LAST WILL AND TESTAMENT-2l
CAROL BANRU
I, CAROL BANKES, of Cumberland County, Pennsylvania, do
hereby make this my Last will and Testament, revoking any former
Wills and Codicils made by me,
FIRST: I give my tangible personal property and all
casualty insurance that I am carrying on said tangible personal
property to my husband, Robert H. Bankes, Jr., in confidence that
my handwritten instructions rel.ative to family items w,Ul be
honored.
~ECOND: I give to my husband, Robert H. Bankes, Jr., if he
survives me, for his life use and possession, without any bond or
other security, my interest as a tenant in common with Robert H.
Bankes, Jr. in that certain tract or parcel of land situated in
East Pennsboro TownShip, Cumberland County, Pennsylvania, bounded
and described as follows:
BEGINNING in the northwesterly extremity of
the arc or curve having a radius of 10 feet
connecting the southerly line of Shady Lane
with the westerly line of Altoona Avenue, and
extending thence southeasterly on a line
curving toward the right with a radius of 10
feet, a distance of 16 feet and .502 of a
foot; thence along the westerly line of
Altoona Avenue, South 10 degrees 20 minutes
East, 88 feet and .056 of a foot; thence
South 79 degrees 40 minutes West, 123 feet
and .729 of a foot; thence North 14 degrees
54 minutes West, 85 feet, more or less, to
the South side of Shady Lane and thence North
75 degrees 07 minutes East, a distance of 120
feet and .214 of a foot to a point, the place
of BEGINNING,
(2) My husband shall keep the real property in good condi-
tion and repair, pay all taxes and other carrying charges, and
keep the real prcperty insured against loss, theft or damage at
its fair value, but shall not be liable for waste and shall not
have to account to the remaindermen. My husband may rent and
alter or improve the real property as my husband deems appropri-
ate. The cost of such improvements and other expenses, and
receipts from the real property, shall be allocated between my
husband's life estate and the remaindermen as provided by law for

t.rusts, and my husband may encumber the real property to provide
funds ohargeable to the remaindermen.
(3) My husband shall have with respect to this property all
powers granted to a trustee, including the power to sell and to
reinvest without the consent of the remaindermen,
(4) My husband may relinquish the life estate in whole or
in part by an acknowledged instrument of release which shall be
recorded in the Cumberland County Recorder of Deeds Office.
(5) Any purchaser of property disposed by this Article
shall deal with my husband as the sole owner and shall have no
responsibility to inquire into the application of the sale
proceeds or into any other matter involving the interests of the
remaindermen.
(6) Upon my husband's death, or upon the execution of an
instrument of release, I give, devise and bequeath the property
disposed of by this Article (or released by my husband) to my
daughter, Michele Baum,
THIRD: I give, devise and bequeath all the rest, residue
and remainder of my property of every kind and description
(including insurance policies and retirement benefits payable to
my estate) wherever situate and whether acquired before or after
the execution of this Will, absolutely in fee simple to my
Trustee, hereinafter named, to be held in trust, and administered
and distributed as follows:
(1) My Trustee shall distribute the following fractional
shares of the trust (as valued on the end of the calendar quarter
immediately preceding the distribution date) to my daughter,
Miohele Baum:

an insurance company and deliver to my daughter, Michele Baum, a

I, CAROL BANKES, of Cumberland county, pennsylvania, do
hereby make this my Last will and Testament, revoking any former
wills and Codicils made by me,
FIRST: I give my tangible personal property and all
casualty insurance that I am carrying on said tangible personal
property to my husband, Robert H, Bankes, Jr" in confidence that
my handwritten instructions relative to family items will be
honored.
SECOND: I give to my husband, Robert 11. Bankes, Jr., if he
survives me, for his life use and possession, without any bond or
other security, my interest as a tenant in common with Robert H.
Bankes, Jr. in that certain tract or parcel of land situated in
East pennsboro Township, Cumberland county, Pennsylvania, bounded
and described as follows:
BEGINNING in the northwesterly extremity of
the arc or curve having a radius of 10 feet
connecting the southerly line of Shady Lane
with the westerly line of Altoona Avenue, and
extending thence southeasterly on a line
curving toward the right with a radius of 10
feet, a distance of 16 feet and ,502 of a
footi thence along the westerly line of
Altoona Avenue, South 10 degrees 20 minutes
East, aa feet and .056 of a footi thence
South 79 degrees 40 minutes West, 123 feet
and ,729 of a footi thence North 14 degrees
54 minutes West, a5 feet, more or less, to
the South side of Shady Lane and thence North
75 degrees 07 minutes East, a distance of 120
feet and .214 of a foot to a point, the place
of BEGINNING.
(2) My husband shall keep the real property in good condi-
tion and repair, pay all taxes and other carrying charges, and
keep the real property insured against loss, theft or damage at
its fair value, but shall not be liable for waste and shall not
have to account to the remaindermen. My husband may rent and
alter or improve the real property as my husband deems appropri-
ate. The cost of such improvements and other expenses, and
receipts from the real property, shall be allocated between my
husband's life, estate and the remaindermen as provided by law for

tunds ohargeable to the remaindermen,
(3) My husband shall have with respect to this property all
powers granted to a trustee, including the power to sell and to
reinvest without the consent of the remaindermen.

in part by an acknowledged instrument of release which shall be
recorded in the Cumberland county Recorder of Deeds Office.
(5) Any purchaser of property disposed by this Article
shall deal with my husband as the sole owner and shall have no
responsibility to inquire into the application of the sale
proceeds or into any other matter involving the interests of the
remaindermen.
(6) Upon my husband's death, or upon the execution of an
instrument of release, I give, dev ise and bequeath .the property
disposed of by this Article (or released by my husband) to my
daughter, Michele Baum.
THIRD: I give, devise and bequeath all the rest, residue
and remainder of my property of every kind and description
(including insurance policies and retirement benefits payable to
my estate) wherever situate and whether acquired before or after
the execution of this Will, absolutely in fee simple to my
Trustee, hereinafter named, to be held in trust, and administered
and distributed as folloWS1
(1) My Trustee shall distribute the following fractional
