" AND NOW, comes Harry M. Baturin, Esquire, ofBaturin and Baturin, as attorneys for thi~hirmorr:Q~mpany, a creditor of the Estate of Ethel R. Rosenthal and respectfully reFesents the following: 1: Admitted. It is admitted that on May 15, 2006, Harry M. Baturin, Esquire send a notice of a claim by Shirmor Company against the Estate of Ethel Rosenthal. 2: Admitted in part. Said Notice included a claim for $ 3, 318.00, with interest; however, said interest was subsequent modified which Petitioner failed to address in his averments. 3: Admitted. Said Notice included a copy of a billing statement dated December 28, 2001 which bill was forwarded to the decedent ofthe subject estate. 4: Denied. The subject Lease and obligations thereunder expired after January 31, 2002. 5: Admitted, 6: Admitted. 7: Admitted. 8: Admitted. In furtherance thereto, an Estate was opened by the Executor who is also the Attorney for the Estate. 9: Neither admitted nor denied. 10: Denied. The Shirmor Company claim consists of several claims as well as the Deposit Agreement was under Seal and the several claims and Seal Agreement all have different Statue of Limitations. 11 : Denied. 12: Denied. Said bill was incurred while tenants were living. WHEREFORE, Respondent respectfully requests that said claim by Shirmor Company not be discharged and remain payable. By: wivJ. ~. . HARRYM.
