I, MARY ELIZABETH SHIRLEY, of Carlisle, Cumberland County,
Pennsylvania, declare this to be my last will and revoke any will
previously made by me.
ITEM ONE: I direot that all my debts and funeral expenses,
including my gravemarkeJ:. shall be paid from my residuary estate as
soon as practioable after my decease as a part of the expenae of
the administration of my estate.
ITEM TWO: I give, devise and bequeath my entire estate to my
husband, DONALD I,ES'l'ER SHIRI,EY, SR., if he survives me by 60 days.
In the event that he predeceases me or is not then living on the
6lst day after my death, then I give, devitle and bequeath my entire
estate as follows:
A. I direot that my real property located at 122 West South
Street, Carlisle, Cumberland County, Pennsylvania, be sold and the
net proceeds therefrom be divi.ded equally, ahar.e and share alike,
per capita, between B.I\.RBARA A. TOLLEY, MILDRED L. GARNER, DONNA M.
RICKRODE, DONALD L. SHIRLEY, JR., and SUE A. CLINE.
B. I give, devise and bequeath the three drawer dresser to TRACY
GRIFFITH.
C. I give, devise and bequeath the pedal sewing machine to SUE A.
CLINE.
D. I give, devise and bequeath the boat and trailer to THURSTON
CLINE.
E. To DONNA M. RICKRODE, I give, devise and bequeath the
remaindl0r of my household contents which the said DONNA M. RICKRODE
wishes to receive. Any remaining household contents which the said
DONNA M. RICKRODE does no.t wish to receive, I give, devise and
bequeath to DONALD L. SHIRLEY, JR.
F. I give, devise and bequeath the remainder of my ef.ltate to be
divided eqnally, share and share alike, per capita, between BARBARA
A. TOLLEY, MILDRED L. GARNER, DONNA M. RICKHODE, DONALD L. SHIRLEY,
JR., and SUE A. CLINE.
ITEM THREE: I appoint my husband, DONALD LESTER SHIRLEY, SR.,
Executor of this my last will. Should he fail to qualify or cease
to act as Execntor, I tippoint DONNA M. RICKRODE to act as Executrix
with the same rights, powers and duties.
ITEM FOUR: All estate, inheritance, succession and other taxes,
imposed or payable by .reason of my death, and interest and
penalties t.hereon, with respect to all property comprising my gross
estate for tax purposes, whether or not such property passes under
this will, shall be paid out of the principal of my relliduary
estate, without apportionment or ri.ght of reimbursement.
ITEM FIVE: I direct. that my person representative or guardian
shall not be required to give bond for the faithful performance of
t.heir duties in any jurisdi.ction.
ITEM SIX: In addition to the rights and powers given to the
fiduciaries by law or elsewhere in this will., I give to my ExecutoJ:'
during the full time necessary and for the administration of my
estate the following rights and powers to be exercised in his Bole
discretion.
