LAST WILL AND TESTAMI'NT
I, ARTHUR H. BAIR, of 609 Charles Street, Borough of Shippensburg, Cumberland
County, Pennsylvania, being of sound mind, memory and disposition, do hereby make,
publish and declare this my Last Will and Testament, hereby revoking and making void
all wills by me at any time heretofore made.
FIRST.
1 order and direct the payment of all my just debts and funeral expenses as
soon as may be convenient after my decease.
SECOND.
I give, devise and bequeath all my estate, real, personal and mixed,
whatsoever and wheresoever situate, in equal shares, as follows:
A. ONE SHARE to my dear friend, MARTHA JONES. In the event the said
Martha Jones should predecease or fail to survive me by thirty (30) days, I then
give, devise and bequeath said beneficiary I s share in equal shares to my children,
ARTHUR H. BAIR, JR. and MARY LOUISE ORNDORFF, on a per stirpes distribution basis;
B. ONE SHARE to my son, ARTHUR H. BAIR, JR., on a per stirpes distribution
basis; and
C. ONE SHARE to my daughter, MARY LOUISE ORNDORFF, on a per stirpes
distribution basis.
~. I hereby direct that all federal, state and other death taxes payable
because of my death, with respect to the property forming my gross estate for tax
purposes, whether or not passing under this Will, including any interest or penalty
imposed in connection with such taxes, shall be considered a part of the expense of
administration of my estate and that such be paid out of the rest and residue of my
estate.

bond for the faithful performance of their duties in any jurisdiction.

DRIVEWAY EASEMENT AGREEMENT
TI-IIS INDENTURE made this .~ -1A.- day of October, 1998, between Arthur H. Bair, Jr.,
and Mary Louise Orndorff (hereinafter called the "Grantors"), and Ronald R. Gill and Betty S. Gill
(hereinafter called the ':Grantees").
WHEREAS the Estate of Arthur H. Bair, deceased, is the owner of a certain tract of real
estate known as 609 Charles Street, Borough of Shipp ens burg, Cumberland County, Pennsylvania,
more fully bounded and described in Cumberland County Deed Book "B," Volume 29, at page 379.
Mary Bair died April 11, 1992, thereby vesting the entire fee simple in Arthur H. Bair. The said
Arthur H. Bair died on September II, 1997. Letters Testamentary were issued by the Register of
Wills in and for Cumberland County, Pennsylvania, to Arthur H. Bair, Jr., and Mary Louise
Orndorff, Executors, under the Last Will and Testament of Arthur H. Bair; hereinafter referred to
as Grantors, at File No. 21-97-0764; and

WHEREAS Ronald R. Gill and Betty S. Gill, hereinafter referred to as Grantees, are the
owners ofa tract of real estate together with improvements erected thereon known as 613 Charles
Street, Borough of Shippensburg, Cumberland County, Pennsylvania more fully bounded and
described in Cumberland County Deed Book "K," Volume 33, at page 283; and
WHEREAS Grantors are desirous of granting to Grantees, their heirs and assigns an
easement for the limited purpose of ingress and egress of motor vehicles over a driveway constructed
on the Grantors' property.
WITNESSETH:
The said Grantors for and in consideration of the sum of Six Hundred Dollars ($600.00)
lawful money of the United States of America unto them well and truly paid by the said
Grantees, at or before the sealing and delivery hereof, the receipt whereof is hereby
acknowledged, have granted, bargained and sold, released and confirmed, and by these presents
do grant, bargain and sell, release and confirm unto the said Grantees, their heirs, executors,
administrators and assigns an easement for the limited purpose of ingress and egress of motor
vehicles over a driveway over that portion of Grantors' real estate situate in the Borough of
Shippensburg, Cumberland County, Pennsylvania, known as 609 Charles Street and more fully
described as follows:
Beginning at an existing iron pin at the Southern comer of real estate of Ronald R. Gill
and Betty S. Gill thence along the Northern Side of the right of way for Charles Street
South forty six (46) degrees, fifteen (15) minutes, zero (00) seconds West, one and
seventy hundredths (1.70) feet to a point; thence through lands of Althur H. Bair Estate
North forty four (44) degrees, fifty five (55) minutes forty nine (49) seconds West,
eighty nine and forty four hundredths (89.44) feet along the existing edge of the Ronald
R. Gill driveway to a point; thence North twenty nine (29) degrees, fifty three (53)
minutes. fifteen (15) seconds West, fourteen and seventy eight hundredths (14.78) feet to
the existing lot line between lands of Arthur H. Bair Estate and lands of Ronald R. Gill;

