OPINION AND ORDER OF COURT Oler, J, At issue in the present case is whether Christina Marie Fearnbaugh should be adjudicated an incapacitated person and, if so, whether the Petitioner, Susan J, Fearnbaugh, her mother, should be appointed plenary guardian of her person and her estate, A hearing was held on the matter on Tuesday, February 5, 1997, before the undersigned judge, Based upon the evidence presented at the hearing, the following Findings of Fact, Discussion and Order of Court are made and entered I FINDINGS OF FACT 1. The allegedly incapacitated person is Christina Marie Fearnbaugh, a domiciliary of Cumberland County, Pennsylvania, residing at 807 Shuler Street, Mechanicsburg, Cumberland County, Pennsylvania, 2, Ms, Fearnbaugh was born on March 22, 1978, and resides with her parents at the above address, 3, Petitioner is Susan J, Fearnbaugh, residing at 807 Shuler Street, Mechanicsburg, Cumberland County, Pennsylvania/ the Petitioner is the mother of the allegedly incapacitated person, 4, The allegedly incapacitated person, Christina Marie Fearnbaugh, has a condition known as spastic cerebral palsy and severe receptive and expressive aphasia, with an I,Q, estimated at 36. This condition has existed since birth. 5. As a result of the aforesaid condition, the allegedly incapacitated person is an adult whose ability to receive and evaluate info~ation effectively and communicate decisions is impaired to such a significant extent that she is totally unable to manage her financial resources and totally unable to meet essential requirements for her physical health and safety, 6, The aforesaid condition is apparently of a permanent nature. 7. Based upon the aforesaid condition, the Court finds that it is necessary to establish a plenary guardianship with respect to the estate and person of Christina Marie Fearnbaugh. 8, In view of the absence of a contrary '; I I I I i , prognosis at this time, the duration of the guardianship required must be said to be indefinite, pending further Order of Court, and apparently pe~anent. 9, The guardianship to be established herein is necessary notwithstanding the personal assistance which the " Petitioner and her husband provide to Christina Marie Fearnbaugh. 10, Petitioner, Susan J, Fearnbaugh, is found to be an individual qualified under 20 Pa, C,S, Ssction 5511(f) to serve as plenary guardian of her daughter's person and estate. 11, The foregoing Findings of Fact are made on the basis of clear and convincing evidence: DISCUSSION The provisions respecting adjudication of incompetency have recently been amended and are contained in 20 Pa. C,S. Sections 5501 et sea, Petitioner has fully complied with these provisions, and based upon the foregoing Findings of Fact the following Order will be entered: ORDER OF COURT AND NOW, this 5th day of February, 1997, upon consideration of the Petition for Appointment of Permanent Guardian, and following a hearing at which the allegedly incapacitated person was present, Christina Marie Fearnbaugh is adjudicated an incapacitated person, and her mother, Susan J, Fearnbaugh, is appointed plenary guardian of her person and her estate, The guardian is directed to file reports in accordance with the provisions of 20 Pa, C,S, Section 5521(c) , No bond shall be required of the guardian, Notice is hereby provided to Christina Marie Fearnbaugh of her right to appeal and to petition to modify or .. -, ~.. Christina Fearnbaugh 2/14/92 Page 2 ------------------------------------------------------------------------------------ ------------------------------------------------------------------------------------ Binet (4th Ed,) IQs of 39 in 1988 and 38 in 1987, and Stanford-Binet, Form L-M IQs of 49 in 1985 and 37 in 1983. ASSESSMENT RESULTS. Mrs, Shoop, Tina's classroom teacher, was interviewed to obtain information about Tina's activities in school, her present levels, and areas of strengths and weaknesses. Mrs. Shoop is attempting to have Tina speak more than one word at a time, initiate talking, and speak up when upset rather than remaining quiet with tears in her eyes, In reading, Tina is now making progress as she is learning to memorize new sight words, and now can recognize between 10 and 50 sight words. Tina is learning how to write her name. In regard to her self-help skills, Tina is fairly self sufficient with grooming skills, although she cannot tie her shoes, Tina is able to prepare a simple lunch. Regarding community skills, Tina is making progress, but needs help with such tasks as finding her own size when buying clothes, Otherwise, Tina does fairly well at grocery shopping, purchasing items, and ordering. Mrs. Shoop reports that Tina is always cooperative and never angry, but sometimes cries and lacks confidence. Expression is difficult for Tina. During the testing, Tina was indeed cooperative and a very pleasant girl to work with. Tina responded with "yes" and "no" answers but would give other one-word responses when encouraged to do so. Tina preferred to respond "yes" and would do so even when the answer was unknown or "no." She responded to the examiner's encouragement to respond "no" or "don't know" however. Tina was absorbed by the tasks, quick to respond, and somewhat anxious. She was fairly persistent on some of the more difficult items. Positive praise from the examiner seemed to reduce her anxiety somewhat. The Stanford-Binet. Fourth Edition was administered to obtain an estimate of her current level of intellectual functioning. On this administration she received a Test Composite of 36 which corresponds to the severely mentally retarded range of intellectual functioning according to the DSM-III-R classification system. Tina received a Verbal Reasoning Score of 37. an Abstract/Visual Reasoning Score of 36, a Quantitative Reasoning Score of 36, and a Short-Term Memory Score of 36, Thus, Tina shows equal ability in these four areas of functioning. An analysis of the items indicates that Tina can identify pictures of common objects, has difficulty counting objects, and can repeat sentences up to three words. Tina has visual- perceptual difficulties as she could not tell the difference between nonreversed and reversed designs on blocks. Except for foot/leg confusion, Tina can identify common body parts, and indicate what people do when they're hungry, thirsty, etc. She had difficulty copying the examiner's block configurations from her own set of blocks, however, SUMMARY AND RECOMMENDATIONS. Tina is currently enrolled in the life-skills classroom at the Northern Middle School in Dillsburg, Pennsylvania. A review of her records shows that Christina is functioning in the moderate to severe range of mental retardation with Stanford- Binet (4th Ed,) IQs of 39 in 1988 and 38 in 1987, and Stanford-Binet, Form L-M IQs of 49 in 1985 and 37 in 1983, Mrs, Shoop, Tina's classroom teacher, would like to see her speak up more when she needs assistance, Tina has progressed in the areas of self-help, community skills, and sight-word vocabulary. Intellectual testing indicates that Tina is currently functioning in the severe mentally retarded range.
