LAST WILL AND TESTAMENT
I, Arthur G. Etter, a resident of the Township of Upper Frankford, County of
Cumberland and State of Pennsylvania, being of sound mind and memory, do make,
publish and declare this to be my Last Will and Testament, hereby revoking any
and all Wills or Codicils heretofore made by me.
FIRST: I hereby direct my Executors, hereinafter named, to pay all my just
debts and funeral expenses as soon as may conveniently be done after my
decease.
SECOND: I give, devise and bequeath to my grandson, Michael L. Etter my 1931
Ford Roadster automobile for his own proper use and behoof forever.
THIRD:
I give, devise and bequeath all the rest of my estate, be it real,
personal or mixed to my children to-wit: Arthur L. Etter, Leroy C. Etter and
Louise L. Rickabaugh, or their heirs, equally, share and share alike. It is
my desire and wish that all my estate, be it real,. personal or mixed, be
converted into cash and the disposition of said estate be divided equally as
herein set forth in this paragraph.
FOURTH: I hereby nominate, constitute and appoint my two sons, Arthur L.
Etter and Leroy C. Etter, to be the Executors o'f this my Last Will and
Testament.
IN WITNESS WHEREOF, I have hereunto set my hand and seal to this my Last Will
and Testament, dated this 7~day of April, 1988.

INSTALLMENT SALE AGREEMENI
THIS AGREEMENT is entered into this.;lS'/day of June. 1996. by and between ARTHUR
G. ETTER. by ARTHUR L. ETTER his attorney in fact, of726 Grahams Woods Road, Newville.
Cumberland County, Pennsylvania. hereinafter called "Seller", and DENNIS BRIAN ETTER, of
Rock Hollow Road. Loysville, Perry County, Pennsylvania. hereinafter called "Purchaser".
The parties hereto, intending to be legally bound hereby, mutually agree as follows:
I. Seller agrees to sell, grant and convey to Purchaser and Purchaser agrees to purchase
and accept the conveyance of the following described real property (the premises):
All that certain piece, parcel and tract of land situate in Saville Township,
Perry County, Pennsylvania, more particularly bounded and described as follows, to
wit:
BEGINNING at a yellow pine tree at the corner of land now or formerly of
Harvey Keller and the public road; thence along said public road, North 34.5 degrees
West 120 feet to land now or formerly of Paul E. and Mary P. Arnold; thence by said
land, North 59.5 degrees East 150 feet to an iron pin at land now or formerly of
Arnold; thence by said land, South 34.5 degrees East 120 feet to line of land now or
formerly of Harvey Keller; thence by land now or formerly of Keller. South 59.5
degrees West 150 feet to the place of BEGINNING.
BEING the same property which was conveyed to Arthur G. Etter by deed of
Judy A. Shenk dated February 15, 1989, and recorded February 16, 1989, in Perry
County Record Book 0522, Page 001. The said Arthur G. Etter having appointed
Arthur L. Etter his attorney in fact by Durable General Power of Attorney dated May
29, 1996, and recorded in Perry County Record Book '151 ,Page 333 '
2. Purchaser agrees to pay the sum of Seventeen Thousand and 00/100 ($17,000.00)
Dollars to Seller payable as follows: Commencing August 1, 1996, and on the first day of each
month thereafter, the sum ofTWO HUNDRED FORTY-NINE AND 27/100 ($249.27) Dollars shall
be paid, which sum shall first be applied on account of interest on the unpaid balance at the rate of
five (5.0 'Yo) per cent per annum, and the remainder of said installments shall be applied on account
of reduction of the principal. On or before April I. 2003, the principal balance and accrued interest
may be paid at any time by Purchaser and he shall be entitled to receive a deed as provided herein,
however, all the principal balance and accrued interest hereunder shall be payable no later than April

I. 2003. The foregoing provisions for the periodic payment of principal and interest shall not extend
or otherwise modify the final maturity date mentioned herein above, said maturity date being the
essence of this Agreement. Until final settlement, title shall remain in Seller but at time of linal
settlement Seller agrees to grant and convey title in fee simple, by special warranty deed, free and
clear of all encumbrances, except easements visible or of record and building and use restrictions.
