LAST WILL AND TEST AMENT OF MARIAN E. SIMMONS
I, MARIAN E. SIMMONS, of the Sliver Spring Township, Cumberland County,
Pennsylvania, being of sound and disposing mind, memory and understanding, do make, publish
and declare this my Last Will and Testament, hereby revoking and making void any and all prior
WlI1s by me at any time heretofore made.
I.
I direct the payment of all my just debts and funeral expenses as soon after my deeease as
the same ean eonveniently be done.
2.
I make the following specifie bequests, legacies and gifts;
II.) I give all of my "owl" colleetion to my daughter, CLARA FLINCHUM.
b.) I give all of my lawnmowers to my grandson, MICHAEL FLINCHUM.
! c.) I give the sum of one hundred ($100.00) dollars to each of my grandchildren,
excepting Michael Flinchum, he being otherwise provided for.
The , above gifts are to be estate and inheritance tax free. In the event any of the above
persons, whether designated by name or class, predeeease me, then their gift, bequest or legacy, as
the case may be, shall lapse and beeome part of the residue of my estate.
3.
All the rest, residue and remainder of my Estate, real, personal and mixed, whatsoever and
wheresoever situate, I give, devise and bequeath in three equal shares to my beloved ehildren,
RAYMOND L. SIMMONS, CLARA J. FLINCHUM and JOYCE A. HALTER, gm:~.
4.
Should my grandson, Miehael Flinchum, be oceupying my residenee at 201 Hempt Road at
the time of my death, he shall be allowed to remain in the premises rent-free for up to sixty (60)
days to enable him to find another suitable plaee to reside.

I nominate, eonstitute and appoint my ehildren, RAYMOND L. SIMMONS, currently of
Lisbum Road, Carlisle, Cumberland County. CLARA J. FLINCHUM, eurrently of New
Kingstown, Cumberland County, and JOYCE A. HALTER, currently of Carlisle, R.D.,
Cumberland County, to be the Co-Executors of this my Last Will and Testament. I further direct
that they shall not be required to file bond or other seeurity in the Offiee of the Register of WlIIs for
the purpose of administering my Estate.

the law of esla\CS. The law of estales was predominantly controlled by the common law of England which WlUlam
Penn brought with him upon the founding of Pennsylyanla. "Estate." in legal usage, ordinarily indicates the
position in which a person stands with regard to the ownership, possession and control of his propeny, or. il may
mean the property itself. Although originally, in lis technical sense, an estalC referred 10 property in land, common
usage and Judicial decisions have broadened the term's meaning to include personally as well as really. See Kline v.
Peiffer. 3 Berks (Pa.) 240 (1910); 14 P. L. E.. Estates, sec~ I. at pp. 3-4 (1959); and the defmition section aboVC\.
Ills now imponanl1O differentiate between the common law of estates concenting Joint tenancies and tenancies in
common. Set! the definition SC(;tion above. We begin with the joinllenancy. The common law eslate of joinl
lCIW1cy exislS where a single estate in propeny. real or personal. Is owned by two or more persons under one
instrumenl or acl of the panies. See Haggerty's Estate, 311 Pa. 503. 166 A. 580 (1933); Leach's Eslate, 282 Pa.
545. 128 A. 497 (1925). Those panics all have an equal right to share in the enjoyment of the eslate during their
lives. Phila.. ele. R.R. Co. Y. f.A\high Coal & Nav. Co, 36 Pa. 204 (1860). The concept of surviyorship was the
distinctiye characteristic of a joint tenancy at the common law. In England. joint tenallcie.~ were fayored and the
doctrine of survlYlll'Ship was recognized as a p~umed and necessary Incident of a joint esl8le. In other words, no
special language was needed 10 CIClUC a jointlenancy with a right of survivorship. If a joint eslate was creared. il
was necessarily presumed to carry with it the Incident of survivorship unless language to the conll'lll'y was plainly

c.) I give the sum of one hundred ($100.00) dollars to each of my grlUldchildren.
