Section 5512.1(b), it is found that Mr. Griest is partially incapacitated and in need of temporary partial guardianship services of his person. 9. Pamela Brown, an adult individual residing at 1990 Walnut Bottom Road, Carlisle, Cumberland County, Pennsylvania, who is familiar with the "2176 waiver" and other needs of Mr. Griest, is a person qualified under 20 Pa. C.S. Section 5511(f) to serve as guardian of his person. 10. It appears that Mr. Griest's condition is of an indefinite nature in terms of duration. 11. The foregoing Findings of Fact are made on the basis of clear and convincing evidence. DISCUSSION The provisions respecting adjudication of incompetency have recently been amended and are contained in 20 Pa. C.S. Sections 5501 et sea. petitioner has substantially complied with these provisions, andr based upon the foregoing Findings of Fact, the following Order will be entered: ORDER OF COURT AND NOWr this 26th day of Decemberr 1996, upon consideration of the petition for Appointment of a Temporary Guardian of the Person Pursuant to 20 Pa. C.S.A. 5513, and following a hearing held at the Cumberland County Courthouse at which the allegedly incapacitated person was present, Amos Griest is adjudicated an incapacitated person, and Pamela Brown, ~ an adult individual residing at 1990 Walnut Bottom Road, Carlisler Cumberland County, Pennsylvania, is appointed temporary partial guardian of his person for the purpose of executing a "2176 waiver" and any other necessary documents to effect Mr. Griest's continued participation in the facility known as the Mt. There are no other known presumptive adult heirs to Amos Griest's estate to agree with this petition to determine Amos Griest's incapacitation. 7. Guardianship of the person is being sought because Amos Griest's mental retardation, coupled with the onset of numerous physical ailments, impairs his eapacity to make decisions. This petition is instituted to aid and benefit Amos Griest. Pamela A. Shenk has known Amos Griest since 1990. The nature of Pamela A. Shenk's relationship with Amos is that ofa close personal friend, as well as long-term acquaintance through C-PARC. Dawn M. Rudinski has known Amos Griest since 1989. The nature of Dawn Rudinksi's relationship with Amos is that ofa close personal friend, as well as long term acquaintance through ARC. 8. Neither Petitioner is seeking guardianship of the estate because C-PARC is better equipped to handle those matters than Pamela A. Shenk or Dawn M. Rudinski. 9. Amos Griest is incapacitated as defined in Chapter 55 of the Probate Estates and Fiduciaries Code. He is an adult whose ability to receive and evaluate information effectively and communieate deeisions is impaired to such a significant extent that he is totally unable to meet essential requirements for his physical health and safety. 10. In a psychiatric evaluation (attached as Exhibit A) pcrformed by Jayanthi Perisasamy, \ M.D., of Hershey Medical Center ofthc I'ennsylv;mia State University, datcd March 7, 2001, Amos Griest's range of functioning was detennincd to be "scvcrely mcntally retarded". He is dependent upon others for self-management. He has limited indepcndent pcrsonal care skills. II. Amos has been diagnosed with BiPolar Disorder NOS, Depression, Severe Mental Retardation, Chronic Obstructive Pulmonary Disordcr, and Bilateral Hearing loss. Amos Griest also suffers from: arthritis, lefi olecranon bursitis, and Tardive Dyksenesia. Amos Griest has also been hospitalizcd for: lefi inguinal hernia repair, pneumonia, increased agitation, right middle cerebral stroke, dehydration, kidney infection, and prostate surgery. 12. Efforts havc been madc to allow Amos to retain as much autonomy as possiblc. However, he continues to bc dcpendent upon others to assist him in his personal care. This carc is currently being provided by thc community residential facility, where Amos rcsidcs. 13. Pamela A. Shenk is qualified to be Amos Griest's guardian because shc is interested in his wclfare and has no interest advcrse to his. In addition. Pamcla A. Shcnk has Bachclor of Arts dcgrcc in Social Wclfare and ovcr 26 years of expericncc caring for mentally rctarded individuals with disabilitics such as Amos Griest's. Dawn M. Rudinski is qualified to bc Amos Griest's guardian beeausc she is intercsted in his wclfarc and has no intercst advcrsc to his. Dawn M. Rudinski holds a Mastcr's degrec in Human Services and has over 22 years cxpericnec caring for mentally rctarded individuals with disabilities such as Amos Griest's. 14. Amos Griest has no current guardian already appointcd. 15. Pamela A. Shenk hercby gives her written consent to becomc thc Icgal guardian of Amos Gricst for thc duration of Pam cia A.
