I, NGUYEN T, STOTT, Social Security Number 216-76-1677, of the
Commonwealth of Pennsylvania, declare that this Is my lAST WILL AND
TESTAMENT and I revoke all other wills and codicils previously made by me,
FIRST: I appoint my Daughter, BOBBIE LEE STOVALL, as my Personal
Representative concerning this Will, If my Daughter, BOBBIE l.EE STOVALL, is
unable or fails to serve, I then appoint my Cousin, DE TRANG of Carlisle,
Pennsylvania to serve as my Personal Representative.
a. I request that my Personal Representative be permitted to serve
without bond or surety thereon and without the intervention of any court, except
as required by law, I direct that my Personal Representative act in unsuperVised
administration so as to administer my estate with a minimum of court supervision.
If It becomes necessary to have ancillary administration of my estate In any
Jurisdiction where my Personal Representative Is unable or does not desire to
qualify as ancillary legal representative, I appoint as such ancillary legal
representative such individual or corporation as my Personal Representative
shall designate, in writing,
b. I direct my Personal Representative to pay the expenses of my
last illness, the expenses of a funeral appropriate to my station In life and custom
of living (Including a suitable monument or marker for my grave), and written
charitable pledges which I have made, I grant my Personal Representative the
power to extend or renew any debt for such time as my Personal Representative
shall deem appropriate.
c. All estate, inheritance, succession and other death taxes with
respect to all property passing under this Will shall be paid from and borne by the
principal of my residuary estate, without regard to reimbursement, as if such
taxes were administration expenses. My Personal Representative may pay such
taxes at any time deemed advisable, whether or not then due and payable,

soon after my death as may be practicable, and to payor deliver every legacy or
bequest to my beneficiaries without waiting any time that may be believed to be

e. I may leave a letter of Intent with the executed copy of this Will
for the purpose of giving guidance to my Personal Representative concerning the
distribution or sale of certain Items of my property, I request, but do not require,
that my Personal Representative honor my wishes therein expressed,
SECOND: I give, devise and bequeath, absolutely and forever, all of my
estate and property of which I may be seized or possessed, or to which I may be
entitled, at the time of my death, wherever situated or of whatever nature, be it
real, personal, or mixed, to my Daughter, BOBBIE LEE STOVALL, if she shall
survive me,
THIRD: In the event that my Daughter, BOBBIE LEE STOVALL, shall not
survive me, I give, devise and bequeath, absolutely and forever, all of my estate
and property of which I may be seized or possessed, or to which I may be
entitled, at the time of my death, wherever situated or of whatever nature, be It
real, personal, or mixed, to my Cousin, DE TRANG, of Carlisle, Pennsylvania, as
his sole and absolute property if he shall survive me,
FOURTH: Except as otherwise provided in this Will, I have Intentionally
failed to provide for any other relatives or other persons, whether claiming to be
an heir of mine or not. Specifically excluded is my estranged Husband, ROBERT
L. STOTT, as we are pending divorce,
FIFTH: Any beneficiary who falls to survive until one hundred twenty
(120) hours after my death shall be deemed to have predeceased me, and the
gift to that beneficiary shall be disposed of accordingly.
SIXTH: The term "Personal Representative" as used in this Will means
Executor, Executrix, Independent Executor, or other title of like import which is
used to describe such a fiduciary,
SEVENTH: In addition to any powers granted by the laws of the state in
which this Will is probated, I hereby authorize and empower the fiduciaries
named in this Will, to the extent of the discretion herein granted, to sell,
exchange, convey, transfer, assign, mortgage, pledge, lease or rent the whole or
any part of my real or personal estate, to invest, reinvest, or retain investments of

my estate, to perform all acts and to execute all documents which my fiduciaries
may deem necessary or proper in regard to my property, If any of my fiduciaries

any reason, It is my intention that the remaining parts, so far as possible and
real'lonable, shall be effective and fully operative, My Personal Representative
may seek and obtain court instructions for the purpose of carrying out as nearly
as may be possible the intention of this Will as shown by the terms hereof,
including any terms held invalid, illegal, or inoperative.

