I, KATIlERINE G, NTONAOOS, of Cumberland County, Pennsylvania, being of
sound and disposing mind and memory, do make, publish, and declare this
instrument to be my Last will and Testament, hereby revoking any and all wills
at any time heretofore made by me including my Last will and Testament dated
May 11, 1994 and the First Codicil to my Last Will and Testament dated
August 31, 1994,

ITEM 1: I direct that all my just debts, funeral expenses, expenses
of my last illness, and the expenses of the administration of my estate be
paid as soon after my decease as may be convenient. I direct that there shall
be paid out of my residuary estate all estate, inheritance, and like taxes
imposed by the government of the United States or any state thereof in respect
to all property required to be included in my gross estate for estate,
inheritance, or like tax purposes.
ITEM 2: I give and bequeath all of my common stock and the assets of
Stagg Inn, Inc. to the following, in the percentage set opposite their names:
VIOLET G, SMITIl, my sister, Sixty (60%) Percent;
GEORGE G, LAZOS, my brother, Forty (40%) Percent,
This stock does not include the real estate at 1619 Paxton Street,
Ilarrisburg, Pennsylvania which is in my name alone, I give my sister,
VIOLET G, SMITH, the opportunity to purchase sixty (60%) percent of this
building and my brother, GEORGE G. LAZOS, the opportunity to purchase forty
(40%) percent of this building at a value to be set solely by my co-Executors.
This opportunity must be exercised by VIOLET G. SMITH and GEORGE G, LAZOS

DECISION AND ORDER
Petitioner seeks to remove Schedule A item 5 real estate on the basis that it is
property held outside the state of Pennsylvania. In addition, Petitioner seeks to claim
expenses regarding the repair of the 1619 Paxton Street, Harrisburg rental property,
real estate taxes for 1994, 1995, 1996 on the 211 Walnut Street, Harrisburg property,
real estate taxes for 1994 and 1995 on the 1619 Paxton Street, Harrisburg property and
mortgage date of death principle balances on the Camp Hill and Lemoyne properties.
With respect to Schedule A item 5, the Board concurs that real estate located
outside Pennsylvania is not taxable for Pennsylvania Inheritance Tax purposes. The
$1,040.04 deduction for repairs on the rental property is disallowed because there was
no written contractual agreement between the decedent and the claimant. With respect
to the real estate taxes on the Harrisburg properties, Schedule H item C-20 1995 real
estate taxes in the amount of $5,603.10 and item C.25 1994 real estate taxes in the