thence with said common lot line South forty three (43) degrees, forty five (45) minutes,
zero (00) seconds East, one hundred three and seventy seven hundredths (103.77) feet to
an existing iron pin the place of beginning.
Being a part of the same which Frank E. I-lollar, Jr., by his deed dated August 20, ] 980,
and recorded in Cumberland County Deed Book "B," Volume 29, at Page 379 granted
and conveyed to Arthur H. Bair and Mary Bair, husband and wife.
EXCEPTING AND RESERVING unto the said Grantors, their heirs, and assigns, full, free
liberty and right at all times hereafter forever, in common wi th the Grantees, their heirs, successors
and assigns, to a perpetual driveway casement for ingress and egress of motor vehicles at, across and
upon the aforementioned premises.
1. The Grantees, their heirs, successors and assigns, forever, shall pay all charges and
expenses for improving, repairing, cleaning, altering and maintaining said driveway, without the
right of reimbursement from the Grantors, their heirs, successors, and assigns. Nothing herein
contained shall prevent Grantees from improving the surface of the driveway easement with
macadam, pavement, or other roadway surfacing.
2. No barriers, fences, curbs or other obstruction to the free and unhampered use of said
easement and right of way shall hereafter be permitted, nor shall any automobiles, trucks, motor
vehicles or other personal property nor any building or other structure hereafter be parked, stored,
constructed or permitted upon any part of said easement or right of way. Nothing herein shall
prevent the temporary parking of motor vehicles by guests or invitees of the Grantees, provided that
such temporary use does not interfere with the Grantors' use or enjoyment of Grantors' property.
3. Should the land hereby subject to this easement ever cease to be used as a driveway,
then in such a case, the full right and title to the above described real estate shall revert to the present
Grantors or their respective successors in title in the same fashion as existed prior to the construction
of the subject driveway.
4. It is agreed that the driveway hereinabove provided for is and shall remain a private
driveway for the use of Grantees and shall not be used nor permitted to be used by adjoining owners
or other persons unless and until such adjoining owners or other person shall enter into an agreement
in writing with the parties hereto, covering the permissible use of said driveway.
5. This Driveway Easement Agreement shall be construed, interpreted and applied in
accordance with the laws of the Commonwealth of Pennsylvania.
6. This Driveway Easement Agreement shall be recorded of public record in the Office
of the Recorder of Deeds in and for Cumberland County, Pennsylvania, at Grantees' expense.

County, Pennsylvania, being of sound mind, memory and disposition, do hereby make,
publish and declare this my Last Will and Testament, hereby revoking and making void
all wills by me at any time heretofore made.
FIRST.
I order and direct the payment of all my just debts and funeral expenses a9
soon as may be convenient after my decease.
SECOND.
I give, devise and bequeath all my estate, real, personal and mixed,
whatsoever and wheresoever situate, in equal ~hares, as follows:

A. ONE SHARE to my dear friend, MARTHA JONES. In the event the said
Martha Jones should predecease or rail to survive me by thirty (30) days, I then
give, devise and bequeath said beneficiary's share in equal shares to my children,
ARTHUR H. BAIR, JR. and MARY LOUISE ORNDORFF, on a per stirpes distribution basis;
B. ONE SHARE to my son, ARTHUR H. BAIR, JR., on a per stirpes distribution
basis; and
C. ONE SHARE to my daughter, MARY LOUISE ORNDORFF, on a per stirpes

THIRD.
I hereby direct that all federal, state and other death taxes payable
because of my death, with respect to the property forming my grosS estate for tax
purposes, whether or not passing under this Will, including any interest or penalty
imposed in connection with such taxes, shall be considered a part of the expense of
administration of my estate and that such be paid out of the rest and residue of my

WHEREAS, Letters Testamentary were granted to Arthur H. Bair, Jr. and Mary Louise
Orndorff on September 17, 1997, by the Register of Wills of Cumberland County, Pennsylvania;
and
WHEREAS, all the assets of the late Arthur H. Bair have been liquidated or distributed and
all his debts paid in full, and further the period of four months having terminated since the first
advertisement of the issuance of Letters to the said Co-Executors, the said parties hereto desire to
waive the duty of the Co-Executors to file a First and Final Account with Proposed Schedule of
Distribution for purposes of confirmation by The Court of Common Pleas of Cumberland County,
Orphans' Court Division, AND FURTHER desire that a Family Settlement Agreement be executed,
which Family Settlement Agreement will be duly recorded among the deed records in and for
Cumberland County.
