DESCENDANTS - The term "09$cendanh" as usedl n till s Will means the i mmedl ate

PER STIRPES - The term "Per Stirpes" as used In this WIll means that whenever
distrlbutTon is to be made per stirpes, the estate or portion of the elitate, to
be so dilitrlbuted, shall be diVided Into as many shares as there are sLlrvivlng
heirs in thf! nearest degree of kinship to the decedent and deceased persons in
the lIame degree of "Inahlp who left ISIBue who SLlrvlVe the decedent. This
degr'ee of kinship shall be termed the root gem;,ration. Each surviving heir In
the root generation shall take one full share. Those remaining heirs, i.e. the
sclrvlving iSf,lue of the d!lc:eased persons in tl18 reot generation, shall h'~e the
share of their deceased ancestor in the root generation, such share being
divided in the following manner: each surviving issue shall take the
fractional share that his or her immediate ancestor would have tal(en had he or

PER CAPITA - The term "Per Capita" as used in this Will means that whenever
distribution is to be made per capita, the estate or portion of the estate, to
be so distributed, shall be divided into as many equal shares as there are
surviving issue, standing in the same degree of kinship to the decedent.
Distribution shall be made without reference to right of representation of the

ISSUE - The term "Issue" as used in this Will means all persons WllO are

adoption by that person or any of that descendant's legitimately born or
legally adopted descendants.

or other person, not named as a beneficiary, under this my Last Will and
Testament, whether claiming to be an heir of mine or not, unless otherwise
provid~d for in this my Last Will and Testament.

a. to my nephew, PETER ZIRILLI, of Harrisburg, Pennsylvania, my brick
ranch type house lotated at BOI C~rol Circle, New Cumberland, Pennsylvania, and
the lawn and gardening equipment contained therein. I also give to PETER
ZIRILLI ilny automDbile owned by me at my death. If PIOTER ZIRILL.I does not

ZirilH Gurtil.cn, deceascd (herein rcferrcd to as Executor), and Susan Hawke (niece), Frances
Zirilli (sister-in-Iuw), Murie Zirilli (niecc), Pctcr Zirilli (ncphcw), and Pctcr S. Zirilli (brothcr), us
specific and/or rcsiduary bcnctkiarics of thc said ~'statc (hcrcin colleetivcly rcferrcd to as thc
Bcneficiarics).
In aceordanec with thcir dcsire that the administration of the Estate of Jennic Zirilli
(lurtizcn bc tcrminatcd without thc cxpcnsc and further dclay of a court accounting, the parties
hereto, in consideration of thc mutual covcnants hcrein cxprcsscd, and intending to be Icgally
bound hereby, agree that:
1. The Estate of Jennie Zirilli Ourtizcn, who died January 14, 1997, is now in thc
process of administration, Lctters Testamcntary having been duly gl'llntcd to Petcr S. Zirilli by
the Register of Wills of Cumberland County, Pennsylvania on January 24, 1997.
2. Under the provisions of thc Decedent's Will, dated Novcmber 5, 1990, the
Decedent bequeathed hcr personal residence known as 80 I Carol Circle, New Cumberland,
Pennsylvania, any lawn and gardening equipmcnt locatcd therein, and any nutomobile owned by
her at the time of her death, to Peter Zirilli.
3. Under the provisions of the Decedent's Will, dated November 5, 1990, the
Decedent bequeathed her mothcr's gold watch and chain to Susan Hawke.
4. Under the provisions of the Deccdent's Will, dated November 5, 1990, the
Dccedent bequeathcd hcr thirty (30 ) inch gold chain with a $10 gold piecc attached to Francis
Zirilli.
5. Under thc provIsIOns of the Decedcnt's Will, dated November 5, 1990, the
Deecdcnt bequeathed her eighteen (18 ) inch gold chain with a $2,50 gold piece attached to
Marie Zirilli.
6. Under the proVIsions of thc Dccedcnt's Will, dated November 5, 1990, the
Decedent bequeathed her grandfather clock, mantel clock, and any moneys in her checking and
savings accounts remaining after payment of all estate debts to Peter S. Zirilli.
7. Under the provisions of the Decedent's Will, dated November 5, 1990, the
Decedent bequeathed her residuary estate to be divided at the sole discretion of the Executor,
Peter S. Zirilli.
8. Each of the bencficiaries by their signature hereto, acknowledge that they have
