ERNEST K, PACE and REBA D, PACE, his wife, of Perry County,
Pennsylvania, hereinafter called the "Mortgagors" and LOIS C. DeHART,
Perry County, Pennsylvania, hereinafter called the "Mortgag~e",

The Mortgagee has made a loan to the Mortgagors, that loan
represented by a Mortgage Note of even date herewith, in the
principal amount set forth above, and this mortgage indenture is
executed in oonsideration of that loan *nd to furnish collateral to
the Mortgagee for that loan.
Further to provide the collateral for the aforesaid loan and for
all other sums as may be due LOIS C. DeHART under the terms of the
mortgage note and the terms of this Mortg~ge Indenture, the
Mortgagors do hereby grant and convey to the Mortgagee:

degrees 19 minutes 13 seconds West, 330.00 feet to an iron pin on the
North side of Highway Route 850, aforementioned: thence extending
along same North 76 degrees 27 minutes 34 seconds West, 15 feet to
the first mentioned point and place of BEGINNING.
CONTAINING 6.2385 acres.
BEING the same premises which Lois C. DeHart, by her Deed dated
December 27. , 1994, and intended to be recorded herewith,
grai1tedand conveyed unto Ernest K, Pace and Reba D, Pace, his
wife, Mortgagors herein.
TOGETHER with all the Mortgagors' right, title and interest now
owned or heraaftdr acquired in: {II all present and future
buildings, improvements, ways, water rights, liberties, privileges,
her8ditaments and appurtenanceo thereunto belonging: (2) all
fixtures, appliances, machinery, furniture, equipment and article.
of personal property now or at any time hereafter installed in,
attached to or situated in or upon the above described real estate
or any, building and improvements now or hereafter erected thereon
and now or hereafter used or intended to be used in any
manufacturing, industrial, businesR or commercial operation now or
hereafter conducted on the above mentioned real estate or for which
the above mentioned real estate is or becomes particularly fitted
whether or not the personal proPerty is or shall b0 affixed thereto.
ALL of the above ~entioned real estate, buildings,
improvements, ',~ays, wa,:;or rights, :ib€:rties, privileges,
hereditaments, appurtenances, machinery, equipm€:nt, appliances,
fixtures and personal property are hereinafter collectively referred
to herein as the mortgaged premises.
TO HAVE AND TO HOLD the same unto Lois C. DeHart, her heirs,
executors, administrators and assigns.
PROVIDED, HOWEVER, that if the Mortgagors shall pay to the
Mortgagee the above sum and all other sums payable by the Mortgagors
to the Mortgagee hereunder and under the terms of the mortgage note,
hereby incorporated in this mortgage indenture by reference thereto,
and shall keep and perform each of the other covenants and
agreements hereinllfter and in the mortgage note set forth, then this
mortgage indenture and the real estate hereby granted and conveyed
shall become void and the Mortgagee shall cause this mortgage
indenture to be satisfied upon the records of the Recorder of Deeds
where it is recorded.

The Mortgagors COvenant and agree that:
(1) The. mortgage note secured hereby shall evidence and this
mortgage indenture shall be security eor th~ obligation of the
Mortgagors to pay the above sum and any and all present or future
debt dr liability, including contingent liability, of the Mortgagors
to the Mortgagee, any sums paid by the Mortgagee pursuant to the
terms of this mortgage indenture, and interest on all of the
foregoing. all of which together is hereinafter called the debt.
(2) The Mortg~gors, at the Mortgagors' expense, shall keep the
mortgaged premises insured against fire and such other risks and
casualties and in such amounts and by such companies as are
satisfactory to the Mortgagee with loss payable to the Mortgagee.
(3) The Mortgagors' shall pay punctually, and promptly submit
to the Mortgagee evidence of the payment of: all taxes, assessments,
sewer and water rents, and all other charges and claims assessed or
levied on the mortgage premises from time to time by any lawful
authority; all ground rents; all mechanics' liens; all debts, liens
or charges which might have priority or parity in lien or payment to
the debt secured hereby; any documentary stamps or other tax,
including interest and penalties thereon, now or hereafter becoming
payable on the mortgage note or any other document evidencing or
securing the debt of the ~ortgagors to the Mortgagee; and premiums
and charges on such policies of fire, hazard and liability insurance
with respec" to the mortgaged premises as the Mortgagee reasonably
may require from time to cime.
(4) The Mor:04gors shall per!orm all of their obligations under
any agreemen: wi:~-the ~c:tgGgee to improve the mortgaged premises
and shall maintain the mortgaged premises and the improvements
thereon in good repair and unaltered except to the extent that. the
Mortgagee gives its written consent to alterations. The
Mortgagee shall have the right to enter on the mortgaged premises
at any reasonable hour for the purpose of inspecting the condition
and repair of the premises and the improvements.
(5) If the Mortgagors fail to make the payments required at
(3) above or fails to maintain the mortgaged premises and
improvements in good repair, the Mortgagee may do so and add the
cost to the debt evidenced by the mortgage note and secured by thiS
mortgage indenture.
(6) The Mortgagors Shall not transfer title to the above
described property or any part thereof without the prior written
consent of the Mortgagee. * Such a transfer by the Mortgagors
shall constitute a default under the terms of the mortgage note and
this mortgage indenture and the entire balance and outstanding

