I, W. D. BOYER also known as WILBUR D. BOYER, of the Borough of
. Lemoyne, cumberland county, pennsylvania, declare this to be my Last
Will and Testament, hereby revoking any will previously made by me.
I _ I direct the payment of all my just deb:s and funeral expen-
ses out of my estate as soon as may be practical after my death.
II _ I bequeath certain items of my automobiles and all other
articles or personal or household use, including household goods, furni-
ture and personal effects, not including cash and securities, in accor-
dance with a written list made by me during my lifetime. In the absence
of such a list or designation on said list, I bequeath said items to my
wife, Dorothy A. Boyer, if living, and if not, to my daughter, Patsy L.
Wheeler, to dispose of as she deems appropriate.
III _ I devise and bequeath all the rest, residue and remainder
of my estate of whatever nature and wherever situate unto my wife,
Dorothy A. Boyer, providing she survives me by sixty (60) days.

IV _ Should my said wife fail to be living on the sixty-first
(61St) day following my death, then I devise and bequeath all of my
estate of whatever nature and wherever situate unto Dauphin Deposit Bank
and Trust Company, IN TRUST. nevertheless for the following uses and
purposes and under the following terms and conditions:
1.. The trust shall be held f or the benef it of my daughter,
patsy Wheeler, and my grandchildren, Claude W. Wheeler, Jr., stephanie
sturm and Douglas Wheeler. My trustee shall pay one-half of the net
income to or for the benefit of my daughter, patsy Wheelor, for the rest
of her natural life, and the other one-half of the income shall be divi-
ded among my living grandchildren. upon the death of the said Patsy
Wheeler, the trust shall terminate and the balance then remaining shall
be distributed among my grandchildren or their issue per stirpes. For
the purpose of this provision, Jason C. Haas, the child of the wife of
Claude w. Wheeler, Jr., shall be considered as a great grandchild of
mine just as though he was the issue of Claude W. Wheeler, Jr.
2. In addition to the powers above provided fort and thos
given by law/ trustee, without any order of court and in its sole dis-
cretion, may:

A. Retain any property received hereunder and invest and rein-
vest in any prudent investment, inclUding but not limited to, common or
diversified trust funds maintained by trustee and any form of life
insurance, annuity or endowment policiesl settlor's dwelling house or
other real estate 1 and in so doing settlor's trustee may act without
restriction to so-called legal investments and without responsibility
for diversification.
B. Keep ~easonable amounts of cash in bank uninvested.
C. purchase investments at premiums and charge premiums to
income or principal or partlY to each.
o. subscribe for stOCKS, bonds or other investments; eKercise
any stock option or similar right; join in any plan of lease, mortgage,
merger, consolidation, reorganization, foreclosure of voting trust and
deposit securities thereunder 1 and generallY exercise all the rights of
security holder of any corporation.
E. Register securities in the name of a nominee in such manner
that title shall pass by delivery.
F. vote in person or by proxy, securities held by it and in
such connection to delegate its discretionary powers.
G. Repair, alter, im~rove or lease for any period of time any
property and give options for leases.
H. Sell at public or private sale, for cash or credit, without
or with security, and exchange or partition property and give options
for sales or exchanges.
I. Borrow money from any person, including any eKecutor or
trustee, and mortgage or pledge any property.
J. compromise claims.
K. Add to the principal of any trust created hereunder any
property received from any person by deed, will or in any other manner.
L. Pay premi,ums of any life insurance, annuity or endowment
policies which may have been retained or purchased herein and exercise
any right, option or privilege thereunder.
M. Advise with settlor's executor in the use of expenses and
losses as deductions for federal income tax or estate tax purposes, or
party for each, as it shall be deemed advisable, without adjustments
between income and principal in consequence of the exercise of such
discretion.

N. Treat as income all income accrued and unpaid on assets at
the time such assets become a part of this trust.
O. Make distribution in cash or in kind or partly in each.
P. Exercise all power, authority and discretion given by this
trust after termination of any trust created herein until the same is
fully distributed.
Q. Settlor's fiduciary shall be entitled to compensation for
services hereunder in accordance with the standard schedule of charges
currently in effect at the time the services are called upon, and from
time to time during the period over which such services are performed.
v _ If my wife and I die simultaneously or under circumstances
which are such that the order of our deaths is uncertain, I direct that
my wife shall be deemed to survive me, irrespective of any provisions of
law establishing a contrary presumption.
VI _ I appoint Dauphin Deposit Bank and Trust company as Execu-
tor of this, my Last Will and Testament. My personal representatives
shall not be required to post bond in this or any jurisdiction. It is
my request that lilY executor engage John E. Slike, Esquire, of the law
firm of ^rnold , Slike, as attorney to assist them in the administration
of my estate.

