South Street, Carlisle, Pennoylvania 17013, and io the otep-daughter of the Decedent and the daughter of Howard D. Hinnah, deceased huoband of the Decedent. 5. Petitioner, Ann Hinnah Stormo, io an adult individual reoiding at 26 Homeotead Road, Leeoport, Pennoylvania 19533, and is the step-daughter of the Decedent and the daughter of Howard D. Hinnah, deceased husband of the Decedent. 6. Howard D. Hinnah died on June 11, 1991, a reeident of South Middleton Township, Cumberland County, Pennsylvania, leaving a Will dated November IS, 1990, a copy of which is attached hereto as Exhibit "B." Except for a specific gift of farm equipment and farmland in Iowa to his children, Howard D. Hinnah'e Will left hie entire estate to the Decedent. In addition, his Will left one-half (1/2) of his residuary estate to the Oecedent'e three (3) children in the event the Decedent were to predecease him. At the time of his death, Howard D. Hinnah's gross estate was valued at approximately $1,213,170. 7. Petitioners are parties in interest in the Decedent's estate, being creditors in the amount of one-half (1/2) of the residuary estate, pursuant to a contract between the Decedent and Howard D. Hinnah whereby the Decedent promised to leave one-half (1/2) of her residuary estate to the Petitioners in the event Howard D. Hinnah predeceased her in exchange for Howard D. Hinnah's promise to leave one-half (1/2) of his residuary estate to the Decedent's three (3) children in the event the Decedent predeceased him. B. At the time of her death, the Decedent's estate was valued at approximately $335,000, exclusive of her real estate holdings in Iowa. 9. On February 13, 1997, Petitioners' counsel notified the Executrix, through her attorney, Samuel W. Milkes, Esquire, of Petitioners' claim and -2- also notified the Clerk of the Cumberland County Orphano' Court of ouch claLm. In addition, Petitionero' counsel requested the Executrix, through her attorney, to file an inventory pllrnllnnt to S 3301(c) of the Probate, Estates and Fiduciaries Code.