at a session of the said Court there tote held, for the County of
Cumberland to shew rause why a derlaratory judgment should not be 'I

Code and why the Real Estate and Personal Property whirh were jointly
owned by Nguyen T.Stott and Robert L. stott should not be partitioned
by a derree derlarlng that:
1. Robert L.Stott is found to be the slayer of Nguyen T.Stott.
2. Robert L. stott shall be deemed to have predereased Nguyen
T. Stott as to property whirh would have passed to him under
the will of Nguyen T.Stott.
3. The pr.emises at 2800 Spring Road, North Middleton Township,
Carlisle, pennsylvania shall be held one-half by the estate
of Nguyen T. Stott and one-half by Robert L,Stott subjert to
8805 the Probate, Estates and Flduriaries Code, 20 Pa.
C.S.A. 8R05, provid~d that Robert L.Stott shall be liable
to pay one-half of all expenses of maintenanre, taxes,
repairs, upkeep, mortgage pRym~nts and all expenses relative
to the p.roperty, and provlded that upon Sil e of the property,
one-ha If of the net, proreeds shall be pat! over to the Estate
of Nguyen T.Stott and the other half to be deposited in a
bank arrount for Robert L. Stott and the Estate of Nguyen
T. Stott and the Arnount shall be marked for distribution of

and upon the death of Robert L.stott the arrount is to be

no. CR-000393-97 and Common)'lcas Docket No. 97-1577, Rohcrtl.ce Stnll is fiJrmally
charged with criminal homicide, murder of thc first dccrec und rclatcd charges. A preliminary
hcaring was held on August 21. 1997 and District Justice Puula P. Correul found a prima fucie

rights of the Estate of Nguyen T. Stoll to the jointly owncd asscts is nceded so that funds may be
made availablc to pay dccedcnts dcbts, administration costs, and deuth taxes, and so that the

1. T A VI.OR p, ANDREWS, verify that the statements made in this Petillon for
Declaratory Judgment to Determine Robert L. Stouto bea Slayer and for Partitioning are true
and correct to the best of my knowledge, information and belief. 1 provide this verificallon rather
than Bobbie Lee Stovall because Bobbie Lee Stovall rcsidcs in Germany, beyond the jurisdicllon
of this Court, and there is insufficient time to obtain a signed verification by Bobbie Lee Stovall
because there is a need for quick action to avoid waste of the propcrty involved. Furthelmore, as
counsel to Nguyen T. Stott in her divorcc action, thc undcrsigned has more information regarding
the property of Nguyen T. Stott and the circumstances of her death then does Bobbie Lee Stoval1.

At approximately 2305 hours on the evening of July 31, 1997, the dead
bodies of Nguyen Stott and ,Jimmy K. Diven, ,Jr" were found in the parking
lot of Hasland Industries, along Carlisle Spring Road in the Borough of
Carl isle, Cumbel: land County, pennsy 1 vania. Wh Un investigatinlJ this CJ: ime,
Michael Burkholder stated he observed Robert 1,. stott leave the area of the
parking lot in a white Chrysler automobile. Robert L. stott was observed
by Troopers \Iousel and Hays of the Pennsylvilnia state police dr:iving a
white Chrysler: automobile along 1'/\ Route 233 in Cooke Township where he was
arrested. /\t the time of the orrest, the troopers observed in plain view a
handgun laying on the floor of the vehicle. 1\ subsequent gear~h of the
vehIcle revealed that fOUl' handguns were found in the vehicle, 1\ check was
made with the Cumberland County Sheriff'S (Jffice and it was detelmined that
the defendant was not licensed to carry a hondgun concealed on his person
or in 'lilY motol: vehicle in the state of Pennsylvania. 'I'he accused was
interviewed by myself and Cldef County Detective lHchae1, H. Br:ennan on the
morning of I\ugust 1, 1997, at which time he stated that the handguns in
question were his, that he placed them in his automobile after removing
them from his residence at 2000 CarlIsle Spring Road and that he did
utilize one of the handguns found in his vehicle to shoot Nguyen Stott
and Jimmy K. Diven, Jr.

