, real or personal, even though such property
would not be conaidered appropriate or legal for a fiduciary
apart from this provision, it being my intention to give my
fiduciaries the same power of investment and reinvestment
which I would posaess if present and acting.
(c) To aell, convey, exchange, partition, give

personal, at any time held by them, at public or private sale
or otherwise, for cash or other consideration or on credit.

with the administration of my estate or the trusts created in

or personal. included herein, to divide or distribute in
cash, in kind. or partlY in cash and partlY in kind, as they
may determine. and to that end allot specifiC securities or
other property or an undivided interest therein to anY share
or part.
(h) To hold. manage, and develOP any real estate
which may be held by them at any time. to mortgage any such
property in such amounts and on such terms as they may deem
advisable, to lease any such property for such term or terms.
and upon such considerations and rentals as they may deem
advisable, irrespective of whether the term of any such lease
shall exceed the period permitted by law or the probable
period of retention in my estate or in a trust; to make
repairs. replacements and improvements, structural or
otherwise. in connection with an)' such property, to abandon
any such property which they may deem to be worthless or not
of sufficient value to warrant keeping or protecting, and to
permit anY such property to be lost by taX sale or other
proceeding.
(i) To emploY sueh brokers, banks, custodians,
investment counsel. attorneys, and other agents and to
delegate to them such duties, rights and powers as they may
determine, and for such periods as they think fit.
(j) To register any such securities at any time in
their own names, in their own names as fiduciaries or in the
names of nominees, with or without indicating the trust
character of the socurities so registered.
(k) With respect to any securities forming part of
my estate or the trusts created in this Will, to vote upon
any proposition or election at any meeting of the corporation
issuing such securities, and to grant proKies, discretionary
or otherwise, to vote at any such meetingi to join or become
a party to any reorganization, readjustment, merger, voting
trust, consideration or exchange, and to deposit any such
securities with any committee, depository, trustee or
otherwise, and generally to take all action with respect to
any such securities as could be taken by the absolute owner
thereof.
(I) To determine, as to all sums of money and other
things of value received by them whether and to what extent
the same shall be deemed to be principal or income, and as
to all charges and expenses paid by them, whether and to what
extent the same shall be charged against principal or income.
8. I direct that all estate, inheritance and
succession taxes that may be assessed In consequence of my
death, of whatsoever nature and by whatsoever jurisdiction
imposed, shall be paid out of the principal of my general
estate to the same effect as if said taxes were expenses of
administrationi and all property includible in my taxable
estate whether or not passing under this Will, shall be free
and clear thereof.
9. If any legatee or devisee under this Will shall die
within sixty (60) days after my death he shall be deemed to
have predeceased me for all purposes under this Will.
10. I appoint my daughters, Helen M. Hoover, of Camp
lIill, Pennsylvania and Mary Ann Hoover, of Mechanicsburg,
Pennsylvania, as my executrice, If either is unable or
unwilling to serve, then I appoint the other as my executrix.
II. My fiduciaries shall not be required to post bond
for the faithful performance of their duties in any
jurisdiction,

Cumberland County, Pennsylvania, declare this to be my Will
and hereby revoke all prior Wills and Codicils made by me.

if she survives me, all furniture, clothing, jewelry,
pictures, statuary, works of art, si Iver, plate, ornaments,
bricabrac, tapestry, bousebold goods or supplies, books,
linen, cbina, glass, automobiles, trucks, trai ler~, horses,
boats, and all implements, plants and tools that may be in or
upon our home at the time of my death, together with all
policies of insurance thereon. If my said wife shall
predecease me, then I give and bequeath all of said property
to my chi Idren who are al ive at the time of my death, in
equal shares. Should such children be unable to agree upon
a division of said property, alternate choice of such items
shall be made by them until distribution is completed, my
executor to represent minors in the division of such proper
ty. The first choice to be made by the oldest of my
children, the next choice to be made by the next oldest of
my children, and so on until distribution is completed.
4. I give, devise and bequeath all the rest of m)'
property of whatsoever nature and wheresoever situate,
including property over which I hold a power of appointment,
to m)' wife, Barbara A. Hoover, if she should survive me.
5. In the event that my wife, Barbara A. Hoover, shall
predecease me, then I give, dedse and bequeath all the rest
of my property of whatsoever nature and wheresoever situate,
Including property over which I hold a power of appointment,
outright to my issue per stirpes, except for that share that
will go to my son Daniel Joseph lIoovcr, which share I give to
Mary Ann Hoover to hold IN TRUST for Daniel in accordance
with the following terms and conditions:
(a) The Trustee shall payor apply sucb portion or

portions of the income or principal, or both, to the use or
for the benefit of my son Daniel as the Trustee in its
discretion shall determine. It is my intention that this
trust shall be used for the benefit of Daniel in the same
manner as I would have used it were I alive, that is with
regard to the needs of Daniel. In addition to being used to
meet the ordinary living expenses of Daniel, I would like the
fund used to the extent that it is available, for the
expenses of serious illness, and for such other unusual or
emergency needs as may seem proper to the Trustee. All
undistributed accumulations of income shall be added to and
become a part of the principal of this Trust. The Trustee is
directed to take into consideration the amount that Daniel
is able to earn for himself before expending Trust Funds.
(b) When Daniel dies, this share shall be divided
equally among my remaining issue per stirpes.
(c) In the event that Mary Ann is unable or
unwilling to serve, then Helen M. Hoover shall be Trustee.
6. No interest of any beneficiary of my estate or any
trust herein created shall be subject to anticipation or to
pledge, assignment, sale or transfer in any manner, nor
shall any beneficiary have power in any manner to charge or
encumber his interest, either in income or principal, nor
shall the .interest of beneficiary be liable or subject in
any manner while in the possession of the executor, trustee,
or guardian for the liability of such beneficiary whether
such liability arises from his debts, contracts, torts or
engagements of any type.
7. In the administration of my estate and any trusts
herein created, my fiduciaries shall have the following
powers, in addition to such powers as they may have by law:
(a) To retain all or any part of my property, real
or personal, in the form in which it may be at the time of my
decease, including any business owned or controlled by me, or
any closed corporation, partnership, or family enterprise in
which I have an interest, as long as in the exercise of their
discretion it may be advisable so to do, notwithstanding that
said property may not be of a character authorized by law,
and to operate any such business as a sole proprietorship,
partnership or corporation.
(b) To invest and reinvest any funds held by them
in any property, real or personal, even though such property
would not be considered appropriate or legal for a fiduciary
apart from this provision, it being my intention to give my
fiduciaries the same power of investment and reinvestment
which I would possess if present and acting.
(c) To sell, convey, exchange, partition, gh'e