FOR VALUE RECEIVED, that being the 6um of $40,000.00 hereafter
called the "loan~, the undersigned (whether singular or plural)
jointly and severally, if more than one, promise to pay to the order
of LOIS C. DeHART, the aforesaid sl1m in accordance with the repayment
provisions set forth below. Additionally, the undersigned
acknowledges that they have executed, as collateral for the loan, a
mortgage indenture the same date hereof, granting and conveying a
tract of real estate specifically described therein, and any
improvements thereon, to LOIS C. DeHART. The obligations of the
undersigned, set forth in the referred to mortgage indenture, are
made a part of the obligations of the undersigned imposed upon them
by their execution of this mortgage note. Specifically, the
undersigned agree that any sums advanced by LO~S C. DeHART, in
accordance with the aforesaid mortgage indenture, whether for the
payment of insurance premiums, repairs, taxes or other municipal and
governmental claims, or for any other purpose as permitted by the
said mortgage i~denture may be added to the principal amount of the
loan and shall oe repaid by the undersigned.
The loan shall be repaid to LOIS C. DeHART over the period of
Ten (10) years in monthly payments of principal and interest in the
amount of 1435.32 per monch. Interest on the loan shall be ~t the
rate of 8% per anhum. ?ayments shall begin on January 27, 1995 and
a like sum o~ 5435.32 on :he same day of each and every month
thereafter until said principal sum ~ith interest at the rate
aforesaid is paid in full. Said ~onthly payment shall be applied
first to the pa~~e~~ of i~terest and the balance on the reduction of
?rincipal i~det:ed~ess. :~e ~crt;agee shall have t~e right to call
chis mortgage a: :~e end of five (5) years from the date of this
mortgage by prcvidin; sixty (60) days prior notice to Mortgagors of
her intention to call the mortgage. In the event said mqrtgage is
not called by Mortgagee at the end Of five (5) years, then this
mortgage will renew from year to year with the right of Mortgagee to
call the mortgage at the anniversary date of each and every
subsequent year by providing the sixty (60 day notice of her
intention to call to Mortgagors, In the event that Mortgagee does
not elect to exercise her right to call the mortgage, this mortgage
shall be due and payable in full no later than ten (10) years from
the date of this instrument. The monthly payment set forth above
must be paid every month until the entire obligation is paid in full.
The undersigned shall have the right to make any additional payments
of prinCipal at any time without penalty. In the event that any
monthly payment is late in excess of 15 days, the undersigned agree
to pay a penalty for such late payment in the amount of 5% of the
monthly payment. Every late payment by the undersigned shall create
a separate late penalty and the undersigned authorize the mortgagees
to add such a penalty or penalties to the unpaid principal debt if
the undersigned do not pay such a penalty within 30 days of the late
payment creating the penalty. In the event that the principal sum of
the loan is increased because of payments made by mortgagees under
the terms of the mortgage indenture, the term of this loan.shall be
increased a sufficient number of months to permit the undersigned to
pay the total principal debt and interest in the monthly payment
amount set forth above.
The undersigned acknowledges that the obligation created by the
execution of this mortgage note is a general obligation of the
undersigned and is not limited or curtailed in repayment by the value
of the collateral given the undersigned to the mortgagee by the
referred to mortgage indenture.
At any time after default for a period of 30 days in any
payment due on the debt or in the performance of any obligation
under the mortgage indenture, all of the debt shall become due
and payable at the option of the mortgagee and without notice.
Each of the undersigned hereby irrevocably authorizes and
empowers any attorney of any court of record of Pennsylvania or
elsewhere at anytime to appear for and to confess judgment
against the undersigned or either or any of them for the unpaid
debt, with costs and an attorney's commis~ion of 5% for
collection added, and waives and releases all errors and all
relief from any and all present and iuture stay or exemption
laws.
If all or any part of this property or any interest in it is
sold or transferred without Mortgagee's prior written con.ent,
Mortgagee may at her opt~on require immediate payment in full of all
sums secured by this Mor:gage. '
This is a purchase money mortgage under the Lien Priority Laws
of the Commonwealth of Pennsylvania.
This mortgage note shall bind, and the benefits of this mortgage
shall inure to, the undersigned and LOIS C. DeHART, her heirs,
executors, administrators and assigns. Failure on the part of the
mortgagee to exercise any of her rights hereunder shall not be deemed
a waiver of any such rights or a waiver of any default.
