ANSWER TO PETITION FOR CITATION
TO SHOW CAUSE WHY AN ACCOUNT..aHQ.tJLD NOT BE FlliD.
NOW COMES, the Respondent, GARY C. BRANDT, by and
through his attorneys, Ricci & Taneff, and files this Answer to
the Petitioner FRANCES M. BRANDT'S Petition For Citation To Show
Cause Why An Account Should Not Be Filed. In support of his
Answer, the Respondent states as follows:
1 . ADMITTED,
2. DENIED AS STATED, Decedent was survived by his
fi ve (5) adult children I namely I Gary C. Brandt, Mark C, Brandt,
Craig R. Brandt, Kirk A, Brandt and Linda Heininger, The
decedent I s surviving children were born of the decedent's
marriage to his first wife, Joan G. Brandt. That long and happy
marriage ended when Joan G. Brandt died on October 22, 1984. In
late 1987, the decedent married the Petitioner, who willfully and
maliciously abandoned the decedent in September 1989. All of the
aforesaid persons have a beneficial interest in the decedent's
estate and have been provided with the appropriate Rule 5.6(a)
Notice.
3. DENIED AS STATED. Decedent's sons, Craig R.
Brandt and Gary C. Brandt (hereinafter referred to variously as
the "Brandts" and "Co-Executors"), admitted their late father's
Last Will and Testament to probate shortly after decedent's death
and I,!:!t ters Testamentary were issued to them as Co-Executors.
Between 1997 and the present, the Brandts, with no prior
estate experience of any sort, have attempted to administer their
late father's estate alone without the assistance of full-time
counsel. Because of the size and complexity of the es~ate and
the legal i8sues involving the estate, the Co-Executors decided
to seek legal representation to assist them in the administration
of the estate. Towards that end, the undersigned attorney first
met with the Brandts on August 9, 1999 to discuss the status of
the estate and, more importantly, to address this Court r s
Citation of August 3, 1999 ordering them to show cause why a
formal accounting should not filed in their late father's estate,
On August 11, 1999, the undersigned attorney contacted the
Petitioner's counsel, Frances Del Duca, and advised her that the
undersigned had been engaged by the Brandts to assist them in the
administration of their late father's estate and sought her
agreement to handle the estate and its accounting informally.
That telephone conversation was subsequently confirmed under
cover of a letter dated August 26, 1999, a copy of which is
attached hereto as Exhibit-A. In response thereto, opposing
counsel demanded by letter dated August 30, 1999 that she be
provided with an accounting by September 15, 1999 or she would
move to make the Citation absolute. A copy of opposing counsel's
letter is attached hereto as Exhibit-B. In view of the
voluminous records that have now been delivered and continue to
be delivered to the undersigned's office, it has become apparent
that the expectation of completing an informal accounting within
thirty (30) days was premature. Realistically, based upon
counsel's advice, the Co-Executors estimate that it will be
several more months before a complete review of all of the

documents can be made with their counsel and an accounting,
formal or otherwise, can be prepared. This additional time
requirement should have come has n" surprise to the Petitioner or
her counsel in view of the fact that the Brandts had already
filed a Rule 6,12 with the Register of Wills on April 25, 1999,
indicating that "administration will be complete within a year."
A copy of the Rule 6.12 is attached hereto as Exhibit-c. The Co-
Executors and the surviving children of the decedent are as
anxious to finalize this estate as the Petitioner, but even with
the assistance of counsel rendering an accounting by September
30, 1999 is virtually impossible.
4. ADMITTED. Stating further, the decedent's Will
provided a ten percent (10%) interest in the decedent's estate to
the Petitioner, Apparently, unsatisfied with this devise, the
Petitioner filed an elective share claim against the decedent
with whom she lived for only a brief period; having wilfully and
maliciously abandoned the decedent in 1989. The Co-Executors
have repeatedly made attempts to work out an amicable solution
with the Petitioner, but to no avail. The Co-Executors have
decided to challenge the peti tioner I s right to an elect i ve share
of their late father's estate. Such a contest will, of course,
affect the Co-Executors ability to render a final accounting
relative to this estate. Moreover, the Co-Executors believe and,
therefore, allege that there is property that may have passed to
the Petitioner that operates as a charge upon the Petitioner's
elective share claim, if valid, and will also affect the Co-
Executors' ability to render a final accounting. Regardless of
the outcome of any contest over the Petitioner's elective share

rights, the decedent's estate is and remains solvent and contains
suff.ident assets to discharge any amounts that are distributable
to any of the decedent's beneficiaries including the Petitioner.
5. DENIED. Stating further, on January 19, 1998, the
Petitioner's attorney, James G. Morgan, of the firm of Hepford,
Swartz & Morgan, Harrisburg, PA acknowledged receiving a 'list of.
assets' comprising the decedent's estate, Moreover, on April 28,
1999, the Petitioner's new counsel, Frances DelDuca,
acknowledged that the Petitioner had been provided with a copy of
the decedent's Inheritance Tax Return, Copies of these letters
are attached hereto as Exhibit-D. Admittedly, an Inheritance Tax
Return and a list of aesets is not the equivalent of an
accounting, but the Petitioner's allegation and the corresponding
inference that she has been virtually kept in the dark about the
estate is disingenuous if not misleading, In consequence of the
voluminous documents that need to be reviewed with the assistance
of counsel, the Co-Executors will be unable to put together an
accounting of their late father's estate in less than 120 days.
To compel an accounting earlier would require the Co-Executors to
hire other professionals and counsel at a premium, thus
unnecessarily depleting estate assets that might otherwise be
available for distribution to beneficiaries.
WHEREFORE, the Respondent respectfully requests this
Honorable Court to grant him and his Co-Executor an addit:onal
period of 120 days to complete an accounting of their late
father's estate.

I was out of town on business for n couple_ 9J days this week, When I returned, Jeannie
showed me the attached bill she opened b~stake since it was addressed to us, You may
wani to correct your records regarding the reference to "guardian,"
We met with Ronald Johnson, our attorney, today and provided him with a list of estate
assets which I understand he will be forwarding to your attorney immediately, Fran, 1 owe
you an apology for the amount of time lhis has taken, There were a lot of calls to make. I
don't know if you heard or not, but I ruptured my right achilles tendon in mid August.
After the operation, ) was on crutches for 6 weeks and in a brace for a full 12 weeks. I
was unable to drive and just trying to work in an office was exhausting, I am still going
through rehab and not pennitted to lUn for another 3 months. At least I can walk and
drive so life is returning to normal.
Another problem arose with the date of death valuations of Dad's stocks, We contacted
Charles Scln11ab on October 101h and requested them to value the stocks. After repeated
calls, correspondence and visits, they finally produced the report on December 300', They
cited the stock market fluctuation in the fall as a reason why their workload increased. We
understood our request was not a priority issue for Schwab who paid more attention to
those people buying and trading stocks, but the lengthy delay was inexcusable regardless
of the reason,
We also discovered one of the stocks is still titled in my mother's name, Dad never got
around to changing the title. Schwab's San Francisco office is requesting us to furnish
them letters of testamentary, but Mom died without a will, Gary and I are acting as co-
executors of Dad's estate, but have no authority to handle Mom's stock (the only item we
found she owned). We are still trying to resolve this matter, however, it should not delay
filing the tax return, We just won't know if we have authority 10 sell the stock or not.
Neither Gary nor I are experienced in these matters. This has been an educational
experience for us. This has taken a lot longer than any of us would have liked,
Unfortunately with my injury and job demands, ) was unable to devote my full attention to
resolving some of these issues, Hopefully this will be concluded in the near future, )
