FOR MISMANAGEMENT AN)) NONDISCLOSURE OF ESTATE ASSETS
To lhe Honorable. lhe Judges of said Court:
Pursuanllo 20 Pa,C,S,a,. seclion 3182(\) and (5), pelilioner, Deanna Murray, one of
lhe heirs allaw of Dorolhy S, Pace, deceased, makes lhe following allegalions as reasons for
removal from office of Sandra E. Pace, Adminislralrix, and personal representative of the
estate of the decedent:
1. The pelitioner, Deanna Murray, is a surviving daughter of Dorothy S. Pace,
who died November 14, 1996, Dorothy S. Pace died seized of both personal and real
property,
2, Dorothy S. Pace was survived by four daughters: Carol R, Pace, Gloria J,
Kautz, Deanna Murray, and Sandra E. Pace, Sandra E, Pace assumed the role of personal
representative shortly after Dorothy S. Pace's death.
3, In January, 1997, Petitioner was asked by Sandra E, Pace, Administratrix, for
$ 200 payable into an estate account to help pay for estate expenses,
4. Petitioner obtained independent legal counsel, Craig A. Diehl, Esquire, of the
Law Offices of Craig A, Diehl. to advise her of her rights regarding the estate.
5, On February 14, 1997, Notice of Beneficial Interest in Estate was received by
Petitioner. On said Notice. Jan L. Brown, Esquire, is listed as counsel for the estate,
6, The information provided in said Notice shows that Dorothy S. Pace died
intestate, and states that there would probably be no assets to distribute to beneficiaries after
payment of estate expenses, Said notice also states that personal property would be sold at
auction,
7, Disputes have arisen between Petitioner and Sandra E. Pace, Administratrix.
as to the supposed whereabouts of a Will, as to the removal of many items of personal
property of the estate. and as \0 the disposilion of 312 shares of IBM stock which Dorothy S,
Pace had in her possession shortly before her death,

8, On fehruary 17, 1997, Petitioner's counsel sent Jan L. Brown, Esquire,
counsel for the estate, two letters requesting llllY and all information regarding the 312 shares
of IBM stock which the deceased owned, and requesting any infonnation regarding the
possible whereahouts of her Last Will and Testament (See letters allaehed hereto and
incorporated herein as Exhibit A.)
9. To date. there has heen no reply to the requests in said letters,
10, On March 3, 1997, counsel for Petitioner sent another letter to Allorney
Brown requesting infonnation regarding the transfer of the 312 shares of IBM Stock from
Dorothy S, Pace to Sandra E. Pace shortly he fore Dorothy S, Pace's death, This leller also
requested infonnation regarding the existence of a Will. (See letter attached hereto and
incorporated herein as Exhibit B,)
11. There has been no reply to the letter dated March 3. 1997,
12, Subsequent thereto, on May 7, 1997, Petitioner's counsel asked again for
documentation of the transfer of the 312 shares of IBM stock to Sandra E. Pace and asking
for documentation or infonnation regarding the existence or whereabouts of a Will.
Moreover. counsel for the petitioner notified Attorney Brown in said letter that lack of a
response within ten (101 days would force Petitioner to settle any disputes through litigation.
(See letter attached hereto and incorporated herein as Exhibit C.)
13, To date there has been no response to the letter dated May 7, 1997.
14, It is believed that Sandra E, Pace, Administratrix, has deliberately avoided
accounting for the whereabouts of the deceased's L1st Will and Testament and has converted
to her own benefit the 312 shares of IBM stock which rightfully should be an asset of the
estate,
WHEREFORE, Petitioner, requests that Sandra E. Pace, Administratrix be ordered to
appear and show cause why she should not be removed as personal representative of the
estate and that the court grant such other relief as may be deemed proper.

Dear Attorney Brown:
Previously, you were advised that I represent Deanna Murray in
reference to her mother's estate. It is our client's belief that
at the time of her mother's death there was a Will in existence.
Please advise us as to whether you have questioned Ms, Pace about
the existence of this Will.
In addition, we have learned from Ms. Murray that the 312
shares of IBM stock owned by her mother were transferred, in some
manner, into the name of Sandra E. Pace, approximately one month
prior to her death. I would also like the opportunity to examine
the documentation surrounding this stock transfer as soon as
possible. Please be advised that our client fully intends to
contest the transfer of this stock, as well as her inheritance
rights to the SQme.

