Petitioner seeks the appointment of an emergency guardian of her person for the limited purpose of consenting to the surgical insertion of II PEG tube and related medical or surgical procedures, 22. Beverly petitioned the Court for an 3 Order compelling the insel'lion of the I'EO tllhe, which. in its opinion, was the method least restrictive of Helenlkhman's rights, The petition was heard in cham hers hy Judge Ohler and Presi<!l\nt Judge Sheely, who denied the petition ami indicated that the Court would entertain a petition for the appointment of an elllergllney guardian pursuant to 20 l'a,(',S,A, * 5513, Petitioners have accordingly filed the instant petition, which seeks appointment of an emergency guardian for the limited purpose of eonsellling to the surgical placement of a PEO tube and related medical and surgical procedures, Petitioner helieves that this altemative is the least restrictive of Helen llehman's rights. 23. The failure of the Court to appoint an (~mergency guardian of the person of Helen Uchman may result in irreparahle harm in that Helen lIchman will be unable to receive continued nutrition and hydration via PEO tube, 24. Representatives of the Cumberland County Area Agency on Aging ("the Agency"), 16 West High Street. Carlisle, I'A 17013, havc indicated a willingness for the Agency to serve as emergency guardian of thc person of Helen Uchman. See Consent of Guardian attached hereto as Exhibit 3, 25. MYERS snCfU2TARY GUARDIANSHIP REPORT FOR HELEN UCHMAN NOVEMBER 6, 1997 Report from Emergency Guardian of Person Cumberland County Office of Aging Janet E. Paull, Aging Care Manager II On October 3, 1997 Emergency Temporary Guardianship of Person for Helen Uchman was granted by Judge George E. Hoffer to Cumberland County Office of Aging. This guardianship was granted for the limited purpose of consenting to the surgical placement of a percutaneous endoscopic gastronomy (PEG) tube and other related medical or surgical procedures necessary for the health and welfare of Helen Uchman, and to authorize her admission to a hospital or other medical facility for the purpose of carrying out these procedures. On October 15, 1997 this guardianship was extended to November 4,1997. The required surgery was performed by Susquehanna Surgeons at Holy Spirit Hospital on October 15, 1997. A feeding pump is being used in conjunction with the PEG tube to provide the necessary liquid nutrition, On October 8,1997 client's weight was 136.7, Her weight on November 5, 1997 was 140,6 showing a 3.9 Ib increase since insertion of the tube, In addition, the possibility of aspiration has been greatly reduced. As of November 4, 1997 the appointment of the Cumberland County Office of Aging as Emergency Guardian of Person for Helen Uchman has expired. It is our understanding that the petitioner, Beverly Enterprises - Pennsylvania, Inc. will be petitioning the court for an appointment of a permanent guardian at a later dale. 12.. Helen Uchman also suffers from aspiration syndrome and cannot be orally fed, and it is unlikely that she wil1 ever regain this ability. (Exhibit 1.) 13, Helen Uchman Is Incapable of communicating In oral or written form. (Exhibit 1.) 14. Helen Uchman is bedridden and completely dependent on a feeding tube for nutrition and hydration. The feeding tube was surgically placed on October IS, 1997, with the consent of the Cumberland County Area Agency on Aging, which had heretofore been appointed by this Court's Orders of October 3 and October 15, 1997 as emergency guardian of the person of Helen Uchman. (Exhibit 1.) IS. Helen Uchman's mental status is not expected to improve. Her physician believes that the progression of her Alzheimer's Disease/dementia is irreversible. (Exhibit 1.) 16. According to her physician, Helen Uchman is physically and mentally unable to attend a proceeding in court, and, in fact, her condition would be harmed by her presence in court. (Exhibit 1.) 17. According to the CHCC executive director, Helen Uchman has not heretofore executed any living will, advance directive for health care, power of attorney or any other docum~nt ~videncing her wishes regarding her continued medical treatment or the handling of her financial and personal affairs in the event of her incapacitation, (Exhibit 2.) 18. The severity of Helen Uchman's mental and physical condition mandates that a plenary guardian be appointed to administer all aspects of her estate and to make decisions concerning her person, including but not limited to her living arrangements, her medical and psychiatric care, the administration of medications, surgical interventions, the employment and discharge of physicians, dentists, nurses, etc. for her physical care. 3 19. Petitioner has consistently sought to obtllin intervention on Helen Vchman' s behalf in the least restrictive means possible, Following the dillgnosis of Helen Vchman's lIspirntion syndrome, ,Petitioner requested that the Court grllnt an Order compelling the insertion of her feeding tube, which, in its opinion, was the method least restrictive of Helen Vchman's rights, The petition was heard in chambers by Judge Ohler and President Judge Sheely, who denied the petition and indicated that the Court would entertain a petition for the appointment of an emergency guardian pursuant to 20 Pa.C,S,A, ~ 5513. 20, Petitioners then filed a petition for emergency guardianship, which was granted by the Court on October 3, 1997, resulting in the appointment of the Cumberland County Area Agency on Aging only as emergency guardian of the person of Helen Uchman, Because the Agency was unwilling to consent to becoming permanent guardian of the person and the estate of the alleged incapacitated person, Petitioner on October 15, 1997 requested that the Court extend the emergency guacdianship for twenty days under 20 Pa.C.S,A, ~ 5513, for the purpose of allowing more time to identify a social services agency to assume a pennanent plenary guardianship. The Court granted the petition and extended the Agency's emergency guardianship until November 4, 1997. 21. No other guardians of either the person or estate of Helen Vchman have been appointed, and no other court has assumed jurisdiction in any proceedings to detennine the capacity of Helen Uchman, the alleged incapacitated person, 22. The proposed plenary guardian of the person and estate of Helen Vchman is Neighborhood Services, Inc.. a non-profit social services agency located at 100 South Queen Street, P,O. Box 1593, Lancaster, PA 17608-1593, ~ConsentofProposedGuardian, allached hereto as Exhibit 3. 4 AFFIDAVIT OF GREG EHGARTNER. D.O. If the Court finds you to be an incapacitated person, your rights will be affected, including your right to manage your money and property and to make decisions. A copy of the petition which has been filed by Beverly Enterprises -Pennsylvania, Inc. is attached. You also have the right to request that the Court order that an independent evaluation be conducted as to your alleged incapacity. If the Court decides that YOll are an incapacitated person, the Court may appoint a guardian for you, based on the nature of any condition or disability and your capacity to make and communicate decisions. The guardian will be of your person and/or your money and other property and will have either limited or full powers to act for you. If the Court finds you are totally incapacitated, your legal rights will be affected and you will not be able to make a contract or gift of your money or other property. If the Court finds that you are partially incapacitated, your legal rights will also be limited as directed by the Court.