3. After this date, Purchaser agrees to pay any and all County , Township, and School
District real property taxes applicable to said property. Purchaser further agrees to be responsible for
all municipal assessments following the date hereof. All realty transfer taxes shall be shared equally
at the time of final settlement, Seller's share not to exceed $170.00.
4. Purchaser shall be entitled to possession of the premises immediately. On default in
payment of any monthly installmentlmder this Agreement for ten (10) or more days, Purchaser shall
pay to Seller a late charge of four percent (4%) of such monthly installment. On default in payment
of any monthly installments or in performance of any other obligation under this Agreement for over
thirty (30) days, the Seller may declare this Agreement to be ended, retaining all payments made to
that time as liquidated damages and in such event, the Prothonotary or any attorney of any court of
record of Cumberland County is hereby authorized to appear for and to confess judgment in an
amicable action of ejectment against Purchaser, his heirs, assigns, executors, administrators or
lessees and in favor of the Seller, his heirs, assigns, executors, administrators or lessees for the
premises herein described and to direct the immediate issuing of a Writ of Possession with Writ of
Execution for costs, including an attorney's fee of five percent (5%) on the unpaid balance of the
purchase price, without asking leave of court, or, at the option of the Seller, said Prothonotary or
attorney is authorized to confess judgment against the Purchaser and in favor of the Seller for the
entire unpaid balance of the purchase price, together with costs, interest, insurance payments, etc.,
and with five percent (5%) added as an attorneys fee. The authority hereinbefore granted shall not
be exhausted by one exercise thereof, but may be exercised as often as there shall occur a default by
Purchaser as aforesaid.
5. No major renovations or alterations shall be made to the Premises that will result in
a decrease in value of the Premises or impair Seller's security hereunder without the prior written
consent of Seller. Purchaser agrees that Seller or Seller's agent shall have the right at all reasonable
times of the day and upon reasonable notice under the circumstances to enter the Premises tor the
purposes of inspection to determine whether Purchaser has complied with terms hereof. Any and
all improvements and additions made to the Premises shall be and remain a permanent part of the
Premises and shall not be removed by Purchaser. In the event of a default hereunder and foreclosure
by Seller resulting in Seller's retaking possession and ownership of the Premises, Purchaser shall not
be entitled to any reimbursement for such renovations or alterations; provided, however, that if such
improvements, alterations or additions were made without the written prior approval of Seller,
Purchaser will remove the same within thirty (30) days upon written notice from Seller to so do. In
the event of such notice to remove such items. Purchaser will repair the surfaces from which such
improvements were removed and leave such surfaces in a condition conforming with surrounding
surfaces. In the event that any alterations or improvements are made to the Premises, Purchaser shall
indemnify Seller from the imposition of mechanics' liens, mechanics' claims and encumbrances of
any nature which might affect Seller's interest in the subject Premises, except as otherwise may be
agreed in writing.
6. The interest of the Purchaser in this contract shall not be assignable by sale.
assignment. lease, subleasing or otherwise, in whole or in part, without the prior written consent of
the Seller. and if such assignment is attempted, the rights stipulated in Paragraph 4 shall accrue to
the Seller. The passing of title by Will or by intestacy shall not be regarded as a forbidden
assignment.
7. In the event any mortgages or judgments are on the premises or are placed on the
premises by Seller, and default of the same is made by Seller, the Purchaser shall have the right to
pay on said obligations and receive credit for monthly payments as above. The Seller agrees he will
not permit any liens or encumbrances in excess of the unpaid balance of the purchase price to be
placed on the property, and to promptly notify Purchaser if any such obligations are in default.
8. The Purchaser agrees, at his expense. to keep the buildings on the premises insured
against fire, with extended coverage, in a company acceptable to Seller tor a sufficient sum to cover
the unpaid purchase price. said insurance to be carried in the name of the Seller, loss payable first
to Seller, and the remainder to the Purchaser, as their interests may appear. A standard homeowner's