Vincont Van Dessera reported to police that ut approximatley 2300 hours on July 3
1997 He ~la3 l,n the parking lot of i'laslllnd Industr1t~s I Leat. 1nc, off Carlisle
Spring Road, Carlisle when he heard gunshots, saw Jomes Divens run across the
parking lot, and heard more gunshots. lie trH,n observed Robert Stott flee the
parking lot. This Detective did observe the Sue Stott and James Divens both
dead from what appeared to be gunshot wounds,
Earlier in the day, Sue Stott told Jo~n Henry (who relayed the information to
t~ [letecttj,.ve) tha~ she had a hearing scheduled in the Cumberland County
Court of Conulio'AI;tC'a's"in which Robert Stott was a pany and Robert Stott failed
to appear for the hearing.
Sue Stott was the estranged wife of Robert Stott.
I believe that this information is sufficient for the issuance of an arrest
warrant for Robert Stott.

I, NGUYEN T. STOTT, Social Security Number 216-76-1677, of the
Commonwealth of Pennsylvania, declare that this is my LAST WIl.L AND
TESTAMENT and I revoke all other wills and codicils previously made by me,
FIRST: I appoint my Daughter, BOBBIE LEE STOVALL I as my Personal
Representative concerning this Will. If my Daughter, BOBBIE LEE STOVALL, is
unable or fails to serve, I then appoint my Cousin, DE TRANG of Carlisle,
Pennsylvania to serve as my Personal Representative,
a, I request that my Personal Representative be permitted to serve
without bond or surety thereon and without the intervention of any court, except
as required by law. I direct that my Personal Representative act in unsupervised
administration so as to administer my estate with a minimum of court supervision,
If it becomes necessary to have ancillary administration of my estate in any
jurisdiction where my Personal Representative is unable or does not desire to
qualify as ancillary legal representative, I appoint as such ancillary legal
representative such individual or corporation as my Personal Representative
shall designate, in writing,
b. I direct my Personal Representative to pay the expenses of my
last Illness, the expenses of a funeral appropriate to my station in life and custom
of living (including a suitable monument or marker for my grave), and written
chafltable pledges which I have made. I grant my Personal Representative the
power to extend or renew any debt for such time as my Personal Representative
shall deem appropriate.
c, Ail estate, inheritance, succession and other death taxes with
respect to all property passing under this Will shall be paid from and borne by the
principal of my residuary estate, without regard to reimbursement, as if such
taxes were administration expenses, My Personal Representative may pay such

entitled, at the time of my death, wherever situated or of whatever nature, be it
real, personal, or mixed, to my Daughter, BOBBIE LEE STOVALL, if she shall
survive me.
THIRD: In the event that my Daughter, BOBBIE LEE STOVALL, shall not
survive me, I give, devise and bequeath, absolutely and forever, all of my estate
and property of which I may be seized or possessed, or to which I may be
entitled, at the time of my death, wherever situated or of whatever nature, be it
real, personal, or mixed, to my Cousin, DE TRANG, of Carlisle, Pennsylvania, as
his sole and absolute property if he shall survive me.
FOURTH: Except as otherwise provided In this Will, I have Intentionally
failed to provide for any other relatives or other persons, whether claiming to be
an hell' of mine or not. Specifically excluded is my estranged Husband, ROBERT
L. STOlT, as we are pending divorce.
FIFTH: Any beneficiary who fails to survive until one hundred twenty
(120) hours after my death shail be deemed to have predeceased me, and the
gift to that beneficiary shall be disposed of accordingly.
SIXTH: The term "Personal Representative" as used in this Will means
Executor, Executrix, Independent Executor, or other title of like import which is
used to describe such a fiduciary,
SEVENTH: In addition to any powers granted by the laws of the state in
which this Will is probated, I hereby authorize and empower the fiduciaries
named In this Will, to the extent of the discretion herein granted, to sell,
