6, The Administratrix contends that with two separate policies with stacking with
two separate premiums that the total underlnsured benefits are $30,000 per polley or a
combined total of $60,000,
7, State Farm Insurance Company has agreed to a partial release under the
aforesaid policies. The Administratrix has agreed to accept the $30,000 tendered by State
Farm Insurance Company and reserves the right to pursue a claim against State Farm
Insurance Company for the remaining $30,000 which the Administratrix claims the estate
is entitled to under the policies,
8, The Administratrix will be pursuing a claim against Dennis J. Wonder and
Wonder Brother's Garage who passed the vehicle driven by Ms, Chapman for Inspection
even though the brakes were not in proper condition to pass Inspection,
9, The Contingent Fee Agreement between the Administratrix and the undersigned
counsel provides for a contingent fee of one-third of any funds recovered prior to suit
Initiation,
WHEREFORE, the Administratrix prays that Your Honorable Court will authorize
her to accept the tender of $30,000 which State Farm Insurance Company claims Is the
underinsurance polley limit so long as It does not preJudice any right to make a claim
against the aforesaid. underlnsured coverage on the polley of her husband and herself for
