WIT N E SSE T II: WHEREAS, Clarence E. McPherson, Sr. died on March 29, 1996 without a Will; and WHEREAS, his wife, Anna M. McPherson, was duly appointed the Administratrix of the estate by the Register of Wills of Cumberland County, Pennsylvania on June 13, 1996; and WHEREAS, all of the above named parties are the intestate heirs of the said Clarence E. McPherson, Sr., deceased; and WHEREAS, Anna M. McPherson Is the widow of Clarence E. McPherson, Sr., deceased and the remainder of the parties to this Family Agreement are the natural children of Clarence E. McPherson, Sr.; and WIIEREAS, the parties hereto desire by this Family Agreement to fully settle the rights of each of the parties In the estate of Clarence E. The above stated recitals are incorporated herein by reference and made a part of this Agreement as if each were set forth in this paragraph. 2. MHlI.. At the time of the death of Clarence E. Under the laws of the Commonwealth of Pennsylvania, if a person dies without a Will, the estate Is distributed so that the spouse receives one.half of the estate and the other one-half of the estate would be distributed in equal shares to the surviving children. Notwithstanding the fact that each of the parties to this Agreement may have a right to receive a certain portion of the estate of Clarence E. McPherson, Sr. pursuant to the intestacy laws of the Commonwealth of Pennsylvania, the assets and debts of the estate of Clarence E. McPherson, Sr. shall be divided and distributed by the Administrator of said estate as follows: A. Mitls. The parties hereto agree that the interest checking account and savings account of the decedent at PNC Bank, South central PA totaling approximately $1,425.13 shall be distributed to and shall become the sole and separate property of Anna M. McPherson. The 1984 Chevrolet Blazer and the 1984 Chevrolet Scottsdale Truck shall be distributed to and shall become the sole and separate property of Anna M. McPherson. The real property loeated at 509 Second Street, West Fairview, Cumberland County, Pennsylvania shall be distributed to Anna M. McPherson. B. Ikh1s. All of the aforesaid debts of the estate listed in paragraph 3 above shall become the responsibility to pay, in full, of Anna M. McPherson. Any debts not covered by the bank accounts distributed to her in paragraph 4.A, above shall be paid in full out of her own personal funds. 5. Disc1aimerIRemmdation. By entering this Agreement, Linda Duncan, Laura Kunkle, Clarence E. McPherson, Jr., Keith McPherson, and Doris J. Modzelewski each do hereby irrevocably disclaim and renounce any and all bequests, gifts and interest in the estate of Clarence E. McPherson, Sr., deceased, which each of us might have had under the laws of intestacy of the Commonwealth of Pennsylvania in favor of Anna M. McPherson, the surviving spouse of Clarence E. McPherson, Sr. and our stepmother. 6. Settlement. This Agreement is for the purpose of evidencing that the full family settlement of the estate of Clarence E. McPherson, Sr., is between all said parties hereto, and said parties agree to abide by this Agreement and do hereby waive all rights as heirs or otherwise in the estate of the said deceased under the statutes of the Commonwealth of Pennsylvania, or independent thereof, relating to distribution and decent in the ease of the estates of persons dying intestate in favor of Anna M. Other Documents. All of the parties to this Agreement agree that each shall, on request by the Administrator of the estate of Clarence E. McPherson, Sr., sign all documents necessary to effect the transfers agreed upon herein, Including the signing of a deed or deeds. 9. Bindinrr Erred. This Agreement shall enure to and be binding upon the respective heirs, executors, administrators and assigns of all parties hereto. McPherson, was duly appointed the Administratrix of the estate by the Register of Wills of Cumberland County, Pennsylvania on June 13, 1996; and WHEREAS, all of the above named parties are the intestate heirs of the said Clarence E. McPherson, Sr., deceased; and WHEREAS, Anna M. McPherson is the widow of Clarence E. McPherson, Sr., deceased and the remainder of the parties to this Family Agreement are the natural children of Clarence E. McPherson, Sr.; and WHEREAS, the parties hereto desire by this Family Agreement to fully settle the rights of each of the parties in the estate of Clarence E. McPherson, Sr. shall be divided and distributed by the Administrator of said estate as follows: A. ~. The parties hereto agree that the interest checking account and savings account of the decedent at PNC Bank, South central PA totaling approximately $1,425. \3 shall be distributed to and shall become the sole and separate property of Anna M. McPherson. The 1984 Chevrolet Blazer and the 1984 Chevrolet Scottsdale Truck shall be distributed to and shall become the sole and separate property of Anna M. McPherson. The real property located at 509 Second Street, West Fairview, Cumberland County, Pennsylvania shall be distributed to Anna M. McPherson. B. llihls. All of the aforesaid debts of the estate listed in paragraph 3 above shall become the responsibility to pay, in full, of Anna M. McPherson. Any debts not covered by the bank accounts distributed to her in paragraph 4.A. above shall be paid in full out of her own personal funds. 5. DisclaimerlRenrlnciation. By entering this Agreement, Linda Duncan, Laura Kunkle, Clarence E. McPherson, Jr., Keith McPherson, and Doris J. Modzelewski each do hereby irrevocably disclaim and renounce any and all bequests, gifts and interest in the estate of Clarence E. McPherson, Sr., deceased, which each of us might have had under the laws of intestacy of the Commonwealth of Pennsylvania in favor of Anna M. McPherson, the surviving spouse of Clarence E.