Recently, John and Deanna Murray received a notice to pay 1996
school real estate taxes in the amount of $1,512.72 and county and
township taxes in the amount of $452,06 on property of the Estate
of her. mother at 33 Millers Cap Road, It is our position that the
Estate is liable [or these taxes, as they were incurred prior to
her mother's death, Please see that these obligations are paid
promptly, Payment for the school taxes should be made to Debra
Basehore Wiest, 269 Woods Drive, Mechanicsburg, PA 17055, and
payment for the county and township real estate taxes should be
made to the Cumberland County Tax Claim Bureau.
In addition, we still have not received any response to our
concerns about the existence or location of the Will of Dorothy S.
Pace, We also requested to see documentation related to the stock
transfer to Sandra Pace. If we do not receive a response within
ten (10) days of your r.eceipt of this letter, we will proceed with
litigation to resolve these issuen. It is our hope that legal
expenses for all parties will not have to be incurred.

I. Admitted with explanation; Petitioner's petition states Dorothy S. Pace died seized of
both personal property and real property, Respondent in this Answer under New Matter is
attempting as administrator to claim the real property of decedent as property of the estate.
2. Admitted in part and denied in part. Respondent did not assume the role as personal
representative, Respondent was appointed Administrator for her mother's estate.
3. Admitted with explanation, the decedent died with minimal funds. The Respondent
requested all daughters (there arc four daughters) to assist in paying for the funeral. Respondent
requested $200 from petitioner to assist in burying their mother.
4, Denied. Respondent is without knowledge ofinformation sul1icientto foml a response to
the averment and therefore the avennent is denied.

9. Denied, Counsel for the estate responded to Attorney Diehl's letter on Febru<lry 18. 1997
(one day after AUorney Diehl's leuer of February 17, 1997) a copy of February 18, 1997 letter
from Auorney Brown to Attorney Diehl is attached, marked as Exhibit C and incorpornted herein.
Auorney Brown's letter in part states:
"At this time the estate account consists only of moneys that have been
placed in that account by Dorothy's (decedent's) children, Your client's three other
sisters have put between $1,900 and $2,300 in the <lccountto assist paying the
funeral expenses and numerous other small expenses, i.e. renting a dumpster. etc.
...., Since the estate at this time has no money other than the moneys from the
children there is nothing to draw from to pay for administrative expenses. Also be
advised that there exist claims from Mastercard, Lowes and Sears ag<linstthe
estate.
Sandra ( the Respondent) has been <luempting to collect the personal
property in an elTort to sell said property and fund the estate. Once the property is
sold, it is hoped th<ltthe children c<ln be reimbursed. If there is any money
remaining, certainly your client would sh<lre in an inheritance. However, at this
time there is a $7,100 funeral expenses and a few thousand dollars in charge card
expenses that have yet to be paid."

Respondent has administered the estate properly and executed her duties as Administrator
of the estate in the following manner:
Respondent was sworn in by the Register of Wills, obtaining the proper renunciations
from the three other heirs,
Respondent made certain her mother was buried and the funeral paid for
Respondent has advertised the death through the proper publications
Respondent has notified the creditors of the death
Respondent has paid bills for her mother's estate administration
Respondent notified the beneficiary via the Notice of Beneficial Interest and properly filed
the 5,6 certification with the Court
Respondent retained an allorney to assist in the estate administralion
Respondent has allempted to ascertain decedent's property
Respondent has arranged and paid for necessary incidentals in the administration
Respondent has obtained some of the decedent's personal property, auctioned oll"the
property and included the auction proceeds in the estate account
Respondent as Administrator has sought legal advise and investigated the potential of a
medical malpractice lawsuit against the decedent's health care providers
Respondent has filed decedent's 1996 state tax returns
Respondent has sought to obtain all assets possible for the estate, properly administered
the estate to date and has not mismanaged the estate assets.