Based on the evidence presented at the hearing held on Wadnesday. July 16. 1997.
on the Petition of Dauphin Deposit Bank and Trust Company for tha probate of a photocOPY
of a writing titled "Last Will and Testament of W. D. Boyer. also known as Wilbur D. Boyer".
we are of the opinion that the Petitioner has produced sullicient evidence to overcome the
presumption that tha instrument. dated June 13. 1990. which was offered as the Last Will
and Testament of the decedent. was revoked bV physical act.
Accordinglv. we are of the opinion that the photocoPV of the aforementioned
instrument can be admitted to probate. We have enclosed an Order admitting said instrument
to probate. As I recall. Dauphin Deposit Bank and Trust Company has already executed tha
standard form Petition for Probate and Grant of Letters. on which the necessary oath has bel;ln
given.

6. Following execution of the Will by Decedent, the Will
was photocopied, a copy was placed in Attorney Sl.ike's files, and
the original Will and photocopy were retained by Decedent.
7. On August 6, 1991, Decedent executed a Codicil to the
June 13, 1990 Will which directed that the Trust created in the
June 13, 1990 will retain certain real estate for the benefit of
the beneficiaries of the Trust, to be distributed in accordance
with the terms of the Trust at the expiration thereof. The
original of the Codicil is in the possession of the petitioner's
counsel. A copy of the Codicil is attached hereto and marked as
Exhibit "B".
8. In all other respects, the August 6, 1991 Codicil
ratified, confirmed and republished the June 13, 1990 Will, and a
copy of the Will was attached thereto.
9. The original Will, which was retained by Decedent,
cannot be located following an exhaustive search of Decedent's
personal effects.
10. Petitioner believes that the Will dated June 13, 1990
had not been revoked and remained in effect at the time of Wilbur
D. Boyer's death.
WHEREFORE, Petitioner respectfully requests the following
relief:
1.
That the Register of Wills issue a Citation to the
beneficiaries above named to show cause why the Peti-
tioner should not be granted permission to probate a
copy of Decedent's Will;

I, W. D. BOYER also known as WILBUR D. BOYER, of the Borough of
Lemoyne, cumberland county, pennsylvania, declare this to be Iny Last
will and Testament, hereby revoking any will previously made by me.
I _ I direct the payment of all my just debts and funeral expen-
ses out of my estate as soon as may be practical after my death.
II _ I bequeath certain items of my automobiles and all other
articles or personal or household use, includi.ng household goodS, furni-
ture and personal effects, not including cash and securities, in accor-
dance with a written list made by me during my lifetime. In the absence
of such a list or designation on said list, 1 bequeath said items to my
wife, DorothY A. Boyer, if living, and if not, to my daughter, Patsy L.
Wheeler, to dispose of as she deems appropriate.
III _ I devise and bequeath all the rest, residue and remainder
of my estate of whatever nature and wherever situate unto my wife,
Dorothy A. Boyer, providing she survives me by sixty (60) days.

IV _ Should my said wife fail to be living on the sixty-first
(6~st) day following my death, then I devise and bequeath all of my
estate of whatever nature and wherever situate unto Dauphin Deposit
and Trust Company, IN TRUST, nevertheless for the following uses and
purposes and under the followi,ng terms and condi t.ions:
1. The trust shall be held for the benefit of my daughter,
Patsy Wheeler, and my grandchildren, Claude W. Wheeler, Jr., stephanie
sturm and Douglas Wheeler. My trustee shall pay one-half of the net
income to or for the benefit of my daughter, Patsy Wheeler, for the rest
of her natural life, and the other one-half of the income shall be divi-
ded among my living grandchildren. Upon the death of the said patsy
Wheeler, the trust shall terminate and the balance then remaining shall
be distributed among my grandchildren or their issue per stirpes. For
the purpose of this provision, Jason C. Haas, the child of the wife of
Claude W. Wheeler, Jr., shall be considered as a great grandchild of
mine just as though he was the issue of Claude W. Wheeler, Jr.
2. In addition to the powers above provided for, and thos
given by law, trustee, without any order of court and in its sole dis-
cretion, may:

