Cumhcrland County, Pcnnsylvania. hcing of sound and disposing mind, memory and
understanding. do herehy make. puhlish and declare this as and for my Last Will and Testamelll.
herehy revoking and making void any and all Wills hy me at any lime heretofore made,
I. 1 direct my hercinafter named Executor 10 pay all of my debts to which I am bound
and Ihe expenses of my funeral, lasl illness, and of the administration of my cstate as soon after
my death as may he found convenient \0 do so.
2. I deelare tlmt I :un currenlly married 10 Burlin Howcll. address unknown, and that I
have five (5) children who arc: Dale Stitzel, Jr.. Michael Stitzel, Gary Stitzel. Kathy Varhola and
Linda Whampler. I further declare that I havc no other children.
3. All of the rest, rcsidue and remainder of my estatc, real, personal or mixed, and
wheresoever the same may he situate. I give, devise and hequeath. to the exelusion of my
hushand, Burlin Howell, in equal shares 10 such of my children as shall survive me hy a period
of ninety (90) days, the share any deceased child would have received to pass to his or her issue
per slirpes. and if there be no issue such share shall lapse and he added to the remaining share or
shares per stirpes. At Ihe presenllime I have five (5) children as aforemenlioned. I have
intentionally made no provision for my said hushand, Burlin Howell. for Ihe reason that he
willfully and maliciously deserted me in June. 1994, withoul cause or consenl. Icaving no means
for me 10 conlacl him. no indication of when he might rcturn and providing no supporl for me in
any manner during the tenn of his absence.
4. Should any person less than 21 years of age he entitled to distrihution from my estate.
in such evenllhe share that person would otherwise have received shall he paid to my hereinafter
named Executor. in Irust. I authorize the hercin named lrustee to receive and inveslthe same, and
to pay the income arising Ihercfrom, together with so much of the principal thereof as in his
opinion is necessary or desirahle to be expended for Ihe proper maintenance. support, and
cducation of such person, to or for the henefil of such person, and upon such person attaining 21
years of age to pay to him or her the then remaining principallogelher wilh any undistrihuted
income,
5, I herehy nominate. constitute and ,Ippointmy son, Dale F, Stitzel. Jr.. as Executor of
Ihis my Last Will and Testamenl, hUI should he predecease me or fail to qualify. Ihen in such
cvenll nominate. constitute and appoint my sons, Michael Stitzel and Gary Slitzel, or either of
them, as Executors. and I further direct that none of them shall he required 10 post any hond 10
secure the failhful performance of his dUlies in the Commonwealth of Pennsylvania or in any
olher jurisdiclion.
6. In addition to the powers confcrred hy law, my Executors and Trustees arc herehy
cmpowered:
a. To invest any part of the Irust corpus in such securities, invest melliS, or other
property as may he deemed advisahle and proper, irrespective of whether the s:une are authorized
for the inveslment of lrust funds under the laws of any governing jurisdiction.
h. Wilh respect to any corporation. the stocks, honds, or other securities of which may
he held. to volc in person or hy proxy on any shares of stock: 10 ,on sent tn the merger,
consolidation or reorg;lI1ization of such corporations: to consent to the leasing. mortgaging or sale of
the property of any such corpormions: to nmke any surrender. exchangc or suhstitution of such
slocks. honds or other securities as an incident to the mcrger, consolidalion or reorganization of
such corporations: 10 pay all assessmenls. suhscriptions and other SlllllS of money which may he
deemed wise and cxpedient for the protection and llminlenance of the proportionate intcrest of Ihe
investment in such corporations: to exercise any option or privilegc which may he conferrcd upon
the holders of such stocks, honds, or other securities of such corporations cither for the conversion
of Ihe samc into other securities or for the purchase of additional securities, and to make any and all
neces~ary payments which nmy he required in connection therewith: and generally to have and
exercise as 10 all such stocks. honds and other securilies, the powers of an individual owner who is
under trust ohligalion.
c. To hold the trust corpus in one or more consolidated funds in which separale shares
shall have undivided interests.
d. To sell al puhlic or private sale fur cash or upon credit, or partly for cash and panly
on credit, and upon such terms and conditions as shall he deemed proper, any parlor parts of the
trust estale. and no purchaser at any sueh sale shall he hound to inquire into the expediency or
propriety of lmy such sale or to sce to the application of the purchase moneys arising therefrom.
e. To keep on hand and uninvested such money as may he deemed propcr and for such
period as may he found expedient.

thereof directed by the provisions of the trust, to make such division or distribution. either in cash or
in kind, or partly in cash and partly in kind, as shall be deemed most expedient, and in making any
division or distribution in kind may allot any specific security or property or any undivided interest
therein to anyone or more of such shares, and to that end may appraise :my or all of the property so
to be allotted and the judgment as to the propriety of such allotmenland as to the relative value for
purposes of distribution of the securities or propeny so allotted shall be final and conclusive upon all
persons interested in Ihe trust or in the division or distribution thereof.
i. Authorized to register any shares of stock or other assets of any trust in their own
names or in the name of a nominee,
j, To retain any investments or mutual funds which I may own at the time of my death
and in addition to invest any pan of the Trust corpus in such mutual fund or mutual funds as may be
deemed advisable or proper, irrespective of whether the same are authorized for the investment of
trust funds under the laws of any governing jurisdiction.
