4. Reus's sister-in-law, Cathol'ino M. Clark ("Clark"), a rosidont of Anno
Arundol County, Maryland, diml on .Juno 27, IHH7, l(laving a Will datml
Decombor 2, 1987. A copy of Clark's Will is lIttachod hOl'ot() as I~xhihit "B",
5. Clark's Will pwvides that twonty.fivo (2fi')'<,) J!ercnnt of tho rllsiduo of
her estate passes to Henry Rous, if he survives hor. If' Henry Rous did not survivo
Clark, this interost passos to Ruth'!'. Hous.
6. Henry Reus ("Reus's Spouso") died on .July :{O, UJHB, thus
predoceasing both Clark and Rous.
7. The approximate fail' market valu!) of thn property which would pass
to Reus pursuant to Clark's Will is Thirty-five 'I'housand ($35,000) Dollars.
8. Due to the close proximity of the deaths of Clark and Reus, and
unless this Honorable Court grants the relinf requestml herein, the property to
which Reus is entitled would be subject to Maryland inheritance tax hy reason of
Clark's death and would be subject to Pennsylvania inheritance tax by reason of
Reus's death. Reus's sole surviving heir is her daughter, Anne R. Towner, wife of
the Petitioner.
9. Pursuant to Reus's Last Will and 'I'estament, all of her property will
pass to her daughter, Anne R. Towner.
10. Pursuant to Maryland's Estatos and Trust Code ~9-204, sinco the
devolution to Reus under Clark's Will was not expressly conditioned on Reus's
survival of Clark, tho property would pass to Reus's intnstate heirs if Rnus's
Estate disclaims the property. Reus's sole intestate heir is her daughter, Anne R.
Towner. The ultimate beneficiary, if disclaimer is permitted, will be Reus's
daughter, Anne R. Towner.