23, On November 22, 1996, less than one week aileI' Dorothy S, Pace's funeral, Petitioner
deeded her interest to her husband and herseU: a copy of the deed is attached, marked as Exhibit
G and incorporated herein.
24. On May 7, 1997, counsel for Petitioner sent to counsel for the estate a notice that
Respondent expected the estate to pay 1996 school real estate taxes in the amount of $1,512. 72
and county and township taxes in the amount 01'$452.86. (A copy of the May 7, 1997 letter is

25, Counsel for Petitioner's letter of May 7, 1997. states:

RE: Deanna Murray v. Estate of Dorothy S. Pace
Dear Attorney Brown:
Recently, John and Deanna Murray received a notice to pay 1996
school real estate taxes in the amount of $1,512.72 and county and
township taxes ,in the amount of $452.86 on property of the Estate
of her mother at 33 Millers Gap Road. It is our posi.tion that the
Estate is liable for these taxes, as they were incurred prior to
her mother's death. Please see that these obligations are paid
promptly. Payment for the school taxes should be made to Debra
Basehore Wiest, 269 Woods Drive, Mechanicsburg, PA 17055, and
payment for the county and township real estate taxes should be
made to the Cumberland County Tax Claim Bureau.
In addition, we still have not received any response'to our
concerns about the existence or location of the Will of Dorothy S.
Pace. We also requested to see documentation related to the stock
transfer to Sandra Pace. If we do not receive a response within
ten (10) days of your receipt of this letter, we will proceed with
litigation to resolve these issues. It is our hope that legal
expenses for all parties will not have to be incurred.

handwritten words were inserted at the Recorder of Deeds Office
prior to being recorded, but subsequent to the signing, when it
was discovered due to an inadvertent error by Mary E. Helster,
real estate secretary for Law Offices of Craig A. Diehl.
21. Denied. Petitioner specifically denies that her mother
had intended the home located at 33 Millers Gap Road, Enola,
Cumberland County, PA 17025 to be included in the Estate and to
be distributed to all her children. To the contrary, Petitioner
avers that Dorothy S. Pace intended her daughter, Deanna M.
Murray to have the entire home upon her death.

II. The deed signed on May 23, 1996 by Dorothy S, Pace was a deed between "Dorolhy S,
Pace and Dorothy S, Pace and Deanna M, Murray, married woman, Grantees",
12, On June 13. 1996, secretary for Craig A. Diehl altered the deed at the Recorder of Deeds
Office by adding in the handwritten words "Joint Tenants with the Right of Survivorship and
Not as Tenants in Common",
13, The words "Joint Tenants with the Right of Survivorship and Not as Tenants in Common
were added 3 weeks after the deed was executed by Dorothy S, Pace,
14, The change in quantity of the estate was not initialed by Dorothy S, Pace or acknowledged
in any manner,
15, Attorney for Defendant, Craig A. Diehl, in his Answer to Respondent's New Matter and
Counterclaim to Restore Real Property to Estate, which was filed with the Court on July 28,
1997, states "the handwritten words were inserted at the Recorder of Deeds Ofi1ce prior to
being recorded," (A copy of the Answer to Respondent's New Maller and Counterclaim to
Restore Real Property to Estate is attached as Exhibit "0" and incorporated herein),

Dear Attorney Brown:
Recently, John and Deanna Murray received a notice to pay 1996
school real estate taxes in the amount of $1,512.72 and county and
township taxes in the amount of $452.86 on property of the Estate
of her mother at 33 Millers Gap Road. It is our position that the
Estate is liable for these taxes, as they were incurred prior to
her mother's death. please see that these obligations are paid

files this ANSWER TO PLAINTIFF'S PETITION TO SET ASIDE REAL ESTATE
DEED AND RESTORE REAL PROPERTY TO ESTATE, respectfully stating in
support thereof the following:

