The third page ollored for probate consisted of a page of stationery with butterfly and
flowers printed across the lower half of the page. with an Inatructlon addressed to, "Betty
Wlsotzkey", which raad, "if anything happens to me please take this to Robert Bleck, the
lawyer. who lives on Conway Street - South Hanover Street - office. Please sign it to verify
my signsture". The decedent's apparent signature followed the above-dllscribed text.
We are of the opinion that the pages designated page 1 and pege 2, written on
notebook-tyPII paper, mey be admitted for probate as the Will of Mary L. Hoy.
The signlllture which appellrs at the top of page 2 of the Writing can be construed as
the signature at the end of all of the language which appears on page 1. Although the
language on page 1 does not contain all of the Informotion necessery to dispose of the
decedent's estate, the lengusga on pege 1 does indicate that all of the information necessary
to dispose of decedent's estate is in existence, In psragraph B, the decedent indicates there
are certain itams which will be mentioned "below". Likewise in paragraph C, the instructions
regarding the disposition of the final one-third of her financial assets indicated that the final
one-third would go to 'the following people end organizations." The aforementioned language
In paragraph A and B suggests that the information to which decedent made referencs could
be found at some other location, which was "below", or which followed page 1. The
additional information to which the decedent had alluded at paragraph 8, was in fact listed
at the tope of page 2, immediately below the decedent's signaturs. The information to which
the decedent alluded ot the end of paragraph C. wall in fect containod in the bottom half of
page 2.
As you are no doubt aware, Section 2502 of the Pennsylvania Probate Estate and
Fiduciaries Cede requires that the Will be signed by the tastator "at the end thereof".
However, there is e considerable body of Pennsylvania case law which holds that "the end
thereof" means the logicel end of the language used by the testator or testatrix, rathsr than
the spatial end. The decadent. by the time she had completed the text at the bottom of page
1 of the Writing, hed, together with the additional information on page 2, to which reference
had been made on page 1, made a full and complete disposition of her assets. The signature
which appears at the top of page 2 may reasonably considered to be at the logical end of the
Writing. There is e 1985 decision by the Orphens' Court of Forest County, Wagner Ea1a.W,
36 D. & C. 3rd, 18311985), upon a set of facts similar to those doscribed above. which held
that additional dispositive language which appeared on e half p'3ge following the decedent's
signature was neverthaless logicelly connected to the portions of the Writing which preceded
the testatrix's slgneture, and therefore, were included in the decedent's Will as admitted to
probate.
Page three of tho Writing was written on paper different from page one and page two,
with what appears to be felt or nylon tipped pen, and was limited to a single instruction as
to what should be done with tho Writing. Becouse thare is no indication that it was written
contemporansously with page one and page two, and there Is no reference which connects
