ORDER OF COURT
AND NOW, this 16th day of DECEMBER, 1996, based on the
attached petition, the Court enters the following:
1. prudential Insurance Company shall pay the proceeds of
the policy to William David Kibler and Denise Allison Kibler,
parents of Matthew William Kibler a minor, born February 24,
1994. The parents are authorized to execute any release required
by Prudential to receive the proceeds.
2. The parents shall deposit said amount received in the
name of the minor son in a bank, building and loan association or
saving and loan association insured by a Federal Governmental
Agency, with the provision that no withdrawal can be made from
any such account until Matthew William Kibler attains his
majority, except as authorized by a prior order of this Court.
3. Counsel for petitioners shall within ten (10) days from
the receipt of the money from Prudential, furnish a copy of the
account as opened to the Court.
4. This sequestered deposit is provided for by the Act of
June 30, 1972, P.L. SOB, as amended, 20 P.S. 5103.

AND NOW COME, Denise Allison Kibler and William David Kibler,
natural parents of the above referenced child, by and through their
Attorney, Daniel J. Sodus, Esquire, and petition the Court to
declare each of them guardian of the estate and of the person of
their natural child.
In support thereof, each petitioner
respectfully represents the following:
1. The child is Mathew William Kibler (hereinafter referred
to as child)

2. The natural parents of the above child are:
a. Denise Allison Kibler (hereinafter referred to as
mother)

place of Birth - Rahway, New Jersey

officer(accounting clerk)
Earning - approximately $6000.00 annually
Religion - Roman Catholic

Occupation - Business Analyst (Computers)
Earning - approximately $37,500.00 annually

3. The child, mother, and father each reside at 6255
Billingsgate Court, Mechanicsburq, CUlllberland County, Pennsylvania

November 1, 1995.
4. '1'0 the best o[ the lIIother's and [ather's knowledge, there
is no action pending in this court or in any other court in this
state or any other state concerning the child,
5. prudential Tnsurilnce COmpilny o[ America has informed
Mother and Father that child Is the beneficiary of Six Thousand
Dollars ($6,000.00) of lire insurance proceeds from a life
insurance policy purchased by childs maternal grandfather, Federic
puorro, deceased.
6. purdential Insurance Company of America has informed
Mother and Father that it will not pay the sum of money referred to
in paragraph 5 to Mother or Father in behalf of child unless and
until it receives an Order of the Court of Common Pleas of
Cumberland County, pennsylvania which formally declares them to be
guardians of the estate of the child. In the alternative,
prudential Insurance Company of America has articulated its
intention to retain the sum o[ money in its own account and to pay
no interest or nominal interest on this sum until the child reaches
the age of majority.
7. Mother and Father have at all times provided for the
financial, physical, emotional, and spi ri tual wel fare of the child.
8. No other persons have exercised primary responsibli ty for
the financial, physical, emotional, and spiritual welfare of the
child.
