Dyarman, of North Newton Township, Cumberland County, Pennsylvania, being of sound and disposing mind, memory and understanding, do hereby declare this to be my will, hereby revoking any and all former wills and codicils thereto by me heretotore made. rIRST I direct that all my just debts and funeral expenses, including all expenses of my last illness, shall be paid from my estate as soon as practicable after my decease as a part of the expense of the administration of my estate. SECOND I have previously conveyed a lot of ground with a house erected thereon situate along Pennsylvania Highway LR 21063 situate in North Newton Township, Cumberland County, Pennsylvania, being designated Lot 1 on a certain subdivision plan of Bruce D. Dyarman, prepared by Wilbur H. Clifton, R.S., dated December 28, 1983, and recorded J.n the Office 0,1: the Recorder of Deeds of Cumberland County, pennsylvania, to my daughter, Fredith E. Dyarman. Dyarm/ln's, snare to be received from the remainder of my estate, and in the event the sams is not adequate, my said daughter, Fredith E. THIRD I have previously conveyed a certain lot of ground with a house and other improvements erected thereon situate along Pennsylvania Highways LR 21063 and LE 21007, situate in North Newton Township, Cumberland County, Pennsyl.vania, being designated Lot 3 on II certain subdivision pl.an of Bruce D. Oyarman, prepared by Wilbur H. Clifton, R.S., dated December 28, 1983, and being recorded in the OHi:::e of the Recorder of Deeds of CUmbp.r1and County, PennsYlvania, to my daughter, Shirley L. Lynch, absolutely. r hereby establish a va1uQ for the gift of said real estate in the amount of $J.8,OOO.00 and direct that the same be deducted from my said daughter's, Shirley L,. L,ynch's, share to be received from the remainder of my estate, and in the event her share is not adequate, my said daughter, Shirley Lea Lynch, shall pay any additional amounts required to make up the sum of $18,000.00 to my estate. f I FOURTH I give, devise al1d bequeath the residue of Iny estate of every nature and wherever situate to my children, Paulo. The share of any child who predeceases me or dies on or before the thirtieth day following my death, except as herein provided, shall be distributed to said beneficiary's issue, per stirpes, U.ving on the thirty-first day following my death, and in default of any such then-"living issue, such share shall be added to the share or shares of my other children. lI'IrTH I hereby direct that in the event that a debt evidenced by a certain promissory note owing from my daughter, Alice M. Crider, and her husband, John A. Crider, to me has not been fully paid in my lifetime and in such event the principal and any accrued interest owing under the said promissory note shall be deducted from my daughter, Alice M. Crider's, share of my estate to receive from the remainder of my estate and in the event the same is not adequate to pay the aforesaid promi.ssory note in full, my daughter, Alice M. Crider, shall pay any additional amounts required to pay the said promissory note in full. Said guardian shall in the guardian's sole disoretion and without order of oourt, use prinoipal as well as inoome from time to time as may appear to be necessary for the minor's welfare, oomfort, medical care, reoreation, support and education, without responsibility to the minor or to any per.son taking care of the minor I and the remaining balanoe in the hands of said guardian shall be distributed to said minor when the minor attains the age of eighteen years. If such minor di~s prior to attaining the age of eighteen years, said guardian is authorized in the guardian's discretion to pay part or all of the minor's funeral expenses and the remaining balance in the hands of said guardian shall be distributed to the minor's personal representative. In the event the funds held by the guardian for any minor become in the opinion of the guardian too small for proper and efficient administration, the guardian, in the guardian's sole discretion, may deposit such funds in a savings account in the name of the minor. SBVBNTH Any fiduciary under this will shall have the following powers in addition to those vest~d in them by law and by other provisions of my will applicable to all property whether principal or inoome, including property held for minors, exeroisable without Court approval, and effective until actual distribution of all property: A. To retain any and all of the assets of my estate, real or personal, without regard to any principle of Page 4 diversifioation of risk. B. To invest in all fot1lll of property inoluding stook, oommon trust funds and mortgage investment funds without restriotion to investments authorized for pennsylvania fiduoiaries as they deem proper, without regard to any prinoiple of diversifioation of risk. C. To sell at publio or private sale, to exohangE! or to lease for any period of time any real or personal property and to give options for sales, exohanges or leases, for such pr ioes and upon such tet1lls or oondi t:l.ons as they deem proper. D. To allooate receipts and expenses to principal or income or partly to each as they from time to time think proper. E. To compromise any claim or controversy. F. To distribute in cash or in kind or partly in each. G. To hold property in their names without designation of any fiduciary capacity or in the name of.a nominee or unregistered.