12. Admitted, By way of further answer, it was noticed by
Mary E. HeIster while at the Recorder of Deeds that the Deed was
not properly completed due to a clerical oversight. Ms. HeIster
hand wrote in the proper legal language as she was previously
instructed by Craig A. Diehl, Esquire, on how the Grantees were
taking title.
13. Admitted. By way of clarification, the words "Joint
Tenants with the Rights of Survivorship and not as Tenants in
Common" was inserted at the Recorder of Deeds Office on June 13,
1996, by agent for the Grantor, Mary E. HeIster, Real Estate
Secretary for Law Offices of Craig A. Diehl, due to a clerical
oversight. These additional words inserted accurately depict how
the Grantees wanted to take legal title to the property.
14. Admitted in part, denied in remainder.
Respondent/Defendant admits that there are not initials next to the
words "Joint Tenants with the Rights of Survivorship and Not as
Tenants in Common". Respondent/Defendant denies that Dorothy S.
Pace did not acknowledge the transfer to herself and Deanna M.
Murray as "Joint Tenants with the Rights of Survivorship and Not as
Tenants in Common". To the contrary, agent for Grantor Dorothy S.
Pace, Mary E. HeIster, acted pursuant to instructions of Craig A.
Diehl, attorney for Grantor, who instructed Ms. HeIster pursuant to
prior instructions to him by Grantor, Dorothy S. Pace.
Specifically, Grantor, Dorothy S. Pace, instructed her counsel,
Craig A. Diehl, to transfer the property in question from herself
to Deanna M. Murray and herself as "Joint Tenants with the Rights
of Survivorship and Not as Tenants in Common".

face, the alteration changes the quantity of the Entate, the Deed
accurately sets forth the legal title an was requested by Dorothy
S. Pace during her consultation with her attorney, Craig A, Diehl,
Esquire.
17. Admitted in part. By way of explanation, Respondent/
Defendant's assertion in petition that "Dorothy S. Pace
died seized of both personal and real property" referred to Dorothy
S. Pace's interest as a Joint Tenant with Rights of Survivorship in
the property located at 33 Miller's Gap Road, Eno1a, Pennsylvania
17025.

19. Denied. Respondent/Defendant specifically denies that
Craig A. Diehl's signature on the deed document is a forgery. The
signature of Craig A. Diehl on the deed was written by Mary E.
HeIster, Real Estate Secretary for Law Offices of Craig A. Diehl,
pursuant to authority expressly provided her by Craig A. Diehl,
Esquire. By way of explanation, on May 23, 1996, Craig A. Diehl
was unavailable to execute the certification of address and
instructed Real Estate Secretary, Mary E. HeIster, to sign for him
as Agent for Grantor. Said actions have no legal effect on the
authenticity of the deed, as this signature merely certifies the
Grantee's mailing address.
20. Denied. Respondent/Defendant specifically denies that
Dorothy S. Pace had any interest more or less than that of a Joint
Tenant with Rights of Survivorship. By way of further explanation,
Dorothy S. Pace informed Craig A. Diehl, Esquire, during her
consultation that she would continue to pay the taxes subsequent to
the deed conveyance. Counsel then informed Respondent/Defendant of
this information.
21. ^dmitted, Heopondcnt/Defendant admitn that pant counoc1
for Deanna M. Murray sent the Eotatc notice through a letter dated
May 7, 1997, that the Estate ohould pay the 1996 School Heal Estate
Taxes and County and Township Taxeo, Said correopondence does not
address whether the Estate haD a claim for reimburoement after the
date of death.
22. Admitted in part. Hespondent/Defendant admits that said
May 7, 1996 letter states: "It is our position that the Estate is
liable for these taxes, as they were incurred prior to her mother's
(Dorothy S. Pace) death". By way of further explanation, the
letter goes on to say "Please see that these obligations are paid
promptly". Again, this letter does not address a right of
reimbursement from Respondent/Defendant owed to the Estate if the
Estate paid the tax for the time period Respondent/Defendant owned
the property in fee simple. It is not the duty of the
Respondent/Defendant's past counsel to tell counsel for the Estate
what rights the Estate has for reimbursement.
23. Denied. Respondent/Defendant specifically denies that
Dorothy S. Pace intended for the property located at 33 Miller's
Gap Road, Enola, Pennsylvania 17025, to be included in her Estate.
Respondent/Defendant further specifically denies that
Respondent/Defendant transferred any interest due the Estate of
Dorothy S. Pace, to herself and her husband. To the contrary,
Dorothy S. Pace unequivocab1y and clearly desired that the home
pass to her daughter, Deanna M. Murray, upon her death as set forth
in the deed.
WHEREFORE, Respondent/Defendant requests this Honorable Court
to issue a Decree and Order that:

I'ennsylvania Inheritance Tax and is not subject to the payment of Pennsylvunia Estate Tax.
6. AlIlhe parties in interest arc living with the exception of Deanna M. Murray, who
died on January 5, 2005.
