CIVIL ACTION MORTGAGE FORECLOSURE
1. LaSalle Bank, N.A. f/k/a LaSalle National Bank, as trustee under the Pooling and
Servicing Agreement dated 2/1/1999, Series 1999-1, (hereinafter referred to as
"Plaintiff') is an Institution, conducting business under the Laws of the
Commonwealth of Pennsylvania and brings this action to foreclosure the
mortgage between Beth A. Wogan and David A. Wogan, Mortgagor(s)
(hereinafter referred to as "Defendant") and itself as Mortgagee by Assignment.
Said Mortgage was dated January 27, 1999 and was recorded in the Office of the
Recorder of Deeds and Mortgages in Cumberland County in Mortgage Book
1520, page 173. A copy of the Mortgage is attached and made a part hereof as
Exhibit 'A'.
2. The Mortgage is secured by Defendant(s) Note dated January 27, 1999 in the
amount of $31 ,500.00 payable to Plaintiff in monthly installments with an interest
rate of 8.875%.
3. The land subject to the mortgage is:
96 Cold Spring Road, Carlisle, PA 17013.
4. The Defendants, Beth A. Wogan and David A. Wogan are the real owners
of the land subject to the mortgage and the Defendants' address is:
96 Cold Spring Road, Carlisle, PA 17013.
5. The Mortgage is now in default due to the failure of the Defendant(s) to make
payments as they become due and owing. The following amounts are due:
Principal Balance $30,709.04
Interestto 12/15/2002 941. 66
Accumulated Late Charges 61.36
Escrow Advance 1,006.49
Other Fees 28.90
NSF Charges 10.00
Recoverable Balance 564.39
Attorney Fees/Costs 3,700.00
TOTAL $37,021.84
plus interest from 12/15/2002 at $6.94 per day, costs of suit and attorney fees.
6. In accordance with the provisions of the Act of January 30, 1974, P.L. 13 No.
6, Section 403 (41 P.S. 403), a Notice oflntention to Foreclose is required and
the Notice of Homeowners' Emergency Mortgage Assistance was sent to
defendants December 30, 2002. The Defendant(s) have not cured the default.
WHEREFORE, Plaintiff requests the court enter judgment in Mortgage Foreclosure for
the sale of the mortgaged property in Plaintiffs favor and against the Defendant(s), in the
sum of$37,021.84 together with the interest from 12/15/2002 at $6.94 per day, costs of
suit and attorney fees.

CONSUMER CREDIT COUNSELING AGENCIES -If yoU meet with one of the consumer credit

MOTION FOR REASSESSMENT OF DAMAGES
Plaintiff, by and through its attorney, Gregory Javardian, moves this Honorable Court to
enter an Order for Reassessment of Damages, and in support thereof, avers as follows:
L On February 19, 2003, Plaintiff instituted this action in Mortgage Foreclosure
because Defendants Beth A. Wogan and David A. Wogan defaulted on a Mortgage
given to secure the indebtedness of a Note. A true and correct copy of the Complaint
is attached hereto, made part hereof, and marked as Exhibit "A".
2. Defendant David A. Wogan was served with Plaintiffs complaint on February 26,
2003, while Defendant Beth A. Wogan was served on April 17, 2003. The Notices
of Intention to Enter Default Judgment (10-day notices) were sent on May 13, 2003,
3. On May 30, 2003, default judgment was entered in Plaintiffs favor and against
Defendants. The damages were assessed against Defendants in the amount of
$38,153.06, A true and correct copy of the Praecipe for Default Judgment is
attached hereto, made part hereof, and marked as Exhibit "B".

4, The Writ of Execution was thereafter issued on June 10, 2003 and the mortgaged
property was scheduled for the September 3,2003 Sheriff's sale.
5. The September 3, 2003 Sheriffs sale was stayed as Defendant David A. Wogan
filed a Chapter 13 bankruptcy with the United States Bankruptcy Court for the
Middle District of Pennsylvania on June 25, 2003 at docket number 03-03787-mdf.
6. The bankruptcy at docket number 03-03787-mdfwas dismissed via Court Order on
January 5,2005.
7. The Writ of Execution was reissued on March 1,2005 and the mortgaged property
was scheduled for the June 8, 2005 Sheriffs sale.
8, The June 8, 2005 sale was postponed to September 7, 2005 because Plaintiff was
unable to effectuate service of the Notice of Sheriffs sale upon Defendant Beth A.
Wogan.
9. The June 8, 2005 sale, which was subsequently postponed to September 7, 2005,
was ultimately stayed as Defendant David A. Wogan filed another Chapter 13
bankruptcy with the United States Bankruptcy Court for the Middle District of
Pennsylvania on June 7, 2005 at docket number 05-03790.
10. The bankruptcy at docket number 05-03790 was dismissed via Court Order on
February 16, 2006.
11. The Writ of Execution was reissued on or about February 28, 2006 and the
mortgaged property is currently scheduled for the June 7, 2006 Sheriffs sale.
12. Plaintiff seeks a Motion to Reassess Damages in order have the judgment reflect the
funds it has been forced to advance in order to protect its collateral, including taxes,
insurance, inspections and legal fees and costs.

13, Additionally, interest has continued to accrue since the entry of the judgment due to
the bankruptcies filed by Defendant David A. Wogan.
14. The Mortgage, which is incorporated herein as part of Exhibit "A" expressly
provides that Plaintiff is entitled to collect for sums advanced for property insurance,
delinquent taxes and legal fees and costs.
15. Plaintiff may sustain a substantial loss unless damages are reassessed in order to
account for the sums advanced to protect the collateral, additional interest and legal
fees and costs.
