Cuunty uf Hl'uomc and State of New YOI'k, being of Bound and disposing mind
and memory, do hereby make, publish and declare this as my Last Will and

Testament, hel'eby revoking all other and formcr wills and codicils by me at
any time heretofore made.
FIRST: I hereby direct the payment by my Executrix or Executor of
all my just debts and funeral expenses and all legitimate expenses incurred in
the administration of my Estate.
SECOND: I give, devise and bequeath all the rest, residue and re-
mainder of my property, of every kind and nature, real, personal and mixed,
and wheresoever situated, to my beloved Wife, MARGARET L. COLE, to be
hers, absolute and forever.
THIRD: If my said Wife shall predecease me, or if she and I shall
die either simultaneously or as the result of a common disaster or accident,
or if she and I shall die under such circumstances that it is difficult or im-
possible to determine whether she survived me, then in such event, all of the
rest, residue and remainder of my property, of every nature and description,
real, personal and mixed, I hereby direct my Executor to divide intothree
(3) equal parts or shares and one (1) of such equal parts or shares I give, de-
vise and bequeath to each of my children, CHARLES E. COLE, JR., CHER-
LYN L. COLE, and SANDRA E, COLE, share and share alike, all per stirp s
and not per capita.
FOURTH: I hereby authorize and direct my Executrix or Executor
to sell, mortgage, I ease or conveyor transfer any or all of my property, real
