8. The October 24, 1997 cover letter Bent by Executor Guido
was interpreted by the undersigned Thomas W. Scott to mean that
written objections to the First. and Final Account would be timely
if filed anytime November 25, 1997. It was not understood to
require filing of the Objections prior to the presentment of the
Estate for audit. Accordingly the written objections were prepared
and taken to the courthouse prior to the close of busineSs on
November 25, 1997,
9. Prior to attempting to file the Objections, the
undersigned was in telephone communication with both Edward, Guido,
Exec.:utor and Attorney for the Estate, and Diane Radcliff, Attorney
for the other principal beneficiary of the Estate, Guy D. Fry, to
advise them of the fact of representation and the general nature of
the Objections that would be filed,
10, The undersigned reasonably believed that the Objections
would be timely if filed at any time on November 25, 1997 and was
surprised to learn that they could not be accepted for filing,

died on February 2, 1997 and that Charles W. Fry, the
Petitioner and Objector is one of the two children of the
Decedent and along with his brother, is a principal
beneficiary ~f her estate,
2. Admitted. It is admitted that on October 24, 1997, Edward E.
Guido, Executor for the Estate of Helen K. Fry sent a copy of
the First and Final Account of the Estate of Helen K. Fry to
Char.les W. Fry.
3. Admitted. It is admitted that the First and Final Account was
accompanied by Attorney Guido's cover letter which was
attached as Appendix A to t.he Objector's PetitJ.on which stated

also stated, that it would not be necessary for thE! Objector to
be present at the audit or represented by an attorney unless
he had S(lme objection to the account and that if he wished to
file written objections, the Court rules require that they
must be filed by November 25, 1997.

belief, established the truth or falsity of the averment set
forth in Paragraph 5 of the Petition and said averments are
therefore denied. Guy D. Fry demands thereof at the hearing

reflect the intentions of his mother, Helen K. Fry, the

6.10-1. requires that. Objections to an Account or to the
statement of Proposed Distribution must be file in writing no
later than 9:00 a.m., prevailing time, of the date fixed for
confirmation unless otherwise permitted by the Court prior to
confirmation.

State of Pennsylvania and in so practicing, was or should have
been familiar with the Cumberland County Penni3ylvania Local
Rules of Court and was or should have been aware that the
Objections to the Account were required and mandated to be
filed prior to the date and time of audit held on this First
and Final Account on November 25, 1997 at 9: 00 a,m.
11. Denied. The filing of objections to an account after formal
presentment for audit in violation of the Cumberland County
Pennsylvania Local Rules of Court is not a de minimis error
which can be overlooked by this court and regardless of the
presence of prejudice or undue delay in the overall
administration of the Estate, such late filing may not be
permitted by this Court in violation of the Rules of the
Orphan's Court, Rule 2,1 and the Cumberland County Local Rules
of Court. In Re ,"rick's Estate,. 17 Pa. D.&C.3d 622, 1
Fiduc.Rep.2d 129 (1981).

Esquire, attorney for Guy D. Fry, moves this Honorable Court to
schedule a hearing on the petition for Leave to File Objections to
the First and Final Account of Edward E. Guido, Executor of the
Estate of Helen K. Fry filed by the Objector, Charles W, Fry and
assigns the following reasons therefor:
1. On or about November 25, 1997 at 9:30 a.m. the First and Final
Account of the Estate of Helen K, Fry was presented to the
Court for audit and there being no objections timely filed,
said account was approved and confirmed by the Court.
2. On or about November 25, 1997 at 4:15 p.m. following
presentment of the First and Final Account and approval
thereof by the Court, the Obj ector, Charles W. Fry, by and
through his attorney, Thomas W. Scott, Esquire, attempted to
file objections to the First and Final Account of Edward E.
Guido, Executor of the Estate of Helen K. Fry after
presentment of the accounting to the Court, which filing was
denied by the Register of will due to the fact that the
accounting had already been confirmed by the Court at the
audit held earlier that day.
3. On or about November 26,1997 the Objector, by and through his
attorney, Thomas W. Scott, Esquire, filed a petition for Leave
to File Obj ections to the First and Final Account of Edward E,
