LAST WILL AND TESTAMENT OF
~THLEEN A. DETE
I, ~THLEEN A. DETE, of the Borough of carlisle, cumberland
County, Pennsylvania,. do hereby make this my Last Will and
Testament, reVOking any former wills and codioils made by me.
FIRST I I am an unremarried widow. I have seven ohildrenl
Anne K. Kostrol Leo J. Dete IIII Mary D. Wernerl G. Ellen shankl
George D. Detel Rita D. Widmann/ and Kathryn A. Nook. These
persons are described in thieWill as "my children," or as "a
child of mine."
I' SECONDI I give my tangiple personal property and all
oasualty insurance ,that I am oarrying on aaid tangible personal
proPerty to suoh of my ohildren who are living at my death to be
divided equitably among or between them as ,they may'determine,
or, if they are unabl~ to agree, as my Exeoutor shall determine"
after oonsidering the wishes of suoh ohildren. I have oomplete
confidenoe that my children or my Exeoutor will honor any written
instruotions that I may leave with regard to said tangible
personal property. Any suoh property not eo distributed shall be
sold, and the prooeeds added to my residuary esta~e to pass as
hereafter. described.
THIRDI I give, devise and bequeath the rest. 'residue and
remainder of my estato, real and personal, to Leo J. Dete III,
Trustee (hereinafter oalled "Trustee" and referred to in the

singular neuter gender) under my Trust Agreement da~ed Septem~
per 15, 1ge9, IN TRUST NEVERTHl!:l,ESS, to be held, administered and
distributed in the manner provided by the terms of said Trust
Aqreement. Should the aforesaid bequest to Leo J. Dete IU,
Trustee, fail for any reason, I give, devise, and bequeath all
the rest, residue and remainder of my estate, real and personal,
in equal shares \:0 my ohildren. If any of my ohildren shpuld
predeoease me, their share shall go to their issue, per stirpes,
or, if they fail to be survived by issue, their share shall go
. equally to their brothers and sisters, or their issue, per
etirpes.
FOURTH, If any share hereunder beoomes distributable to a
benefioiarywho has not attained the age of twenty-five (25)
years, then suoh share shall immediately vest in suoh benefioi-
ary, but notwithstanding,the provisions herein, a Truetee, to be
seleoted by my Exeoutor and to serve without bond, shall retain
possoseion of such share in trust for such beneficiary until such

beneficia~y .attains the age of twentY-five (25) years, using so
much of the net income and prinoipal, of such share as such

FIFTHI If any benefioiary and I should die under suoh
oiroumstanoes as woula render it doubtful whether the benefioiary

purpolieS of this my Will that said benefioiary predeoeased me.
SIXTHI (1) I name as my Exeoutor, my son. Leo J. Dete III.

in whioh oalled upon to aot.
(2) If Leo J. Dete III, or any suooessor as herein
aefinoad,shoula fail to qualify as my Exeoutor hereunder, ,or for
any reason shoula oease to, aot in such oapaoi ty, the suooessor or
substitute Exsoutor shall bedesiqnated in a written instrument
filed with the oo~\rt havih9 jUrisdiotion oV(ilr the probate of my
estate and si9ned by Leo J. Dete III .or, if he fails to aot,
siqnea by or on behalf of a majority of , my then-survivinq

ohildren, or, if they fail to aot, by the oourt having jurisdio-
tion over the probate of my estate.
(3) For servioes as Exeoutor, my Exeoutor shall be
entitled to reoeive reasonable oompensation.
SEVENTHl (1)
I give to any fiduoiary named in this Will
or any Codioil hereto or to any suooessor or substitute fiduoiary
all of the powers now applioable by law to fiduoiaries in the
commonwealth of Pennsylvania and in partioular through the
Pennsylvania Probate. Estates and Fiduoiaries Code, as effeotive
and as in effeot on the date hereOf, during the administration
and until the oompletion of the distribution of my estate, an~
until the termination of all trusts oreated in this will or any
codioil hereto and until the oompletion of the distribution of
the assets of suoh trusts.
(2) My Exeoutor shall have absolutedisoretion, but
shall not be required. to make adjustments in the rights of any
benefioiaries, or among the prinoipal and inoome aooounts to
oompensate for ,the oonsequenoes of any tax deoision or eleotion,
or of any investment or administrative deoision, that my Exeoutor
believes has'had the effeot/direotly or indireotly, of prefer-
ring one benefioiary or group of benefioiaries over others. In
determining the federal estate and inoome tax liabilities of my
estate, my Exeoutor shall have disoretion to seleot the valuation
date and t6 determine whether any or all of the allowable

adm!nistration expenses in my estate' shall be used as federal
estate tax deduotions or as federal inoome tax deduotions.
(3) MYfiduoiaries are authorized and empowered to
retain, either permanently or for suoh period of time as suoh
fiduoiaries may determine, any assets, inoludinq the oapital
stook of any oloselY held oorporation, whioh at any time shall
oomeinto the posaession of,. suoh fiduoiaries as a part of any
trust oreated herein, whether suoh assets are or are not of the
oharaoter approved or authorized by law for illveEltment by
f~duoiaries and whether suon assets do or do not reprssent an
overoono~ntration in one investment.
EIGHTH I (1) All estate. inheritanoe, suooession and other
death taxes imposed or payable by reason of my death and interest

qross estate f?r death tax purposes, whether ,or not suoh property
passes under this WH1, shall be paic1 out of the residUEl of my
estate, as if suoh taxes were expenses of administration, .without

to pay all suoh taxes at suoh time or times as deemed advisable.
(2) I authorize my Exeoutor to sell proper.ty to ~nd .
borrow money from my Trustee upon suoh terms as my Exeoutor and
my Trustee shaU deem appropriate. It is my desil::e that my
Trustee shall make funds available to my ExeoUtor for the paymen~
of all estate, inheritanoe, suooession anc1 other c1eath taxes
