STIPULATION AGAINST LIENS
IN THE COURT OF COMMON PLEAS
CUMBERLAND COUNTY, PENNSYLVANIA
WHEREAS, Charles C. Tumpaugh, of Cumberland County, Pennsylvania, is
about to execute contemporaneously herewith, a contract with Wheatland Custom Homes, Inc.
of Lancaster County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as
follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township,
Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and described
as follows, to wit:
BEGINNING at a point on the southern right-of-way line of Crofton Court at the
common front property comer of Lot No. 31 OB and Lot No. 311B as shown on the hereinafter
mentioned plan of lots; thence along said right-of-way line of Croflon Court by a curve having
a radius of 60.00 feet and an arc length of 92.61 feet to a point at the dividing line between Lot
No. 31 lB and Lot No. 312; thence along said dividing line South 49 degrees 42 minutes 00
seconds East, a distance of 80.51 feet to a point; thence South 41 degrees 02 minutes 55 seconds
West, a distance of 100.40 feet to a point at the dividing line between Lot No. D and Lot No.
31 lB; thence along said dividing line South 88 degrees 01 minutes 00 seconds West, a distance
of 86.07 feet to a point; thence North 22 degrees 23 minutes 05 seconds West, a distance of 62.50
feet to a point at the dividing line between Lot No. 310B and Lot No. 31 lB; thence along said
dividing line North 34 degrees 35 minutes 42 seconds East, a distance of 60.00 feet to a point,
said point being the Place of BEGINNING.
CONTAINING 14,306.00 square feet or 0.33 acres.
BEING Lot No. 311-B on Plan of Lots 310 and 311 - Hampden Hearth, Phase IV,
said Plan recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Plan Book 86, Page 43.
UNDER AND SUBJECT to various easements of record as indicated on said
plan.

UNDER AND SUBJECT to a snow dump area as set forth in Plan Book 86, Page
NOW, the .~ t/ day of January, 2003, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said
Charles C. Tumpaugh, to the said Wheatland Custom Homes, Inc. to commence work on the
said building, or purchase materials for the same in consideration of the making of the said
contract with Wheatland Custom Homes, Inc. and the further consideration of One Dollar, to
Wheatland Custom Homes, Inc. paid by Charles C. Tumpaugh, it is agreed that no lien shall be
filed against the building by the contractor, or any sub-contractor, nor by any of the material men
or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