options upon, or otherwise dispose of any property, real or
personal, at any time held by them, at public or private sale
or otherwise, for cash or other consideration or on credit,
and upon such terms and for such price as they may determine.
(d) To borrow money for any purpose in connection
with the administration of my estate or the trusts created in
this Will, to execute promissory notes or other obligations
for amounts so borrowed, and to secure the payments of such
amounts by mortgages or pledges of any property which may be

on such terms as they may determine, and to adjust, settle
and arbitrate claims or demands in favor of or against my
estate or the trusts created in this Will.
(g) In dividing or distributing any property, real
or personal, included herein, to divide or distribute in
cash, in kind, or partly in cash and partly in kind, as they
may determine, and to that end allot specific securities or
other property or an undivided interest therein to any share
or part,
(h) To hold, manage, and develop any real estate
which mar be held br them at any time, to mortgage any such
propertr in such amounts and on such terms as they may deem
advisable, to lease any such property for such term or terms,
and upon such considerations and rentals as they may deem
advisable, irrespective of whether the term of any such lease
shall exceed the period permitted by law or the probable
period of retention in my estate or in a trust; to make
repairs, replacements and improvements, structural or
otberwise, in connection with any such property, to abandon
anr such property which they may deem to be worthless or not
of sufficient value to warrant keeping or protecting, and to
permit any such property to be lost by tax sale or other
proceeding.
(i) To employ such brokers, banks, custodians,
investment counsel, attorneys, and other agents and to
delegate to them such duties, rights and powers as they may
determine, and for such periods as ther think fit.

(j) To register any such securities at any time in
their own names, in their own names as fiduciaries or in the
names of nominees, with or without indicating the trust

my estate or the trusts created in this Will, to vote upon
any proposition or election at any meeting of the corporation
issuing such securities, and to grant proxies, discretionary

a party to any reorganization, readjustment, merger, voting
trust, consideration or exchange, and to deposit any such
securities with any committee, depository, trustee or
otherwise, and generally to take all action with respect to
any such securities as could be taken by the absolute owner
thereof.
(I) To determine, as to all sums of money and other
things of value received by them whether and to what extent
the same shall be deemed to be principal or income, and as
to all charges and expenses paid by them, whether and to what
extent the same shall be charged against principal or income.
S. I direct that all estate, inheritance and
succession taxes that may be assessed in consequence of my
death, of whatsoever nature and by whatsoever jurisdiction
imposed, shall be paid out of the principal of my general
estate to the same effect as if said taxes were expenses of
administration; and all property includible in my taxable
estate whether or not passing under this Will, shall be free
and clear thereof.
9. If any legatee or devisee under this Will shall die
within sixty (60) days after my death he shall be deemed to
have predeceased me for all purposes under this Will.
10. I appoint my daughters, Helen M. Hoover, of Camp
Hill, Pennsylvania and Mary Ann Hoover, of Mechanicsburg,
Pennsylvania, as my executrice. If either is unable or
unwilling to serve, then I appoint the other as my executrix.
II. My fiduciaries shall not be required to post bond
for the faithful performance of their duties in any
jurisdiction.

HELEN M. HOOVER, it is hereby ordered and decreed that HELEN M. HOOVER,
Co-Personal Representative of the Estate of Karl V. Hoover, Deceased, is authorized
in her individual capacity to purchase the real estate located at 44 Circle Drive,
Camp Hill, Pennsylvania (more fully described on the attached Exhibit "A") for One
Hundred Five Thousand ($105,000.00) Dollars and the Co-Personal Representative
MARY ANN HOOVER LONG is hereby authorized to execute and deliver a deed to
HELEN M. HOOVER, her heirs and assigns, upon receipt by the Estate of the
purchase price.

6. Petitioner wishes to purchase the Real Estate for One Hundred Five
Thousand ($106,000.00) Dollars.
6. All parties in interest consent to the proposed sale. Their consents
are attached as Exhibit "B" to Exhibit "E", respectively.
7. There are no mortgages or other known liens of record, delinquent
taxes, water or sewer rents or judgments against the Real Estate.
8. The Real Estate is assessed for tax purposes at Nine Thousand One
Hundred Seventy ($9,170.00) Dollars.
9. Petitioner has obtained an appraisal from Linda S. Grady, a qualified
appraiser from R & L Appraisal Associates, which values the real estate at One
Hundred Five Thousand ($105,000.00) Dollars. A copy of the appraisal is attached
as Exhibit "F".
10. The Decedent's Estate is sufficient to discharge all of its just debts,
administrative expenses, and taxes.
WHEREFORE, Petitioner requests that this Honorable Court issue an order
granting leave to Petitioner to purchase the Real Estate for One Hundred Five
Thousand ($105,000.00) Dollars, and direct the Co-Personal Representative to
