I, Helen L. Freese, of the Borough of Lemoyne, Cumberland
County, Pennsylvania, being of ~ound mind, memory and
understanding, do make, publish and declare the following to be my
Last Will and Testament, hereby revoking and making void, any and
all wills, codicils and testamentary dispositions be me at any
time heretofore made.
ITEM I. I direct that all my just debts and funeral
expenses be paid and satisfied by my Exeoutors hereinafter named
as soon as conveniently may be after my decease.
ITEM II. All the rest, residue and remainder of my estate,
real, personal and mixed I give, devise and bequeath as follows:
A. I give and bequeath the sum of Fifty Thousand Pollar.
($50,000.00) to RAYMONP E. and SANPRA L. SNYDER, JR., of 27 Creek
Road, Camp Hill, Pennsylvania 17011.

98 taxes of $1,687,79 as claimed; and the reduction of the appraised value of the real
property from $169,900,00 to $160,000.00, In summary, Petitioner requests the
reduction of Schedule A to $160,000,00, the reflection of Schedule H claims totaling
$33,730,73, and the refund of the resulting overpayment of $1 ,474,11, Since the
Department's "Administrative Correction" of January 23, 1998, does not "correct" what It
purports to, it is stricken In Its entirety, The Board's disposition of all requested
adjustments follows,
Since the decedent's real property was sold within a year of her death, the Board
finds that the sale price, $160,000,00, is the best Indication of fall' market value at the
time of death. Therefore, Schedule A shall be reduced to $160,000,00 as requested.
Further, the Board finds that the sales expenses totaling $13,195,00 are allowable as
claimed. Additional attorney fees of $3,150.00 (which will bring the approved total to
$8,775,00) are also in order. However, 1997-98 real estate taxes of $1,687.79 for the
year after the decedent's death are not allowable, as Section 9128(1) of the Inheritance
and Estate Tax Act of 1991 specifically states that "taxes for which decedent Is not
personally liable shall not be deductible", It has been held that real estate taxes
following the year of death are items which inure to the benefit of the heirs and are not
payable out of the general estate,