A. Retain any property received hereunder and invest and rein-
vest in any prudent investment, including but not limited to, common or
diversified trust funds maintained by trustee and any form of life
insurance, annuity or endowment policies; settlor's dwelling house or
other r~al estate; and in so doing settlor's trustee may act without
restriction to so-called legal investments and without responsibility
for diversification.
B. Keep reasonable amounts of cash in bank uninvested.
c. Purchase investments at premiums and charge premiums to
income or principal or partly to each.
D. Subscribe tor. stocKs, bonds or other investments; exercise
any stock option or similar right; join in any plan of leasA, mortgage,
merger, consolidation, reorganization, foreclosure of voting trust and
deposit securities thereunder; and generally exercise all the rights of
security holder of any corporation.
E. Register securities in the name of a nominee in such m~nner
that title shall pass by delivery.
F. Vote in person or by proxy, securities held by it and in
such connection to delegate its discretionary powers.
G. Repair, alter, improve or lease for any period of time any

L. Pay premiums of any life insurance, annuity or endowment
policies which may have been retained or purchased herein and exeroise
any right, option or privilege thereunder.

Q. when you met with him? Then after Mr. Boyer
died, did you locate the stock certificates in the safe
that you'd seen previously?
A. The first time I went back after his death, I
23 went to the safe to try to locate the wills. I found the
24 great majority of the documents that were in that safe
25 that we looked at and talked about were missing. A lot of

And these were documents that would not have

4 A. That's correct. Stock certificates.
5 Q. A person would keep rather than destroy?
6 A. Right.
7 Q. Do you know Mr. Boyer'tI widow, and mother - - if
8 you can describe, generally, her condition as far as
9 remembering where things are located?
10 A. I know Dorothy, but not nearly so well as
11 Pete. My relationship through the years was with Mr.
12 Boyer. But when I was coming over to see Mr. Boyer during

13 his illness, most of my discussions were with him. And my
understanding was that it was important that he get some
matters straightened out because Dorothy had a great deal
of problems dealing with financial matters; and, indeed,
even remembering things like bills that had to be paid and
where things were to be found.
And that wad one of the reasons we were very
careful after reviewing all of these documents to put them
back in the same safe that we found them and make
notations as to what we found. she had great difficulty
locating things and handling financial affairs.
Q. Now, at a later date, were any of the stock
certificates that were missing in your original visit

Yeah. At a later date / I was over talking with

3 Mrs. 130yer and some of the issues came up as to Dauphin
4 Deposit stock. After Dauphin Deposit got bought out, 11
5 tender issue was issued to stockholders. And I was
6 explaining to her that she could get a higher value for
7 the stock as a result of the buy-out. Again, went to the
8 safe in the bedroom and there was a Manila folder with
9 stock certificates that was there in the safe that wasn't
10 there a month or two earlier.

As you know, we have been unable to locate the original will
executed by Mr. Boyer during his lifetime. A copy of the will
was discovered and the original codicil which he executed in 1990
was held by Dauphin Deposit Bank. I have checked with the
Register of Wills' Office as to how we should proceed to file a
photocoPY of the will rather than the original and they have said
that the RegiBter of Wills must hold a hearing to learn the
circumstances of the matter. It is my expectation that the
Register of Wills will agree to permit the copy of the will to be
probated, but we have to establish to her satisfaction that the
will has been lost and was not intentionally destroyed by Mr.
Boyer during this lifetime. It is important that persons who
were with him in the years prior to his death be present at the
hearing to verify that, to their knowledge, the will was not
intentionally destroyed.
Accordingly, I am enclosing a citation setting a hearing for
July 16th at 11:00 a.m. in the Register of Wills' Office in the
county Courthouse. I plan to be present at that time and would
like you to be present if at all possible.
Please contact my office to arrange a convenient time to
review this matter.

IV _ Should my said wife fail to be living on the sixty-first
(6~st) day following my death, then I devise and bequeath all of my
estate of whatever nature and wherever situate unto Dauphin Deposit Bank
and Trust Company/ IN TRUST, nevertheless for the following uses and
purposes and under tho following terms and conditions:
1. The trust shall be held for the benefit of my daughter,
patsy Wheeler, and my grandchildren, Claude W. Wheeler, Jr., stephanie
sturm and Douglas Wheeler. My trustee shall pay one-half of the net
income to or for the benefit of my daughter/ patsy Wheeler, for the rest
of her natural life, and the other one-half of the income shall be divi-
ded among my living grandchildren. Upon the death of the said patsy
Wheeler, the trust shall terminate and the balance then remaining shall
be distributed among my grandchildren or their issue per stirpes. For
the purpose of this provision, Jason C. Haas, the child of the wife of
claude W. Wheeler, Jr., shall be considered as a great grandchild of
mine just as though he was the issue of Claude W. Wheeler, Jr.
2. In addition to the powers above pr.ovided for, and thos
given by law, trustee, without any order of court and in its sole dis-
