THIRD TRUST I give, bequest and bequeath the sum of Three Thousand ($3,000.00) Dollars to NANCY JANE MILLER, as Trustee, IN TRUST, to be held, administered and distributed in accordance with the following provisions: A. PAYMENT AND DISTRIBUTION OF INCOME AND PRINCIPAL Administration of Single Family Trust 1. The entire trust estate shall be administered as one trust until none of my grandchildren are living who are under the age of twenty-two (22) years. Until that time, the Trustee shall apply the net income and principal of the trust estate as follows: (a) The Trustee shall pay to or apply for the benefit of each of my then living grandchildren who are under the age of twenty-two (22) years, in monthly or in other convenient installments but in -3- ~ ~ \ ~ .~ t~ , ~, ~ \\ , (d) The Trustee shall accumulate and add to principal any net income of the trust not paid out in accordance with the discretion hereinabove conferred on the Trustee. Termination and Distribution of Trust 2. When no grandchild of mine is living who is under the age of twenty-two (22) years, the trust shall terminate and the Trustee shall immediately distribute the balance of the trust estate in equal shares to my grandchildren then living. However, if any grandchild of mine not then living leaves issues then living, an equal share of the trust estate shall be distributed to the then living issue of each such child per stirpes and not per capita. Alienation and Attachment of Beneficiary's Interest 3. No beneficiary or remainderman of this trust shall have any right to alienate, encumber, or hypothecate his or her interest in the principal or income of the trust in any manner, nor shall any interest of any beneficiary or remainder- man be subject to claims of his or her creditors or liable to attachment, execution, or other process of law. Powers 4. The Trustee, in addition to all other powers and discretions granted by this Will or by law, shall have the following powers and discretions, subject to any limitations specified elsewhere in this will: -5- Retain Assets (a) To accept in kind and retain any and all property received by the Trustee or subsequently added to the trust estate or acquired pursuant to proper authority [if bank and trust company or trust company is trustee, including shares of Trustee's own stock and stock in any corporation controlling, controlled by, or under common control with the Trustee] if and as long as the Trustee, in exercising reasonable prudence, discretion, and intelligence, considers that the ~ ~ ( ~-~ retention is in the best interests of the trust.
