CITATION WITH NOTICE
A petition has baen filed with this Court to have you daclared an Incapacitated Person, If the Court
finds you to be an Incapacitated Person, your rights will be affectad. including our right to manage money
and property and to make decisions. A copy of the petition which has been filed by
WILLIAM T. HAlIK is attachad.
You are hereby ordered to appear at a hearing to be held in Court Room No.5, Cumberland
County Courthouse, Carlisle. Pennsylvania, on OCTOBER 25 , 1996 . at 10: 30 ~.M. to
tell the Court why it should not find you to be an Incapacitated Person and appoint a Guardian to act on
your behalf.
To be an Incapacitated Person means that you are not able to receive and effectively
evaluate information and communicate decisions end that you are unable to manage your
money and/or other property, or to make necessary decisions about where you will live,
what medical care you will get. or how your money will be spent.
At the hearing. you have the right to appear. to be represented by an attorney, and
to request a jury trial. If you do not have an attorney. you have the right to request the
Court to appoint an attorney to represent you and to have the attorney's fees paid for you
if you cannot afford to pay them yourself. You also have the right to request that the Court
order that an independent evaluation be conducted as to your alleged incapacity.
If the Court decides that you ara an Incapacitated Person, the Court may appoint a
Guardian for you. based on the nature of any condition or disability and your capacity to

Petitioner's request for the appointment of permanent guardian, the following directives are
hereby ORDERED and DECREED:
1. An evidentiary hearing on the request for PERMANENT GUARDIAN

time).
2. Relative to the request for PERMANENT GUARDIAN and as provided
in 20 Pa.C.S.A. 5511(A), the Petitioner shall cause personal service upon the alleged
incapacitated person with the following at least 20 days before the evidentiary hearing:
(a) Petition for appointment of PERMANENT GUARDIAN with
attached NOTICE.
(b) Notice of the time and place of the evidentiary hearing.
(c) Citation with rule to show cause why PERMAN ENT GUARDIAN
should not be appointed for the alleged incapacitated person.

AND NOW, comes William T. Haak, by his attorney, Austin F. Grogan,

Esquire, and in support of his Petition, avers the following:

1. The alleged incapacitated person is Anne K. Haak. She was born on
August 5, 1931 and is currently 64 years of age. She is married to William T. Haak. She
resides at the Harrisburg State Hospital, Harrisburg, Pennsylvania.
2. Petitioner, William T. Haak is married to Anne T. Haak.
3. Petitioner requests Matthew Haak, Anne T. Haak's son be appointed
Guardian of the Estate.
4. The proposed guardian has no interest adverse to the alleged
incapacitated person.
5. Permanent guardianship is sought because of Anne T. Haak's poor
mental condition. Further, Anne T. Haak is unable to care for herself and her own personal
hygiene.

Sections 330 l(b) in that:
